What are the records on correcting errors in mortgage registration information of land use rights and assets attached to land in Vietnam?

Pursuant to Clause 3 Article 20 of Circular 07/2019/TT-BTP stipulates as follows:

Article 20. Storage of applications

2. Records for registration for revision of mortgaged contents include:
a) 1 master register or 1 certified true copy of following papers: Contracts for revision of mortgage agreements or annexes of contracts on changes; Debt sale or purchase agreements, or other documents proving sale or purchase of debts; Contracts or other documents on transfer of right to demand and transfer of obligations as per the law;
b) 1 master register, 1 certified true copy or 1 copy of following papers: Authorization documents in case applicants are authorized persons or documents proving representatives if persons signing application forms are representatives of mortgagors or mortgagees; Other documents proving contents of revision in case of revision on mortgaged contents according to decision or documents of competent agencies;
c) 1 copy of following papers: Application for revision or correction of errors certified by land registration offices; certificates certified in terms of revised contents in case revised contents have been recorded on certificates; List of participated mortgage agreements (if any).
3. Records for error correction include:
a) 1 master register, 1 certified true copy or 1 copy of following papers: Authorization documents in case applicants are authorized persons or documents proving representatives if persons signing application forms are representatives of mortgagors or mortgagees;
b) 1 copy of following papers: Application for revision and correction of errors certified by land registration offices; Certificates containing errors; Application certified for errors; document informing correction of errors in registered contents in case applicants detect errors in cadastral records caused by their faults or document rectifying errors in registered contents in case applicants detect errors.

Thus, according to the provisions on the dossier on correction of errors in registration information on mortgage of land use rights in Vietnam, assets attached to land include:

- 01 original or 01 certified copy or 01 copy of the Authorization Document in case the applicant is an authorized person or a document proving the status of a representative in case the person signing the Request Form is the representative of the mortgagor, mortgagee.

- 01 copy of the following documents:

+ A request form for registration of changes and correction of errors certified by the Land Registration Office; The certificate contains erroneous contents.

+ The request form has certified errors.

+ A written notice of correction of erroneous information on registration contents in case the registration applicant himself detects errors in cadastral dossiers due to his/her fault or a written correction of erroneous information on registration contents in case the registration requester detects errors.

Who is responsible for updating and disclosing information about collateral after registering changes to registered mortgage contents or correcting errors in Vietnam?

Pursuant to Clause 1 Article 9 of Circular 07/2019/TT-BTP stipulates as follows:

Article 9. Responsibilities of agencies related to registration for mortgage of land use rights and assets attached to lands
1. Land registration offices are responsible for informing Departments of Natural Resources and Environment to update and publicize information on collateral after applying to revise mortgaged contents, correct errors and withdraw mortgage information relating to mortgage of investment projects for construction of houses and investment projects for construction other than houses as specified in Article 64 of Decree No. 102/2017/ND-CP .

Thus, according to the above regulations, the Land Registration Office is responsible for sending information to the Department of Natural Resources and Environment in Vietnam to update and announce information on collateral after registering changes in registered mortgage contents and correcting errors.
