What is the explosive pyrotechnic composition? What is the dossier of application for a license to import explosive pyrotechnic composition in Vietnam?
Pursuant to the provisions of Point a, Clause 2, Article 3 of Decree 137/2020/ND-CP, the definition of the explosive pyrotechnic composition is as follows:
Explosive pyrotechnic composition is a product directly used to manufacture fireworks, creates rapid, intense, exothermic and fuming chemical reactions and generates large pressure and explosion sound effects under mechanical, thermal, chemical or electrical impact;
Accordingly, it can be understood that explosive pyrotechnic composition are products used to produce explosive pyrotechnic composition (the type of explosive pyrotechnic composition that cause hisses, explosions and color effects in space).
Pursuant to the provisions of Clause 4 Article 10 of Decree 137/2020/ND-CP, subsection 31 Section D Part II Administrative procedures issued together with Decision 3191/QD-BCA in 2022. A dossier of application for a license for importing explosive pyrotechnic composition includes:
- A written request specifying the type and quantity of explosive pyrotechnic composition and means of transport;
- A copy of the establishment decision or a copy of the Certificate of Business Registration;
- Referral;
- A copy of the citizen's identity card or identity card or passport or military identification card.
Number of applications: 01 set.

What are the steps in the procedure for issuing a license for importing explosive pyrotechnic composition in Vietnam?
Procedures for granting explosive import licenses shall comply with the provisions of Subsection 31, Section D, Part II, administrative procedures issued together with Decision 3191/QD-BCA in 2022.
As follows:
- Step 1: Agencies, organizations and enterprises at the central level wishing to issue licenses for importing explosive pyrotechnic composition shall apply at the Police Department on Administrative Management of Social Order - Ministry of Public Security of Vietnam during office hours on weekdays, through the online public service portal or via the postal service.
- Step 2: The receiving officer checks the validity and composition of the dossier. If the dossier meets the conditions and procedures, it shall receive the dossier, deliver the receipt or notify on the online Public Service Portal to the person assigned by the agency, organization or enterprise.
In case the dossier is eligible but lacks procedures or incomplete and accurate declaration, the written instructions or notice on the online Public Service Portal clearly state the procedures and contents to be supplemented and declared.
In case the application is not eligible, the dossier shall not be received and a written response or notice on the Online Public Service Portal stating the reasons for not receiving the application.
- Step 3: Based on the appointment date on the receipt or notice on the online public service portal, agencies, organizations and enterprises that are granted licenses to import explosive pyrotechnic composition come to receive explosive import licenses or receive them through the online public service portal, via the postal service.
In which:
- Time limit for settlement: 05 working days.
- Subjects of administrative procedures: Organizations and enterprises.
- Agency carrying out administrative procedures: Department of Police administrative management of social order - Ministry of Public Security of Vietnam.
- Results of administrative procedures: The license for importing explosive pyrotechnic composition is valid for 60 days.
- Fee (if any): 150,000 VND/01 license.
What is the implementation of the management and storage of explosive pyrotechnic composition in Vietnam?
Pursuant to the provisions of Article 6 of Decree 137/2020/ND-CP, the management and storage of explosive pyrotechnic composition shall meet the following conditions:
- Management and preservation of consumer fireworks, fireworks and pyrotechnic compositions must meet following requirements:
+ Ensuring security, order, safety and fire safety requirements as per the law; and
+ Location for storage and preservation of consumer fireworks, fireworks and pyrotechnic compositions must be guaranteed in terms of security, order, safety, fire safety, lightning protection, static control and environmental protection according to national technical regulations, national technical standards and relevant law provisions;
+ Location for storage and preservation of consumer fireworks, fireworks and pyrotechnic compositions must develop regulations on ensuring security, order, safety, fire protection; develop protection measures, assign guard forces and organize guard around the clock; examine, control security, safety, fire safety, fire fighting conditions for individuals and vehicles entering, leaving and working in storage area; install restriction signs and signs for regulations related to safety, fire prevention; post procedures for arranging, preserving, extracting and supplying; emergency response plans; fire prevention, rescue and evacuation measures; security and order measures, plans or measures for preventing and responding to chemical hazards; fully equip fire prevention and firefighting equipment and devices.
- For pyrotechnics and pyrotechnic compositions collected from cases and agencies, submitting organizations and individuals must stringently manage and preserve the pyrotechnics, pyrotechnic compositions as per the law; storage must conform to Point c Clause 1 of Article 6 of Decree 137/2020/ND-CP.
- Processes of handling, transporting and preserving pyrotechnics and pyrotechnic compositions must avoid dramatic impact and sources of heat or electricity; prohibit fire or objects that can produce fire or sparks.
