Under the provisions of Clause 1, Article 28 of the Education Law 2019 as follows:
Educational levels and entry ages
1. Educational levels and age groups of general education are regulated as follows:
a) Primary education lasts for 05 academic years, from the first to the fifth grade. The entry age for the first grade is 06;
b) Lower secondary education lasts for 04 academic years, from the sixth to the ninth grade. Students must complete the primary educational programme before entering the sixth grade. The entry age for the sixth grade is 11;
c) Upper secondary education lasts for 03 academic years, from the tenth to the twelfth grade. Students must complete the lower secondary educational programme before entering the tenth grade. The entry age for the tenth grade is 15;

Duties of primary school students
Under Article 34 of the primary school charter promulgated together with Circular 28/2020/TT-BGDDT, the duties of primary school students in Vietnam are:
- Study and train according to the educational plan and rules of the school; have a sense of self-discipline in learning and training to comprehensively develop qualities and capacities according to the objectives of the general education program at the primary level.
- Fully and effectively perform academic tasks; know how to self-study under the guidance of a teacher; actively and actively participate in experiential activities, apply learned knowledge into real life; exercise your body, maintain personal hygiene.
- Be filial to parents and grandparents; show them respect and civility; be kind to your instructors and elders; and come together to support your friends, family, and those who are less fortunate or have disabilities;
- Abide by rules and protect school property and public places; observe traffic order and safety; maintain hygiene and protect the environment
- Contribute to fostering, preservation, and enhancement of traditions of schools and localities.
Rights of primary school students
Under Article 35 of the primary school charter promulgated together with Circular 28/2020/TT-BGDDT, the rights of primary school students in Vietnam are:
- Have the right to learn
+ Be educated and studied to develop comprehensively and bring into full play their potential; To study at a school or class that implements the general education program at the primary level that is convenient for them to travel in the area of residence.
+ Students are allowed to choose a school or transfer to another school outside their place of residence if that school has the ability to accept.
+ Primary school students returning home from abroad, children of foreigners studying and working in Vietnam, children in difficult circumstances who have not yet been able to attend schools, if they wish to move to a primary school, shall be surveyed by the principal to arrange a qualification survey to be placed in appropriate classes.
+ Students with disabilities are allowed to learn inclusively in a primary school; be guaranteed conditions for learning and training; be learned and assessed according to the student's individual education plan.
+ Students are allowed to learn to shorten the program implementation time, study at an age higher than the prescribed age, study to extend the time, and study in committees.
+ Students with good physical strength and early intellectual development can study beyond the grade within the scope of education level.
+ Students with limited learning results, who have been directly guided by teachers, parents or guardians of students but have not yet completed, depending on the degree of incompletion of learning and training tasks, teachers report to the principal to consider the decision to go to class or stay in class, At the same time, together with the family, decide on appropriate educational measures.
- Be protected, cared for, respected, and treated equally and democratically; be guaranteed legitimate rights and interests; be provided with full information about their own learning and training process; be guaranteed the conditions of time, facilities, hygiene, and safety for learning and training.
- Participate in activities that promote the individual's abilities; to express opinions and aspirations of individuals.
- Receive scholarships and enjoy social policies as prescribed.
- Enjoy other rights as prescribed by law.
What are the duties and rights of lower and upper secondary school students in Vietnam?
Under the provisions of Article 34 of the Charter issued with Circular 32/2020/TT-BGDDT, the duties of lower and upper secondary school students in Vietnam are specified as follows:
- Learn and train according to the curricula and education plans of their schools.
- Respect their parents, officials, teachers and staff of their schools, and those older than them; maintain solidarity and mutual support in learning and training; conform to the charter and rules of their schools; and abide by the law.
- Take exercises and maintain personal hygiene.
- Participate in group activities of their schools and classes, Ho Chi Minh Young Pioneer Organization and Ho Chi Minh Communist Youth Union; help their families, join physical and social activities and environmental protection activities, and maintain traffic order and safety.
- Protect school and public property; contribute to fostering, preservation and enhancement of school traditions.
Under the provisions of Article 35 and Article 35 of the Charter issued with Circular 32/2020/TT-BGDDT, the rights of lower and upper secondary school students in Vietnam are specified as follows:
- Receive comprehensive education with fairness, be provided with time, facilities, hygiene and safety to learn in class and self-learn at home, be informed of their education and training, and be able to use learning, cultural and sport equipment of their schools as per the law.
- Receive respect, protection and fair and democratic treatment, complain to their schools and education authorities about decisions concerning themselves; transfer school with legitimate reason as per existing regulations; enter school before the compulsory starting age, skip a grade and study at an age higher than the compulsory attendance age according to regulations in Article 33 of this charter.
- Participate in activities for development of their gifts in academic subjects, sports and art organized by their schools if able to.
- Students eligible for social benefits, disadvantaged students and gifted students may receive sponsorship or other benefits as per the law.
- Transfer school if eligible according to regulations following school transfer procedures stipulated by the Minister of Education and Training.
- Enjoy other rights as per the laws.
