What is the application form for issuing a certificate of satisfaction of security and order conditions to a tourist accommodation establishment in Vietnam?
Pursuant to the provisions of Article 48 of the 2017 Law on Tourism, hotels are a type of tourist accommodation establishment.
Tourist accommodation establishments are identified as subjects that must meet security and order conditions. Therefore, when providing hotel services, establishments must make an application form for issuing a Certificate of satisfaction of security and order conditions by a competent authority.
Currently, the application form for issuing a certificate of satisfaction of security and order conditions to a tourist accommodation establishment in Vietnam is Form No. 03 in the Appendix issued with Decree 56/2023/ND-CP on amendments to some Articles of the Government’s Decree No. 96/2016/ND-CP dated July 01, 2016 providing for security and order conditions for a number of conditional business lines, Decree No. 99/2016/ND-CP dated July 01, 2016 on management and use of seals and Decree No. 137/2020/ND-CP dated November 27, 2020 on management and use of pyrotechnics.

Which entities have the power to issue certificates of satisfaction of security and order conditions to tourist accommodation establishments in Vietnam?
Pursuant to the provisions of Article 24 of Decree 96/2016/ND-CP amended in Article 1 of Decree 56/2023/ND-CP, the power to issue certificates of satisfaction of security and order conditions to tourist accommodation establishments in Vietnam is specified as follows:
+ The Police Department for Administrative Management of Social Order directly under Ministry of Public Security shall certificates to tourist accommodation establishments rated at 05 stars or above
+ Police authorities of districts affiliated to provinces or central-affiliated cities shall issue certificates of satisfaction of security and order conditions to accommodation establishments featuring 10 to 20 rooms;
+ Police authorities of districts affiliated to provinces or central-affiliated cities shall issue certificates of satisfaction of security and order conditions to accommodation establishments featuring 10 to 20 rooms
+ Communal police authorities shall issue the certificate of satisfaction of security and order conditions to the tourist accommodation establishments featuring fewer than 10 rooms
What are the ratings of tourist accommdation establishments in Vietnam?
Based on the provisions of Article 50 of the 2017 Law on Tourism, tourist accommodation establishments are rated as follows:
- The owner of a tourist accommodation establishment may voluntarily apply for rating of the establishment by a competent authority.
* Hotels, tourist villas, tourist apartments and cruise ships shall be rated according to the national standards. Tourist accommodation establishments shall be rated according to a 05 star system.
* The power to rate tourist accommodation establishments:
- The General Department of Tourism has the power to assign 04-star and 05-star ratings.
- The tourism authority of the province shall assign as 01-star, 02-star and 03-star ratings.
(*) An application for rating of a tourist accommodation establishment includes:
An application form for rating of a tourist accommodation according to the form specified by the Minister of Culture, Sports and Tourism.
- A self-assessment form of the quality of the tourist accommodation establishment in accordance with the regulations of the national standards in rating of tourist accommodation establishments.
- The list of managers and employees of the tourist accommodation establishment;
- Certified true copy of qualifications, certificate of professional training and certificate of the working experience in tourism industry of the managers of the tourist accommodation establishment.
* The procedures for rating a tourist accommodation establishment:
- The owner of the tourist accommodation establishment shall submit 01 application to a competent authority specified in Clause 3 of this Article. In case the application is invalid, within 03 working days from the day on which that application is received, the competent authority must issue a written notice and clearly state the contents that need revising;
- Within 30 days from the day on which a valid application is received, the competent authority shall take charge and cooperate with the socio-professional organization for tourism in rating the tourist accommodation establishment; in case of refusal to rate, a written response stating reasons thereof must be given.
A decision on rating of a tourist accommodation establishment is valid for 05 years. After the expiry of the decision, the owner of the tourist accommodation establishment wishes to reapply for rating of his/her tourist accommodation establishment, he/she shall comply with regulations specified in Clauses 4, 5 and 7 of this Article.
- The fees for rating of the tourist accommodation establishment shall comply with regulations of the law on fees and charges.
The rating plate of a rated tourist accommodation establishment shall be displayed at its main entrance gate.
