Pursuant to Clause 1 Article 4 of Circular 31/2015/TT-BCA:
Procedures and power to process applications for issuance of temporary residence cards
1. The inviting entity shall apply for issuance of a temporary residence card on behalf of an eligible foreigner prescribed in Clause 2 Article 36 of this Law at Immigration Administration Department or Division of immigration administration of police authority of the province or central-affiliated city (hereinafter referred to as province) where the inviting entity’s headquarter is located or where the inviting entity resides.
Thus, temporary residence cards shall be issued to foreigners throught inviting entities.
According to the provisions of Circular 31/2015/TT-BCA, the application for a temporary residence card to foreigners in Vietnam shall comply with Circular 04/2015/TT-BCA. However, currently, the Ministry of Public Security has just issued Circular 22/2023/TT-BCA amending some forms issued together with Circular 04/2015/TT-BCA. Therefore, some application forms for issuance of temporary residence cards to foreigners in Vietnam issued together with Circular 22/2023/TT-BCA shall be used:

What are the cases of issuance of temporary resident cards to foreigners in Vietnam?
Cases of issuance of temporary resident cards and symbols thereof are prescribed in Article 36 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014 amended by Clause 14 Article 1 of the Law on Amendments to Law on entry, exit, transit and residence of foreigners in Vietnam in 2019 as follows:
Cases of issuance of temporary resident cards include:
+ Foreigners who are members of diplomatic missions, consular missions, representative offices of international organizations affiliated to United Nation, intergovernmental organizations in Vietnam and spouses, children under 18 years of age and helpers accompanying on missions;
+ Foreigners making entry on LV1, LV2, LS, DT1, DT2, DT3, NN1, NN2, DH, PV1, LD1, LD2 and TT visas.
What are the current procedures for issuing a temporary residence card in Vietnam?
Procedures for issuance of temporary residence cards specified in Article 37 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014 amended by Clause 15 Article 1 of the Law on Amendments to Law on entry, exit, transit and residence of foreigners in Vietnam in 2019 are as follows:
- An application for the temporary residence card consists of:
+ A written request from the inviting entity;
+ A declaration bearing a picture;
+ The passport;
+ Documents proving eligibility for issuing a card
- An application for a temporary residence card shall be processed as follows:
+ The diplomatic mission, consular office, or another agency authorized by the foreigner in Vietnam shall send the application for the NG3 temporary residence card to a competent authority of the Ministry of Foreign Affairs;
+ Agencies, organizations and individuals directly inviting or sponsoring shall submit application for issuance of temporary resident cards for foreigners specified in Point b Clause 1 Article 36 of this law at immigration authorities where the inviting or sponsoring agencies or organizations are based or where the inviting or sponsoring individuals reside;
+ Within 05 working days from the receipt of sufficient documents, the immigration authority or the competent authority of the Ministry of Foreign Affairs shall consider issuing the temporary residence card.
What are the entities that invite or sponsor foreigners to enter Vietnam?
Pursuant to the provisions of Article 14 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014, entities that invite or sponsor foreigners in Vietnam are as follows:
Entities that invite or sponsor foreigners to enter Vietnam (hereinafter referred to as inviting entities) according to Clause 2 Article 10 of Law on entry, exit, transit and residence of foreigners in Vietnam 2014 include:
- Secretary General of Vietnam’s Communist Party, the President of Vietnam, the President of the National Assembly, the Prime Minister;
- Standing members of the Secretariat of Vietnam’s Communist Party, Deputy President of Vietnam, Deputy President of the National Assembly, Deputy Prime Minister, President of Central Committee of Vietnamese Fatherland Front, Executive Judge of The People’s Supreme Court, the Chief Procurator of the Supreme People’s Procuracy, State Auditor General; Ministers and the equivalent, Secretary Generals of provincial Communist authorities, Presidents of the People’s Councils, Presidents of the People’s Committees of provinces;
- The agencies and units affiliated to Central Communist Party Agency of Vietnam, agencies of the National Assembly, agencies affiliated to Standing Committee of the National Assembly, Central Committee of Vietnamese Fatherland Front, The People’s Supreme Court, the People’s Supreme Procuracy, State Audit Agency, ministerial agencies, Governmental agencies;
- Provincial communist parties, the People’s Councils, the People’s Committees of provinces;
- Central agencies of socio-political organizations, social organizations, Vietnam Chamber of Commerce and Industry;
- Companies established within Vietnam’s Law;
- Diplomatic missions, consular offices, representative offices of international organizations affiliated to the UN, intergovernmental organizations in Vietnam;
- Representative offices, branches of foreign traders; representative offices of other foreign economic, cultural, and professional organizations in Vietnam;
- Other organizations with legal status as prescribed by Vietnam’s law;
- Vietnamese citizens residing in Vietnam, foreigners having temporary residence cards or permanent residence cards.
The aforementioned entities must invite or sponsor foreigners within the functions, tasks, and entitlements prescribed by law or by the operating licenses issued. Vietnamese citizens residing in Vietnam, foreigners having temporary residence cards or permanent residence cards may invite or sponsor foreigners to visit Vietnam, and must present papers proving their relationship with the persons invited or sponsored.
