What are the details of National Technical Regulation QCVN 40:2015/BGTVT on road motor vehicle driving test centers in Vietnam?

National Technical Regulation QCVN 40:2015/BGTVT on road motor vehicle driving test centers in Vietnam was issued together with Circular 79/2015/TT-BGTVT.

Accordingly, this National Technical Regulation stipulates technical requirements on facilities and equipment for Road Motor Vehicle Driving Test Centers.

This National Technical Regulation applies to organizations and individuals involved in the construction, supply of equipment and management of the Center's operations.

What are the general requirements for facilities of road motor vehicle driving test centers in Vietnam?

Under National Technical Regulation QCVN 40:2015/BGTVT, the general requirements for facilities of road motor vehicle driving test centers in Vietnam are specified as follows:

- The center must have sufficient material foundations and technical equipment to meet the driving test requirements according to the contents and procedures of the driving test promulgated by the Minister of Transport, be located in a place with convenient roads and conditions on electricity supply, water, drainage, communications, no electromagnetic disturbances affecting fault reporting and grading devices installed at the Center.

- Class 1 center has an area of not less than 35,000 m2, has all basic works such as the test yard, operator and ancillary works, has a vehicle distance in the test yard not less than 1.2 km, has a size suitable for arranging enough driving test sites.

- Class 2 center has an area of not less than 20,000 m2, has all basic construction items such as test ground, operator and ancillary works, has a vehicle distance in the test yard not less than 0.8 km, has a size suitable for arranging enough driving tests.

- Class 3 center has an area of not less than 4,000 m2, has all basic construction items such as test ground, operator and ancillary works, suitable size to arrange enough driving tests.

- The center must have sufficient facilities, equipment and labor force to collect and store domestic waste according to regulations; plant trees around the test yard or take measures to minimize the effects of noise, dust and exhaust from motor vehicles used for testing; posting regulations on environmental sanitation in public places.

- The center must build, install and maintain the technical condition of lightning protection systems and fire prevention and fighting equipment according to regulations, certified by competent agencies to ensure safety.

- The center must be equipped with a backup generator that can automatically generate electricity at intervals not exceeding 10 minutes from the loss of mains power with a capacity of at least 10 kVA for Class 3 Centers and 20 kVA for Class 1 or Class 2 Centers.

- The center must be equipped with the following supporting equipment:

+ Internal communication radio: at least 02 sets for type 3 centers and 04 sets for type 1 or type 2 centers.

+ Sound system: at least 01 set of loudspeakers to publicly announce the results, errors deducting points of test takers.

+ Display screen system for Type 3 Center: there are at least 03 screens of 32 inches or more at the test waiting room to publicize the process of monitoring the theoretical test room, theoretical test results, driving test results in the picture.

+ Display screen system for type 1 or type 2 centers: there are at least 05 screens of 32 inches or more, of which, 01 screen must be arranged at the examination council room to supervise the theoretical test room, 04 screens at the test waiting room to display theoretical test results, Driving test results pictured, road driving test results and theoretical test room monitoring.

+ Camera installed in a theoretical test room, with a minimum pixel count of 0.3 mega pixels, minimum range resolution of 320x240, JPEG image format, minimum focal length of 2.8 mm, minimum viewing angle of 90°, minimum brightness of 5 Lux, night vision of at least 3 m, connected to the display screen and image storage device for at least 40 hours.

- Roads for driving tests are on public roads, with a length of at least 02 km with situations such as: concurrent junctions, narrow roads, places allowed to make U-turns, with average traffic density.

What are the responsibilities of importers of driving test equipment in Vietnam according to National Technical Regulation QCVN 40:2015/BGTVT?

In the National Technical Regulation QCVN 40:2015/BGTVT, the responsibilities of importers of driving test equipment in Vietnam are specified as follows:

- Ensure the conditions of facilities, equipment and human resources to maintain the quality of products and services provided, install testing equipment for customers in accordance with relevant provisions of the Law on Quality of Products and Goods, specifically:

- Provide product service and warranty, take responsibility for product quality and ensure the operation and maintenance of test equipment installed on cars during the product warranty period;

- Measuring equipment and tools used in the production and quality control of testing equipment must be periodically calibrated according to regulations on measurement and calibration of measuring equipment;

- The manufacturer and assembler must promulgate the production process and control product quality, ensuring conformity with each actual processing and assembly stage;

- The manufacturer and assembler must keep records of the origin of import or purchase domestically of the main components of the test equipment (microprocessor chips, GPS modules, GSM modules, data memory);

- The importer must keep a customs declaration dossier on the origin of imported testing equipment; contracts and addresses of overseas manufacturers and assemblers of testing equipment for each batch of imported testing equipment;

- The manufacturer and assembler must have at least 01 employee for each related job position (or contract for outsourcing parts) such as: hardware design, software, warranty service, customer service (labor contract, certificate, training degree suitable to the job position);

- Ensure the conditions for data transmission from the server connecting the driving test device on the road to the General Department of Roads of Vietnam, the Department of Transport (the Department directly managing the operation of the test center) in accordance with regulations on supply, management and use of data from driving test devices on the road;

- Report to the General Department of Roads of Vietnam in writing before each update, change the software of the scoring equipment system when checking and benchmarking and allow re-inspection when required. Change software recorded on CD or USB is sealed by the manufacturer, importer of the device and sent with a written report;

- Comply with the provisions of the Law on Protection of Consumers' Interests, the Law on Quality of Products and Goods and other relevant laws.
