Currently, ChatGPT is creating a fever across social networks. Therefore, the speed of spread of this term is quite fast. There are many people who, out of curiosity, want to learn about what ChatGPT is, have downloaded applications to find themselves careers.
When accessing the Appstore or CH Play on a mobile phone and searching for the phrase ChatGPT, there will be many applications about ChatGPT, including applications created containing malicious code.
When users have to use applications containing this malicious code, they may have their personal information and bank account passwords stolen.
So, how will the spoofing of the ChatGPT application to perform the above acts be handled?
Pursuant to Article 290 of the 2015 Criminal Code of Vietnam, it provides as follows:
Article 290. Appropriation of property using a computer network, telecommunications network or electronic device
1. Any person who uses a computer network, telecommunications network or electronic device to commit any of the following acts, except for the cases in Article 173 and Article 174 hereof, shall face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment:
a) Using information about another organization's or individual's bank account or card to appropriate the account holder's or card holder's property or illegally pay for the offender's purchases;
b) Making, possessing, trading, using fake bank cards to steal money of card holders or illegally pay for the offenders' purchases;
c) Illegally accessing the account of an organization or individual in order to appropriate their property;
d) Commit frauds in electronic commerce, electronic payment, online currency trading, online capital raising, online multi-level marketing or online securities trading for the purpose of property appropriation;
dd) Illegally establishing or providing telecommunications or Internet services for the purpose of property appropriation;
2. This offence committed in any of the following circumstances carries a penalty of 02 - 07 years' imprisonment:
a) The offence is committed by an organized group;
b) The offence has been committed more than once;
c) The offence is committed in a professional manner;
d) The offence involves 50 - 199 fake cards;
dd) The property appropriated is assessed at from VND 50,000,000 to under VND 200,000,000;
e) The property damage caused by the offence is assessed at from VND 50,000,000 to under VND 300,000,000;
g) Dangerous recidivism.
3. This offence committed in any of the following circumstances carries a penalty of 07 - 15 years' imprisonment:
a) The property appropriated is assessed at from VND 200,000,000 to under VND 500,000,000;
b) The property damage caused by the offence is assessed at from VND 300,000,000 to under VND 500,000,000;
c) The offence involves 200 - 499 fake cards.
4. This offence committed in any of the following circumstances carries a penalty of 12 - 20 years' imprisonment:
a) The property appropriated is assessed at ≥ VND 500,000,000;
b) The property damage caused by the offence is assessed at ≥ VND 500,000,000;
c) The offence involves ≥ 500 fake cards.
5. The offender might also be liable to a fine of from VND 20,000,000 to VND 100,000,000 or prohibited from holding certain positions or doing certain jobs for 01 - 05 years or have part or all of his/her property confiscated.
Accordingly, anyone who uses the fake application ChatGPT to illegally access the bank accounts of organizations and individuals for the purpose of misappropriating property but not in the cases in Article 173 of the Criminal Code of Vietnam 2015, Article 174 of the Criminal Code of Vietnam 2015 may be fined without detention for up to 03 years or imprisoned from 06 months to 03 years.
In addition, it is necessary to base on the act and degree of offense to accurately determine criminal liability according to the above provisions.
In addition to being examined for criminal liability, offenders can also be fined from VND 20,000,000 to VND 100,000,000, banned from holding positions, banned from practicing or doing certain jobs from 01 year to 05 years or confiscating part or all of their property.
Can Vietnamese citizens who create applications with functions similar to ChatGPT be considered high-tech in Vietnam?
Pursuant to Clause 1, Article 3 of the 2008 Vietnam Law on High Technology, the definition of high technology is as follows:
- High technology means a technology that has a high scientific research and technological development content; is integrated from modern scientific and technological achievements; can turn out environmentally friendly products of superior quality and utilities and high added value; and plays an important role in the formation of a new production or service industry or the modernization of an existing production or service industry.
Accordingly, to be considered high-tech, that application must be:
- a high scientific research and technological development content;
- integrated from modern scientific and technological achievements;
- capable of turning out environmentally friendly products of superior quality and utilities and high added value;
- playing an important role in the formation of a new production or service industry or the modernization of an existing production or service industry.
