What is the organizational structure of the Office of the People's Committee of the province or municipalities in Vietnam?

Pursuant to Article 4 of the Joint Circular 01/2015/TTLT-VPCP-BNV stipulates:

Administrative units:

- General Department;

- Economic room;

- Department of Science - Literature;

- Internal Affairs Room;

- Administrative office held;

- Administration - Finance Department;

- Provincial Citizen Reception Committee;

- Special room

For localities that do not meet the criteria to establish a Department of Foreign Affairs, the Department of Foreign Affairs shall be established under the Office of the Provincial People's Committee.

For localities where ethnic minorities live and do not meet the criteria for setting up a Committee for Ethnic Minority Affairs, the Department of Ethnic Minority Affairs shall be established or appointed full-time civil servants to do ethnic work under the Office of the Provincial People's Committee. ;

- In addition to the above-mentioned Chambers, the Office of the Provincial People's Committee may establish no more than 02 additional rooms; separately, the Office of the People's Committee of Hanoi and the Office of the People's Committee of Ho Chi Minh City may be established with no more than 03 additional rooms.

Affiliated public non-business units:

- Guest house;

- Other non-business units established under the decision of the chairperson of the provincial People's Committee according to the provisions of law.

What is the position and function of the Office of the People's Committee of the province or municipalities according to Circular 01?

Pursuant to the provisions of Article 1 of Circular 01/2022/TT-VPCP stipulating the functional position of the Office of the People's Committee of the province or centrally run city of this Circular, there is a change, supplement or replacement. The replacement of Joint Circular 01/2015/TTLT-VPCP-BNV is:

- Controlling administrative procedures;

- Organize the implementation of the one-stop shop, one-stop-shop mechanism in handling administrative procedures under the local authority;

- Organize, manage and publicize official information on the activities of the People's Committee and the President of the provincial People's Committee;

- Managing the internal administration of the Office;

- Advise and assist the People's Committee of the province in the state management of foreign affairs and ethnicities (for localities, the Department of Foreign Affairs and the Committee for Ethnic Minority Affairs is not organized separately).

What are the duties and powers of the Office of the People's Committee of the province or municipalities in Vietnam?

Pursuant to the provisions of Article 2 of Circular 01/2022/TT-VPCP stipulating the tasks and powers of the Offices of the People's Committees of provinces and centrally run cities, it is amended to replace Joint Circular 01. /2015/TTLT-VPCP-BNV :

Firstly: Submit to the People's Committee of the province:

- Decisions related to branches and domains under the management of the Office of the Provincial People's Committee;

- Decision stipulating functions, tasks, powers and organizational structure of the Office of the Provincial People's Committee and the public non-business unit immediately an Office of the Provincial People's Committee (if any);

- Documents detailing the functions, tasks and powers of the Office of the People's Council and the People's Committee of the district, town, city of Loa Vinh, city horoscope under the Central Government (hereinafter collectively referred to as: is the district level,

- Programs and plans related to professional fields of the Office of the Provincial People's Committee,

- Deciding to decentralize and authorize the task of state management to the near future, Mr. LG L, empowered the tax-free transfer agency of the province (hereinafter referred to as the department), the district-level People's Committee.

- Other documents as assigned by the People's Committee of the province

Secondly:

- Submit to the President of the People's Committee of the province for promulgation documents under the authority of the President of the People's Committee of the province as assigned.

- Decisions related to branches and domains under the management of the Office of the Provincial People's Committee;

- Decision stipulating functions, tasks, powers and organizational structure of the Office of the Provincial People's Committee and the public non-business unit immediately an Office of the Provincial People's Committee (if any);

- Documents detailing the functions, tasks and powers of the Office of the People's Council and the People's Committee of rural districts, urban districts, towns, provincial cities and centrally run cities (hereinafter referred to as district);

- Programs and plans related to professional fields of the Office of the Provincial People's Committee,

- To decide on decentralization and authorization of state management tasks in sectors and fields under their competence to specialized agencies under the People's Committees of provinces (hereinafter referred to as departments) and People's Committees of districts;

Thirdly:

Advise and assist the President of the People's Committee and the Vice Presidents of the Provincial People's Committee (hereinafter referred to as the President of the Provincial People's Committee) to perform their tasks and exercise their powers according to their competence:

- Advise and assist the President of the People's Committee of the province to convene and preside over the meetings, meetings and conferences (collectively referred to as meetings) of the People's Committee and the President of the People's Committee of the province: Provincial-level People's Committee presidents give opinions on the organization of the meeting; assume the prime responsibility for, and coordinate with relevant agencies in, preparing programs and contents; urge agencies to send documents; record the promulgation of the notice of conclusions and direction of the Chairman of the provincial People's Committee; hold press conferences and press releases on the contents of the meetings under the direction of the Chairman of the provincial People's Committee.

- Submitting to the President of the People's Committee of the province to assign relevant agencies to prepare the contents for the President of the People's Committee of the province to report, explain and answer questions before the People's Council of the province; coordinate with relevant agencies to help chairpersons of provincial-level People's Committees develop plans and contents for contacting, handling and responding to voters' petitions.

- Advise and assist the President of the Provincial People's Committee: Assign the work of the President of the People's Committee and the Vice Presidents of the Provincial People's Committee; monitor, urge and inspect the coordination between departments and agencies under the provincial-level People's Committees and district-level People's Committees in accordance with law; synthesize and report to the President of the People's Committee of the province to handle arising problems and to promptly adjust accordingly.

- Advise and assist the Chairman of the Provincial People's Committee in improving the way, working method, digital transformation, application of information technology in the direction and administration; maintain discipline, state administrative discipline in the locality.

- Advise and assist the Chairman of the Provincial People's Committee to coordinate in formulating the Regulation on coordination of the work of the Provincial People's Committee with relevant agencies and organizations in the locality.

- Advise and assist the President of the People's Committee of the province in implementing the regime of periodic and extraordinary information and reports in accordance with the provisions of law and the request of the competent authority.

- Coordinate with relevant agencies to help the President of the Provincial People's Committee receive citizens according to the provisions of law and the Working Regulation of the Provincial People's Committee.

- Prepare programs and contents of business trips and receptions of chairpersons of provincial-level People's Committees according to regulations.

- Receive, advise and coordinate in handling press issues mentioned in accordance with regulations and direction of the Chairman of the provincial People's Committee.

Fourth: Implement information mode:

- Organize, manage and update information in service of the direction and administration of the People's Committee and the President of the provincial People's Committee; coordinate in providing information to serve the direction and administration of the Government and the Prime Minister.

- Organize, manage and publicize official information on the activities of the People's Committees and Presidents of the provincial People's Committees and provide information according to regulations.

- Building, organizing, managing and operating the provincial electronic portal; connected to the Government portal system.

- Managing, publishing and publishing the Provincial Official Gazette.

- Establishing, managing and maintaining the computer network operation of the provincial People's Committee.

In addition, additional authority tasks such as:

- Receive, process, issue and manage documents to be submitted to the People's Committee and the President of the provincial People's Committee; monitor, urge and check the implementation status and results

- Advise and assist the People's Committee of the province on control of administrative procedures and organize the implementation of the one-stop, one-stop-shop mechanism in handling administrative procedures.

- Ensure the material, technical and logistical conditions for the operation of the People's Committee and the President of the People's Committee of the province.

- Professional and professional guidance

- Advise and assist the People's Committee of the province in organizing the sending and receiving of electronic documents and processing documents and work records in the electronic environment.

- Advise and assist the People's Committee of the province in performing the function of state management of foreign affairs in accordance with the guidance of the Ministry of Foreign Affairs.

- Advise and assist the People's Committee of the province in performing the function of state management of ethnic minority sectors and domains under the guidance of the Committee for Ethnic Minorities.

- Perform internal management tasks.
