The Kitchen Guardians' Day is the 23rd day of the 12th lunar month every year. According to folklore, on this day, Kitchen Gods will ride the carp to heaven to report events during the year. On the 23rd day of the 12th lunar month every year, people will make offerings and release carp.
The Kitchen Guardians' Day in 2023 of Vietnam falls on February 2, 2024 under the solar calendar.
What is the plan for the Lunar New Year holiday 2024 applicable to officials in Vietnam?
On October 27, 2023, the Ministry of Labor, War Invalids and Social Affairs submitted to the Government a proposal for the Lunar New Year holiday and National Day holiday in 2024 for officials, public employees and employees of administrative agencies, careers, political organizations, socio-political organizations, etc business.
For officials and public employees
* The schedule of the Lunar New Year holiday 2024
+ Plan 1: take the 5-day Lunar New Year holiday as prescribed, of which, 2 days before Tet and 3 days after Tet.
Officials and public employees take the 2024 Lunar New Year holiday from Thursday, February 8, 2024 to Wednesday, February 14, 2024 (i.e. December 29, 2024 to January 5, 2024).
Thus, for this plan, officials and public employees will be entitled to 7 days off (including 5 days of Lunar New Year holiday and 2 days of compensatory weekly break as prescribed in Clause 3, Article 111 of the Labor Code 2019).
In addition to the plan of the Ministry of Labor, War Invalids and Social Affairs and the majority of ministries and agencies proposing, the Ministry also proposed a 2nd plan for the Government of Vietnam to choose.
+ Plan 2: take 5 days off as prescribed, of which 1 day before Tet and 4 days after Tet.
officials and public employees take the Lunar New Year holiday in 2024 from Friday, February 9, 2024 to Thursday, February 15, 2024 (i.e. December 30, 2024 to January 6, 2024).
Thus, with this plan, during the Lunar New Year holiday, officials and public employees will also have 7 days off (including 5 days of Lunar New Year holiday and 2 days of compensatory weekly break as prescribed in Clause 3, Article 111 of the Labor Code 2019).
=> Proposed plan: The Ministry of Labor, War Invalids and Social Affairs proposes the Lunar New Year holiday according to Plan 1.
The reason: all 02 plans have the same number of days off, but plan 1 ensures the harmony of rest time before and after Tet (this plan is agreed upon by all relevant ministries and agencies).
In addition, in Article 112 of the Labor Code 2019, there are the following provisions:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.
Accordingly, for the Lunar New Year holiday, officials and public employees will be entitled to at least 05 days off for Tet.
What is the salary paid to employees working during the Lunar New Year holiday 2024 in Vietnam?
Under Article 98 of the Labor Code 2019 on overtime pay and night work pay as follows:
Overtime pay, night work pay
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
4. The Government shall elaborate this Article.
Thus, according to the above regulations, employees working during the Lunar New Year holiday 2024 in Vietnam are entitled to the following salary:
- At least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
- An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
- In addition, an employee who works overtime at night will be paid an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
