Pursuant to Article 23 of Circular 01/2020/TT-BTTTT as follows:

The technical solutions for digital copyright control in publishing and releasing electronic publications in Vietnam are specified at Point dd, Clause 3, Article 17 of Decree No. 195/2013/ND-CP as follows:

Publishers and organizations and individuals releasing electronic publications must satisfy conditions on technical solutions technical solutions for digital copyright control in publishing and releasing electronic publications specified at Point dd, Clause 3, Article 17 of Decree No. 195/2013/ND-CP:
1. Having technical equipment and software to prevent unauthorized interference, alteration and copying of part or all of the contents of electronic publications.
2. Taking technical measures to verify the legality of users when accessing and using electronic publications and ensuring privacy, safety and protection of personal information.
3. Issuing provisions on notifying users of their responsibilities to comply with the provisions of law on publication and intellectual property before accessing and using electronic publications.

Thus, according to the above regulations, the technical solutions for digital copyright control in publishing and releasing electronic publications in Vietnam include:

- Having technical equipment and software to prevent unauthorized interference, alteration and copying of part or all of the contents of electronic publications.

- Taking technical measures to verify the legality of users when accessing and using electronic publications and ensuring privacy, safety and protection of personal information.

- Issuing provisions on notifying users of their responsibilities to comply with the provisions of law on publication and intellectual property before accessing and using electronic publications.

What are the requirements for digital formats in electronic publications in Vietnam?

Pursuant to Clause 1, Article 25 of Circular 01/2020/TT-BTTTT as follows:

Digital formats for electronic publications specified at Point c, Clause 2, Article 19 of Decree No. 195/2013/ND-CP
1. Digital formats of electronic publications must meet the following requirements:
a/ Be conformity with popular electronic means and compliance with current standards and technical regulations;
b/ Allow the establishment of resistance to unauthorized interference, alteration and copying of part or all of the contents of electronic publications.
2. Publishers, organizations and individuals releasing electronic publications shall provide detailed information and digital format structure to state management agencies in charge of publishing activities upon request.

Thus, according to the above regulations, the requirements for digital formats in electronic publications in Vietnam are as follows:

- Be conformity with popular electronic means and compliance with current standards and technical regulations;

- Allow the establishment of resistance to unauthorized interference, alteration and copying of part or all of the contents of electronic publications.

What are the regulations on the responsibility for appraising schemes and certifying the registration of publishing and releasing electronic publications in Vietnam?

Pursuant to Article 24 of Circular 01/2020/TT-BTTTT, the regulations on the responsibility for appraising schemes and certifying registration of publishing and releasing electronic publications in Vietnam are:

- Within 15 days after receiving the scheme on publishing and releasing electronic publications of publishers, organizations and individuals as prescribed at Point a, Clause 1, Article 18 of Decree 195/2013/ND-CP, the Department of Publishing, Printing and Releasing shall consider the suitability and ability to satisfy the conditions specified in Article 17 of the Decree 195/2013/ND-CP shown in the scheme and issue the written appraisal. In case the scheme is not in the correct form or there is insufficient information according to the prescribed form, it must be returned to the publisher, organization or individual for supplementation and completion.

- Within 15 days after receiving the application of registration of publishing or releasing electronic publications, the Department of Publishing, Printing and Releasing shall check the satisfaction of the conditions in the scheme according to the appraisal opinion and issue a written confirmation of registration of publishing and releasing electronic publications to publishers, organizations and individuals; In case of failure to confirm registration, a written reply clearly stating the reason must be given.
