What are the dossiers and procedures for issuing motor vehicle registration certificates in Vietnam?

Pursuant to Article 15 of Decree 139/2018/ND-CP stipulating dossiers and procedures for issuance of motor vehicle registration certificates as follows:

The application for the certificate of registration of motor vehicle inspectors is as follows:

+ Request for a certificate of registration of auditors;

+ A copy issued from the original book or a certified copy or a copy with the original to compare university diplomas and university transcripts;

+ Written confirmation of professional practice of registration of the registration unit (for motor vehicle registration class);

+ Color photos of 4 cm x 6 cm, taken in the style of identification cards, for a period not exceeding 06 months.

+ Professional background according to the form specified in Appendix III promulgated together with this Decree (in case of applying for the first motor vehicle registration certificate and reissuing the motor vehicle registration certificate after being revoked);

Procedures for issuance of motor vehicle registration certificates:

Step 1: Apply:

Organizations and individuals complete dossiers as prescribed above and submit them directly or via the postal system or in other appropriate forms to the Vietnam Register. For the class of motor vehicle inspectors, the application must be made within 12 months from the date of completion of the professional practice of registering the inspector;

Step 2: Check your profile

The Vietnam Register receives and examines the composition of dossiers; within 03 working days from the date of receipt of the dossier; if satisfactory, notify the organization or individual applying for the certificate of registration of auditors of the time to evaluate professional practice on the inspection line and evaluate the mastery of standards, regulations and regulations; if it fails, there must be a written response stating the reason;

Step 3: Evaluate the registration of motor vehicle inspectors

The Vietnam Register conducts professional assessment of the registration of auditors, the assessment results are recorded in the minutes of assessment of the registration of auditors according to the form specified in Appendix IV promulgated together with this Decree;

Step 4: Return the result

If the assessment results are satisfactory, a certificate of registration of auditors shall be issued within 05 working days from the date of assessment. In case the assessment fails, organizations and individuals are entitled to request the Vietnam Register to reassess after 01 month from the date of assessment; Returning results is made in person or via the postal system or by other appropriate form.

What are the standards of a motor vehicle registrar in Vietnam?

According to the provisions of Clause 1, Article 14 of Decree 139/2018/ND-CP stipulating the registration of motor vehicle inspectors with the following standards:

- Qualifications: Obtaining a bachelor’s degree in mechanical engineering, the training program should cover the following subjects: Automotive theory, automotive structures, structure calculation, technical maintenance, internal combustion engine, automotive electricity or equivalent subjects. If there are some subjects which are not covered by the above program, they may be trained at other universities or senior colleges;

- Having experience at least 12 months of probation as an inspector in the registration unit after completing training;

- Having passed the inspector test as prescribed by the Ministry of Transport. The inspection test result shall be recorded using Form in Appendix IV issued herewith;

- Having a driving license that remains effective.

What are the standards of a high-level motor vehicle inspector in Vietnam?

In Clause 2, Article 14 of Decree 139/2018/ND-CP stipulates the standards of registration of high-level motor vehicle inspectors as follows:

- Qualifications: Obtaining a bachelor’s degree in mechanical engineering, the training program should cover the following subjects: Automotive theory, automotive structures, structure calculation, technical maintenance, internal combustion engine, automotive electricity or equivalent subjects.

- Have experience of at least 36 months as an inspector;

- Having passed the high-level inspector test as prescribed by the Ministry of Transport. The inspection test result shall be recorded using Form in Appendix IV issued herewith.

How is the registration center using ineligible auditors sanctioned in Vietnam?

According to the provisions of Clause 2, Article 38 of Decree 100/2019/ND-CP stipulating the level of administrative sanctions, the registration center uses ineligible auditors as follows:

Article 38. Penalties for violations against regulations on inspection of technical and environmental safety of motor vehicles
2. A fine ranging from VND 5,000,000 to VND 7.000.000 shall be imposed upon the Registry that commits any of the following violations:
a) Failure to publicly put up inspection procedures at its office;
b) Failure to carry out inspections as assigned;
c) Employing unqualified people as inspectors;
d) Carrying out inspections without adequate devices and personal protective equipment;
dd) Failure to assign adequate number of inspector per inspection line;
e) Number of vehicles inspected and issued with certificates per inspection line exceeding that prescribed by regulations and law.

Thus, the registration center using ineligible inspectors will be fined from VND 5,000,000 to VND 7,000,000 and deprived of the right to use the "Certificate of eligibility for motor vehicle inspection services" from 01 month to 03 months.
