What are the standards for class 3 inland waterway port authorities in Vietnam?

Pursuant to Clauses 2 and 3, Article 6 of Circular 39/2022/TT-BGTVT stipulates as follows:

2. Standards of training and retraining qualifications:
a/ Having a university diploma or higher with a training major or major suitable to the requirements of the job position;
b/ Have a fostering certificate according to the standards of professional titles of specialized officials of inland waterway port authorities.
3. Standards of professional capacity:
a) Master the Vietnam Communist Party's guidelines, guidelines and policies and the State's laws; policy regimes of sectors and fields and basic knowledge of assigned professional fields;
b) Understand the system of state administrative management knowledge; specialized state management of waterways and the provisions of law on regimes for public officials;
c) Firmly grasp the principles, order, professional procedures, work plans and plans; have the skills to present the issues assigned to research and advise;
d) Have methods for researching, summarizing and proposing and improving management operations; have the capacity to carry out work to ensure progress, quality and efficiency;
dd) Have skills in handling situations, analyzing, synthesizing, communicating and coordinating; skills in using office equipment for professional work;
e/ Have basic information technology skills and being able to use foreign languages or ethnic minority languages for officials working in ethnic minority areas as required by their job positions.

Thus, according to the above standards for class 3 inland waterway port authorities as follows:

- Have a university diploma or higher with a major or training major suitable to the requirements of the job position.

- Have a fostering certificate according to the standards of professional titles of specialized officials of inland waterway port authorities.

What are the duties of the 3rd class inland waterway port authorities in Vietnam?

Pursuant to Clause 1, Article 6 of Circular 39/2022/TT-BGTVT stipulates that port authorities of grade 3 inland waterways have the following tasks:

- Participate in the performance of professional tasks under the management of the Port Authority of Inland Waterways in accordance with the provisions of law.

- Participate in research and proposals for guidelines, policies, orientations, master plans, plans for development and application of science and technology within the scope of assigned tasks; participate in the development of specialized mechanisms and regulations in accordance with the provisions of law, in accordance with the practical situation.

- Propagating, guiding and monitoring the implementation of regulations on management of ports, inland waterways and mooring areas; inspect the operation of ports, inland waterways and mooring areas within the management of the Port Authority of Inland Waterways in Vietnam.

- Guide, monitor, check and propose measures to implement management regulations to achieve results; directly perform the task of inspecting and supervising the implementation and compliance with the provisions of law on state management at ports, inland waterways and mooring areas within the scope of assigned management.

- Synthesize reflections of organizations and individuals on issues related to the management of ports, inland waterways and mooring areas to study proposals to complete issues related to the management of ports, inland waterways and mooring areas.

- Participate in checking, collecting information, statistics, managing records, storing data for work.

- Perform other tasks when assigned by competent authorities

What are the conditions required for a 3rd class inland waterway port authority to be promoted to the title of 2nd class inland waterway port authority in Vietnam?

Pursuant to Clause 4, Article 5 of Circular 39/2022/TT-BGTVT stipulates as follows:

An officer may register for the examination or be considered for promotion to the professional title of a 2nd class inland waterway port authority when he/she meets the criteria and conditions specified in Article 32 of Decree 115/2020/ND-CP and the following standards and conditions:

- Having held the professional title of a 3rd class inland waterway port authority and equivalent for a full 09 years or more (excluding probationary period). In case of equivalent duration, there must be at least 01 year (full 12 months) of holding the professional title of Port Authority of inland waterways class 3 up to the expiration of the deadline for submission of application for registration or promotion;

- During the period of holding the professional title of Port Authority of inland waterways class 3 and equivalent, they have participated in the development of at least 01 (one) legal document, topic, scheme, project, initiative at ministerial, departmental, sectoral or provincial levels that the agency employing the assigned officer studied, construction has been issued or accepted by a competent authority.

Circular 39/2022/TT-BGTVT will come into force from March 01, 2023.
