What are the procedures for moving the remains of martyrs buried at the martyrs' cemetery to another place under the wishes of the representative of relatives without assistance in Vietnam?

Pursuant to the provisions of Subsection 29, Section 2 of the Administrative Procedure promulgated together with Decision 108/QD-LĐTBXH in 2022, the procedures for moving the remains of martyrs buried at the martyrs' cemetery to another place under the wishes of the representative of relatives without assistance in Vietnam are specified as follows:

Step 1: The representative of the martyr's relatives or the beneficiary of the martyr's worship allowance shall send the application form for moving the remains of martyrs to the Department of Labor, War Invalids and Social Affairs where the original dossier is managed with a notice of the martyr's grave.

In case the martyr's relatives authorize the movement of the remain of the martyr, written authorization is required.

Step 2: The Department of Labor, War Invalids and Social Affairs, after receiving the application and documents, shall inspect and issue a recommendation letter for moving the remains of martyrs within 03 working days; save the application form.

Step 3: The Division of Labor, War Invalids and Social Affairs where the martyr' grave is managed:

- Within 02 working days from the date of receipt of the recommendation letter, be responsible for coordinating with the commune-level People's Committee to make a record of handing over the remain of the martyr; make a notice of movement of the remain of the martyr together with a record of handing over the remain of the martyr to the Department of Labor, War Invalids and Social Affairs where the martyr's original dossier is managed and where the martyr's grave is managed.

In case the remain of the martyr is not moved to the locality where the martyr's original dossier is being managed, simultaneously send them to the Department and the Division of Labor, War Invalids and Social Affairs where the remain of the martyr is received.

- Repair the grave shell as prescribed at Point d, Clause 2, Article 152 of Decree 131/2021/ND-CP

Step 4: The Department of Labor, War Invalids and Social Affairs, which manages the martyr's grave within 01 working day from the date of receipt of the notice of movement of the remain of the martyr, the record of handing over the remain of the martyr, is responsible for updating information into the national database on martyrs.

Step 5: The commune-level People's Committee of the locality where the remain of the martyr is received, within 01 working day from the date of receipt of the notice of movement of the remain of the martyr, the record of handing over the remain of the martyr, shall:

Make a record of handing over the remain of the martyr; bury the remain of the martyr in the martyrs' cemetery; make a written report to the Division of Labor, War Invalids and Social Affairs where the remain of the martyr is received together with the recommendation letter and a record of handing over the remain of the martyr.

Step 6: The Division of Labor, War Invalids and Social Affairs where the remain of the martyr is received, within 01 working day from the date of receipt of the written report of the commune-level People's Committee together with documents, shall:

- Pay traveling expenses and expenses for meals; expenses for moving the martyrs remain.

- Pay funds for the construction of the martyr's grave shell based on the wish to bury the remain of the martyr outside the martyrs' cemetery according to the application form.

- Send a document to the Department of Labor, War Invalids and Social Affairs where the remain of the martyr is received and where the martyr's dossier is managed together with the record of handing over the remain of the martyr.

Step 7: The Department of Labor, War Invalids and Social Affairs where the remain of the martyr is received shall base on the notice of movement of the remain of the martyr and the record of handing over the remain of the martyr to update information into the national database on martyrs and issue a notice of martyr' grave within 01 working day from the date of receipt of sufficient documents;

The Department of Labor, War Invalids and Social Affairs, where the martyrs' dossier is managed, shall save the notice of the movement of the remain of the martyr and record of handing over the remain of the martyr in the martyrs' dossier, within 01 working day from the date of receipt of all prescribed documents.

Pursuant to the provisions of Subsection 29, Section 2 of the Administrative Procedure promulgated together with Decision 108/QD-LĐTBXH in 2022, the procedures for moving the remains of martyrs buried at the martyrs' cemetery to another place under the wishes of the representative of relatives with assistance in Vietnam as follows:

Step 1: The representative of the martyr's relatives or the beneficiary of the martyr's worship allowance shall send the application form for moving the remains of martyrs to the Division of Labor, War Invalids and Social Affairs of permanent residence with the following documents:

- A certified copy from a certificate of the martyr's family or relatives or a certified copy from a decision on preferential allowance for a beneficiary of a martyr's worship allowance; notice of martyr's grave.

- In case the martyr's relatives authorize to move the remain of the martyr, written authorization is required

Step 2: The Labor, War Invalids and Social Affairs Office of the applicant's permanent residence shall, within 03 working days from the date of receipt of the application and documents, inspect and issue a recommendation letter for moving the remains of martyrs within 03 working days; save the application form.

Step 3: The Division of Labor, War Invalids and Social Affairs where the martyr's grave is managed, and the commune-level People's Committee where the remain of the martyr is received shall comply with the responsibilities specified at Points c, d and dd, Clause 1, Article 159 of Decree 131/2021/ND-CP.

Step 4: The Division of Labor, War Invalids and Social Affairs where the remain of the martyr is received shall send a document to the Department of Labor, War Invalids and Social Affairs where the remain of the martyr is received and the place where the martyr' dossier is managed together with a record of handing over the remain of the martyr.

Step 5: The Department of Labor, War Invalids and Social Affairs where the remain of the martyr is received and the place where the martyr's dossier is managed shall comply with the responsibilities specified at Points g and h, Clause 1, Article 159 of Decree 131/2021/ND-CP.
