What are the procedures for appointing leaders of press agencies not affiliated to party or state agencies in Vietnam?

Pursuant to the provisions of subsection 1 of Section I of Annex I promulgated together with Regulation 101-QD/TW of 2023. Leaders of press agencies not affiliated to Party or State agencies shall be appointed according to the following procedures:

- Based on the required number of titles of leaders of press agencies to be consolidated and supplemented, party committees, party organizations and leaders of press agencies (hereinafter collectively referred to as the leadership collective) shall perform the following tasks:

+ The leadership collective must issue a document to submit to the supervisory body of the press agency for considering and giving guidelines on the number of titles of leaders of press agencies to be consolidated and supplemented, in which it is expected to assign specific fields and tasks to personnel expected to be appointed.

+ After receiving guidelines, within 30 working days at the latest, the leadership collective must complete the implementation of the personnel process as prescribed. In case after the prescribed time, the implementation of the personnel process has not been completed, the leadership collective shall have to clearly explain the reasons and report to the supervisory body of the press agency.

- Personnel appraisal

+ The leadership collective shall make a submission and application for appointment to the supervisory body of the press agency.

+ Within 5 working days after receiving a complete submission and application as prescribed, the supervisory body of the press agency shall appraise the application and make a document (with the application) and send it to the Central Committee for Propaganda and Education, Ministry of Information and Communications.

+ Within 15 working days after receiving a complete application (enclosed with the application), the Central Committee for Propaganda and Education shall assume the prime responsibility for, and coordinate with the Ministry of Information and Communications in, appraising and replying in writing to the supervisory body of the press agency on the appointment of personnel expected to hold the positions of leaders of press agencies.

In case it is necessary to review and verify, the time limit may be extended bt not exceeding 20 working days.

+ Within 20 working days from the date of receipt of the written reply from the Central Committee for Propaganda and Education under the Ministry of Information and Communications, the supervisory body of the press agency shall hold a meeting to consider and decide on the appointment of leaders of affiliated press agencies; notify in writing to the Central Committee for Propaganda and Education under the Ministry of Information and Communications the results of the appointment of leaders of press agencies. In case of non-appointment, the reasons must be stated. If this time limit is exceeded without an appointment, the supervisory body of the press agency and press agencies must re-carry out the procedures for appointing leaders of press agencies.

What is the appointment age for leaders of press agencies not affiliated to the Party or State agencies in Vietnam?

Pursuant to the provisions of Clause 7, Article 5 of Regulation 101-QD/TW of 2023 on the appointment age for leaders of press agencies in Vietnam as follows:

a/ Leaders of press agencies affiliated to the Politburo and the Secretariat shall comply with the regulations of the Politburo and the Secretariat.
b/ Leaders of press agencies affiliated to the Party, State, Vietnam Fatherland Front, and socio-political organizations must have sufficient time to work for at least 1 full term (60 months) or more.
c/ Leaders of press agencies other than Points a, b, Clause 7 of this Article must have sufficient time to serve for at least 1 full term (60 months) or more and the maximum age to hold leadership positions must not exceed 65 years for women and 67 years old for men.
Special cases not exceeding 70 years of age, shall be considered and decided by the agency directing the press.

Thus, leaders of press agencies not affiliated to the appointed Party or State agencies must have enough time to work for at least 1 full term (60 months) or more.

The maximum age for holding leadership positions is not more than 65 years for women and 67 years for men. In special cases but not exceeding 70 years of age, the appointment age shall be considered and decided by the supervisory body of the press agency.

What is the term of office of leaders of press agencies not affiliated to the Party or State agencies in Vietnam?

According to Article 8 of Regulation 101-QD/TW of 2023, there are regulations on the term of office as follows:

1. The term of office of leaders of press agencies is 5 years (60 months).
2. The heads of press agencies shall not hold office for more than 2 consecutive terms at 1 press agency.

Thus, the term of office of leaders of press agencies not affiliated to the Party or State agencies in Vietnam is 5 years (60 months).

At the same time, the heads of press agencies shall not hold office for more than 2 consecutive terms at 1 press agency.
