What are the employer's responsibilities on the personal protection page for employees in Vietnam?
Pursuant to Article 8 of Circular 25/2022/TT-BLDTBXH stipulating the responsibilities of employers in the personal protective equipment for employees as follows:
- Based on the regulations on personal protective equipment issued in this Circular and the time limit for using personal protective equipment decided, every year, the employer consults the representative organization of employees at the grassroots level to make a procurement plan (including contingencies), personal protective equipment for workers.
- Check the quality of personal protective equipment before the page is issued, during use. In case of allocation to representatives in the team or workshop where the employee works, the employee must inspect and supervise the delivery and receipt of personal protective equipment to the employee.
- Make a page book, monitor the issuance of personal protective equipment signed by the employee or the representative of the team or workshop where the employee works to receive personal protective equipment according to the form specified in Appendix II issued together with Circular 25/2022/TT-BLDTBXH
- Encourage employers to digitize the monitoring and allocation of personal protective equipment, ensuring the certification of employees in accordance with information technology applications.
- Consult with the representative organization of employees at the grassroots level before deciding on the shelf life and number of personal protective equipment provided to employees.
- Ensure the principles specified in Clause 3, Article 23 of the Law on Occupational Safety and Health 2015 and Circular 25/2022/TT-BLDTBXH
- When implementing the provisions of Clause 3, Article 5 of Circular25/2022/TT-BLDTBXH, the employer must simultaneously report to the Ministry of Labor, War Invalids and Social Affairs according to the form specified in Appendix III promulgated together with this Circular to request consideration for amendment and addition to the list.

How should employers supplement the list of personal protective equipment in Vietnam?
Pursuant to Clause 3, Article 5 of Circular 25/2022/TT-BLDTBXH stipulates as follows:

3. In addition to making the list specified in Clause 2 of this Article, the employer shall actively develop a list and page of personal protective equipment for employees to ensure safety and health for employees in the following cases:
a) Occupations and jobs not specified in Appendix I promulgated together with this Circular that the employer deems to have dangerous or harmful factors that do not ensure health safety for employees.
b) Occupations and jobs specified in Appendix 1 promulgated together with this Circular but it is necessary to supplement the list of personal protective equipment to ensure effective prevention of harmful effects of dangerous and harmful factors in the working environment.
At the same time, based on Clause 6, Article 5 of Circular 25/2022 / TT-BLDTBXH stipulates as follows:

6. When implementing the provisions of Clause 3, Article 5 of this Circular, the employer must simultaneously report to the Ministry of Labor, War Invalids and Social Affairs in the form specified in Appendix III promulgated together with this Circular to request consideration for amendment and addition to the list.
Accordingly, employers actively develop lists and pages of personal protective equipment for employees to ensure safety and health for employees in cases where it is necessary to supplement the list of personal protective equipment to ensure effective prevention of harmful effects of dangerous factors, harmful factors in the working environment.
At the same time, when supplementing the list of personal protective equipment to ensure effective prevention of harmful effects of dangerous factors and harmful factors in the working environment, the employer must report to the Ministry of Labor, War Invalids and Social Affairs according to the form specified in Appendix III issued together with Circular 25/2022 / TT-BLDTBXH to propose recommend considering amendments and additions to the list.
Circular 25/2022/TT-BLDTBXH will come into force from April 01, 2023.
