What are the latest penalties imposed on persons operating vehicles on road lanes other than the permissible ones in Vietnam?

Vehicle

Going in the wrong lane (along or against traffic direction)

Going in the wrong lane that causes traffic accidents

car or car-like vehicle

- A fine of VND 4,000,000 – VND 6,000,000. (according to Point dd, Clause 5 of Article 5, Decree 100/2019/ND-CP amended by Point dd, Clause 34, Article 2 of Decree 123/2021/ND-CP).

- Suspension from the right to use a driving license from 01 - 03 months. (according to Point b, Clause 11, Article 5; Decree 100/2019/ND-CP)

- A fine of VND 10,000,000 – VND 12,000,000. (according to Point a, Clause 7, Article 5 Decree 100/2019/ND-CP).

- Suspension from the right to use a driving license from 02 - 04 months.

What are the regulations on the use of road lanes applicable to road traffic participants in Vietnam?

In Clause 7, Article 3 of the Road Traffic Law 2008, a road lane means a divided longitudinal strip of the carriageway which is wide enough for safe vehicular traffic.

In particular, under Article 9 of the Road Traffic Law 2008, road users shall keep to the right in their travel direction, move on the prescribed lane or road section, and obey the road signal system.

Under the provisions of Article 13 of the Road Traffic Law 2008, the use of road lanes applicable to road traffic participants in Vietnam is specified as follows:

- On a road with many lanes in the same direction of traffic, distinguished from one another by the lane-dividing markings, operators shall keep their vehicles on one lane and may only change lanes at places where it is so permitted; when changing lane, they shall give signals indicating their intention and ensure safety.

- On a one-way road with a lane-dividing marking, rudimentary vehicles shall keep to the right lane close to the edge of the road while motor vehicles and special-use vehicles move on the left lane.

- Vehicles moving on the road at a lower speed shall keep to the right.

Shall driving licenses of persons operating motorcycles on road lanes other than the permissible ones in Vietnam be temporarily seized?

Under the provisions of Clause 10, Article 6 of Decree 100/2019/ND-CP as follows:

Penalties imposed upon operators of mopeds and motorcycles (including electric motorcycles) and the like violating road traffic rules
...
10. Apart from incurring fines, the violating operator shall also incur the following additional penalties:
a) The violation(s) specified in Point g Clause 2 of this Article shall lead to confiscation of the warning device(s) installed illegally;
b) The violation(s) specified in Points b, e and i Clause 3; Points dd, e, g and h Clause 4; Clause 5 of this Article shall lead to suspension of driving license from 1 month to 3 months;
c) The violation(s) specified in Point a Clause 6; Points a and b Clause 7; Points a, b, c and d Clause 8 of this Article shall lead to suspension of driving license from 2 months to 4 months; repetition or multiple violations of offence(s) specified in Points a, b, c and d Claus 8 of this Article shall lead to suspension of driving license from 3 months to 5 months and confiscation of vehicle. Committing violation(s) specified in Points a, g, h, k, l, m and q of Clause 1; Points b, d, e, g, l and m of Clause 2; Points b, c, k and m of Clause 3; Points dd, e, g and h of Clause 4 of this Article and causing accidents shall lead to suspension of driving license from 2 months to 4 months;
d) The violation(s) specified in Point b Clause 6; Point dd Clause 8; Clause 9 of this Article shall lead to suspension of driving license from 3 months to 5 months;
dd) The violation(s) specified in Point c Clause 6 of this Article shall lead to suspension of driving license from 10 months to 12 months;
e) The violation(s) specified in Point c Clause 7 of this Article shall lead to suspension of driving license from 16 months to 18 months;
g) The violation(s) specified in Points e, g, h and i Clause 8 of this Article shall lead to suspension of driving license from 22 months to 24 months;

Thus, driving licenses of persons operating motorcycles on road lanes other than the permissible ones in Vietnam shall be temporarily seized.

However, in the case of operating motorcycles on road lanes other than the permissible ones that causes a traffic accident, violators shall be suspended from the right to use driving licenses for 2 to 4 months.
