What are the instructions on identity documents when traveling by plane in Vietnam from February 15, 2024?

On December 29, 2023, the Minister of Transport issued Circular 42/2023/TT-BGTVT amending and supplementing several articles of Circular 13/2019/TT-BGTVT and Circular 41/2020/TT-BGTVT amends and supplements several articles of Circular 13/2019/TT-BGTVT on Vietnam’s aviation security program and aviation security quality control.

In Section I, Appendix VII issued with Circular 42/2023/TT-BGTVT, from February 15, 2024, identity documents when traveling by plane in Vietnam are specified as follows:

* Passengers when checking in for international flights must present one of the following documents:

Passport or laissez-passer or another document valid for entry and exit as prescribed by law such as a departure visa, permanent resident card, temporary residence card, or citizen identity card (if Vietnam and the country concerned have signed an international treaty or agreement allowing citizens of the contracting country to use citizen identity cards instead of household use projection on each other's territory) ... (hereinafter collectively referred to as documents valid for entry and exit according to regulations); In case a child does not have a separate passport, the child's full name, date, month, year of birth and photo shall be recorded and affixed to the passport of the legal representative, including natural father, natural mother, adoptive father, adoptive mother or guardian.

* Passengers aged at least 14 when checking in for domestic flights must present one of the following legally equivalent electronic documents or data:

- For passengers of foreign nationality: Passport (with the latest entry verification stamp) or documents valid for international travel (with the latest entry verification stamp) and related documents residing in Vietnam (visa, permanent resident card, temporary residence card, APEC business travel card) except for visa exemption; diplomatic identity cards issued by the Ministry of Foreign Affairs to members of diplomatic missions, consular offices and representative offices of international organizations; license to drive a car or motorcycle; airport and airport security control cards with long-term validity; identification cards of Vietnamese airlines; Passenger's level 2 electronic identification account. In case a passenger loses his/her passport, a note from the diplomatic or consular mission of the passenger's country of nationality or a dispatch from the foreign affairs department (certified by the local public security office where the passenger lost his/her passport) confirming the passenger's identity and passport loss, with photo stickers, hybrid armor marks. Notes and confirmation letters are valid for 30 days from the date of certification;

- For passengers with Vietnamese nationality, one of the following documents must be presented: a passport or laissez-passer, departure visa, permanent resident card, temporary residence card, identity card, citizen identity card; identity cards and certificates of the people's police and people's army; Member of Parliament card; Party membership card; Journalist card; license to drive a car or motorcycle; cards of the National Civil Aviation Security Board; airport and airport security control cards with long-term validity; identification cards of Vietnamese airlines; Passenger's level 2 electronic identification account; identity certificate certified by the police agency (the certificate contains information showing the following contents: certifying agency, certifying person; confirmation date, month and year; full name, date of birth, gender, permanent residence of the confirmed person; reason for confirmation. A certificate with photo, stamped and valid only within 30 days from the date of confirmation); A certificate from the competent authority certifying that the passenger is the person who has just completed serving the sentence.

- Passengers with Vietnamese nationality from 14 years old to over 14 years old not older than 20 days can use the same laissez-passer as passengers under 14 years old.

* Passengers under 14 years old when checking in for domestic flights must present one of the following documents:

- Birth certificate; extract of civil status; extract of birth certificate (extract of birth information); written confirmation of civil status information; in case under 02 months of age without a birth certificate, a birth certificate must be obtained; Passenger's level 2 electronic identification account; the passenger's identity information in the Level 2 Electronic Identification Account of the parent or guardian accompanying the flight.

- Certificate of the social organization for children nurtured by the social organization (valid only for 06 months from the date of certification).

- Identity certificate certified by a police agency (a certificate containing information showing the following contents: certifying agency, certifying person; date, month, and year of confirmation; full name, date of birth, gender, permanent residence of the confirmed person; reason for confirmation. The certificate is valid within 30 days from the date of confirmation).

- Citizen identity card, national identity card, passport (separate passport or with parents' passport).

* Passengers who are prisoners, suspects, or persons who are being moved, extradited or deported during check-in for air travel only need documents from competent agencies proving the escort; passengers who are escorts present documents as prescribed in Clauses 1 and 2 Section I of Annex VII issued together with Circular 42/2023/TT-BGTVT

Note: Passengers' documents used when traveling on the above-specified aircraft must meet the following conditions:

- Be the original and still valid for use; or electronic copies with legal validity as prescribed.

- For birth certificates, civil status extracts; extract of birth certificate (extract of birth information); written confirmation of civil status information; the birth certificate must be the original or a certified copy as prescribed by law; or electronic copies with legal validity as prescribed.

- Documents in Clauses 1, 2, 3, and 4 of Appendix VII issued together with Circular 42/2023/TT-BGTVT are not accepted if the documents do not contain photos or photos that are not prescribed by law, except for birth certificates, birth certificates, civil status extracts; extract of birth certificate; written confirmation of civil status information, documents from the competent authority proving the escort.

- If it is a level 2 electronic ID account, the passenger's electronic birth certificate, the account is operating normally at the time of presentation.

* At ticketing and check-in points and on the airline's website, regulations on passengers' personal information to be declared when purchasing air tickets and identity documents of passengers must be publicly posted.

From February 15, 2024, will biometric authentication be used for document control upon traveling by plane in Vietnam?

In Clause 13, Article 1, Circular 42/2023/TT-BGTVT amending Clauses 1 and 2, Article 41 of Circular 13/2019/TT-BGTVT regulating aviation security inspection of passengers and their carry-on baggage on departure as follows:

(1) Each airline shall be only allowed to agree to transport and let a passenger board if:

- He/She has his/her boarding pass and identity documents (or his/her electronic identity information having the same validity as that of identity documents) specified in Appendix XIV of Circular 13/2019/TT-BGTVT; are compared against their documents (or his/her electronic identity information having the same validity as that of identity documents or biometric authentication data) and boarding pass to make sure that the passenger, his/her documents and boarding pass match.

- He/She and his/her baggage have undergone security inspection

(2) Passengers with checked baggage, except for the cases specified in Clause 3 Article 41 Circular 13/2019/TT-BGTVT, must be present at the check-in counter to drop their baggage. The check-in agent shall compare passengers against their boarding passes or tickets and identity documents (or their biometric authentication data electronic identity information having the same validity as that of identity documents), and ask them about their baggage. In case of any suspicion, notify the person in charge of the aviation security checkpoint. Checked baggage of each passenger, including passengers in a group shall be checked in individually instead of in a group.

Thus, biometric authentication shall be used for document control upon traveling by plane in Vietnam.

Circular 42/2023/TT-BGTVT will take effect from February 15, 2024.
