Vietnam: What are the functions, duties, and powers of the Military Safety Technical Inspection Center?
Is the Military Safety Technical Inspection Center a focal unit under the Vietnam Ministry of Defense?
Pursuant to Clause 1, Article 6 of Circular 142/2017/TT-BQP and Clause 2, Article 6 of Circular 142/2017/TT-BQP as follows:
Organizational apparatus of safety and labor protection agencies in the Ministry of Defense
1. Ministerial agencies:
a) The managing agency is the Safety and Labor Protection Agency of the Ministry of Defense ( Safety and Labor Protection Department of the Military);
b) The inspection agency is the Military Safety Technical Inspection Center.
2. Focal units under the Ministry of Defense:
a) The General Department of Logistics, the General Department of Defense Industry, and the Department of Military Armament/General Department of Engineering are under the Safety and Labor Protection Department;
b) Military zones, military services, corps, military arms, Border Guard Command, Hanoi Capital Command, Coast Guard Command, General Staff, General Political Department, General Department II, Ho Chi Minh Mausoleum Protection Command, Department of Standards - Metrology - Quality are assistants in charge of safety, labor protection;
c) The remaining focal units under the Ministry of Defense and the Department of Vehicles and Machinery, the Department of Arms Military Engineering/the General Department of Engineering are assistants in charge of safety and labor protection.
Thus, according to the above regulations, the Military Safety Technical Inspection Center is an inspection agency under the Vietnam Ministry of Defense, not a focal unit.
What is the function of the Military Safety Technical Inspection Center in Vietnam?
Pursuant to the provisions of Clause 1, Article 9 of Circular 142/2017/TT-BQP, the Military Safety Technical Inspection Center is under the system of state safety technical inspection centers, which is an internal unit under the General Department of Engineering.
Accordingly, the Military Safety Technical Inspection Center shall inspect machines, equipment, supplies, and substances with strict requirements on occupational safety in the Ministry of Defense.
What are the duties and powers of the Military Safety Technical Inspection Center in Vietnam?
The duties and powers of the Military Safety Technical Inspection Center in Vietnam are specified in Clause 2 Article 9 of Circular 142/2017/TT-BQP with 13 contents as follows:
- Develop short-term, medium-term, and long-term action target programs on safety technical inspection; annual working plans, report to the Safety and Labor Protection Department and submit to the Director of the General Department of Engineering for approval and organize the implementation;
- Organize technical inspection of safety of machines, equipment, supplies, and substances with strict requirements on occupational safety; inspection of fire protection equipment and vehicles, electrical equipment, electrical equipment used for explosion prevention, electromagnetic equipment; specific industrial, construction, and military equipment; equipment used for personal protection;
- Inspect customs clearance for export and import of machines, equipment, supplies and substances with strict requirements on labor safety; participate in the socialization of inspection of machines, equipment, supplies and substances with strict requirements on occupational safety in accordance with the provisions of law and the Ministry of Defense;
- Appraise safety measures in projects, schemes, designs, new constructions and renovations using objects with strict requirements on occupational safety;
- Inspect measuring instruments according to decentralization in the Ministry of Defense and as authorized by the State; Consult and appraise safety techniques; conduct the testing to determine the quantity and quality of materials, products and structures of the inspected objects;
- Conduct technical inspections to determine the causes of labor incidents and accidents caused by objects with strict requirements on occupational safety at the request of competent authorities;
- Conduct training, training and professional retraining for staff working in occupational safety and health, labor protection, and inspectors; train safety workers, inspection technicians, and operators of machines and equipment with strict requirements on occupational safety in accordance with the provisions of law and the Ministry of Defense;
- Conduct the testing and quantitative determination and quality of materials, products, and structures of the inspected objects;
- Research or participate in scientific and technical research on labor protection in the production, exploitation, and management of weapons and technical equipment at units under the Ministry of Defense;
- Request the unit to report the quantity and quality of inspected objects, provide relevant applications and documents, ensure sufficient factors for inspection and remedy safety hazards detected during the inspection process; report to the Labor Safety and Protection Agency of the Ministry of Defense to take timely preventive measures when detecting machines, equipment, and substances that are at risk of causing labor incidents and accidents;
- Refuse to inspect safety techniques when machines, equipment, supplies, and substances do not meet the conditions for conducting the inspection;
- Implement professional work regimes; organize preliminary and summary of safety technical inspection and report according to regulations; build a comprehensive and strong Military Safety Technical Inspection Center;
- Perform other duties assigned by the General Staff/General Department of Engineering.
