What are the duties and powers of the Departments of Agriculture and Rural Development in natural disaster management in Vietnam?
According to Clause 3, Article 3 of the Law on Natural disaster management 2013, Natural disaster management means a systematic process involving the prevention of, response to, and remediation of consequences of, natural disasters.
Pursuant to the provisions of Clause 10, Article 2 of Circular 30/2022/TT-BNNPTNT, the duties and powers of the Departments of Agriculture and Rural Development in natural disaster management are as follows:
(1) Advise and submit to provincial-level People's Committees for promulgation according to their competence or to competent authorities:
- Natural disaster management plan, an investment plan for the construction of local disaster management works as assigned; standards and norms of specialized materials, vehicles, and equipment for natural disaster management;
- Decisions on the construction, management, exploitation, and use of databases, monitoring, and supervision of systems specialized for natural disaster management; decisions on approval and announcement of the results of basic surveys on natural disaster management in the province; decisions on the declaration of a natural disaster emergency as assigned by provincial-level People's Committees; decisions on forces in charge of the dike management and forces in charge of people management;
- Regimes and policies for forces in charge of people management, forces in charge of the dike management; licenses to conduct dike-related activities;
- Use of riverbanks, floating beaches, and islets related to flood drainage and dikes;
- Approval of the construction and renovation of traffic works related to dikes;
(2) Guide and inspect the implementation of flood management plans of rivers with, dike plannings and flood management plans of rivers with dikes, plans for the development of dike systems in provincial planning, investment in construction, repair, upgrading, and consolidation, maintenance and maintenance of dikes, management, and safety of dikes as assigned or authorized by provincial-level People's Committees;
(3) Guide and organize the assessment of the current status of dikes and identify key issues around dikes; inspect the construction and implementation of plans for dike protection, dike protection work, and dike safety assurance; synthesize and manage information and data on dikes within the province;
(4) Guide and inspect the investment in construction, maintenance, operation and protection of natural disaster management works in the province in accordance with the provisions of law and assigned by the People's Committees of provinces;
(5) Propagate and disseminate contents to ensure requirements for natural disaster management for the management, operation and use of mineral exploitation zones and other natural resource exploitation zones; urban areas; tourist spots, tourist resorts; industrial parks; historic districts; rural residential spots and buildings;
(6) Perform the duties prescribed by law on marker placement that limit the scope of protection of dike works; elaborate plans and measures for the relocation of works and houses related to the scope of protection of dikes and river banks according to regulations.
What are the principles of natural disaster management in Vietnam?
Pursuant to Article 4 of the Law on Natural disaster management 2013 as follows:
Basic principles of natural disaster management
1. Proactive prevention, timely response to, and urgent and effective remediation of consequences of natural disasters.
2. Natural disaster management is the responsibility of the State, organizations, and individuals in which the State plays the key role, organizations and individuals play a proactive role and communities help one another.
3. Natural disaster management is carried out under the ‘four- the-spot motto’: command on the spot, manpower on the spot, means and supplies on the spot, and logistics on the spot.
4. Natural disaster management contents must be integrated into national and local socio-economic development master plans and plans and sectoral development master plans and plans.
5. Humanity, fairness, transparency, and gender equity must be guaranteed in natural disaster management.
6. Natural disaster management activities must be based on scientific grounds, combining traditional experiences and scientific and technological advances, combining structural and non-structural solutions; protecting the environment and eco-systems, and adapting to climate change.
7. Natural disaster management activities are assigned, decentralized and closely coordinated among involved forces and conform to the levels of natural disaster risks.
Thus, there are currently 07 principles for natural disaster management in Vietnam.
What are the regulations on human resources for natural disaster management in Vietnam?
Human resources for natural disaster management in Vietnam are determined according to Article 6 of the Law on Natural disaster management 2013 amended by Clause 3, Article 1 of the Law on amendments to Law on Natural disaster management, and the Law on Dikes 2020 as follows:
