What are the documents used to replace household registration books in Vietnam from January 1, 2023?
The Government has just issued Decree 104/2022/ND-CP on amendments to Decrees on the submission and presentation of household registration books, and temporary residence books upon carrying out administrative procedures or providing public services.
Accordingly, from January 1, 2023, Vietnamese citizens can use one of the following documents to prove residence information instead of using household registration books:
- Citizen ID card.
- ID card.
- Certification of residence information
- Notification of personal identification number and citizen information in the national database on population.
Where will Vietnamese citizens apply for a certification of residence information after annulling household registration books?
According to the provisions of Article 17 of Circular 55/2021/TT-BCA, Vietnamese citizens may apply for a certification of residence information in one of the following two methods:
- Vietnamese citizens may visit registration authorities across the country regardless of their places of residence;
- Or send a request for issuing a certificate of residence information via the national public service portal, public service portal of the Ministry of Public Security, or public service portal for residence management.
In addition, the duration of the certification of residence information in Vietnam is specified in Clause 2, Article 17 of Circular 55/2021/TT-BCA as follows:
- The certification of residence information is valid for 06 months from the date of issuance, for cases specified in Clause 1, Article 19 of the Law on Residence if residence declaration is verified.
- The certification of residence information is valid for 30 days from the date of issue in case of verification of residence information.
In case the citizen's residence information is changed, adjusted, and updated in the residence database, the certificate of residence information expires from the time of change.
What are the methods for looking up citizens’ information after annulling physical household registration books in Vietnam?
According to the provisions of Article 14 of Decree 104/2022/ND-CP, competent agencies, officials, public employees and individuals assigned to receive and handle administrative procedures and provide public services must use the information on the residence of citizens in the National Population Database to handle administrative procedures and provide public services.
Information about citizens' residence at the time of carrying out administrative procedures shall be recorded and kept by officials, public employees, and individuals responsible for receiving and handling administrative procedures on the System of administrative procedures at ministerial and provincial levels.
The use of information on citizens' residence in the National Population Database shall be done by one of the following methods:
- Look up and use personal information through the System of administrative procedures at ministerial and provincial levels connected to the National Population Database or through the National Public Service Portal;
- Look up personal information through the citizen's electronic identity account displayed in the VNeID application;
- Use a reader device that has been connected online to the National Population Database, including a QR code reader or a chip reader on a chip-based citizen ID card;
- Other methods as prescribed by special laws.
In case it is impossible to exploit citizens' residence information by the methods mentioned in Clause 2 of this Article, competent agencies, officials, public employees, and individuals that are assigned to handle administrative procedures and provide public services may require citizens to submit a copy or present one of the documents proving residency information.
The request for citizens to submit copies or produce documents proving their residence information is specified in the decision on the announcement of administrative procedures of the ministry, agency, or local government or other notices of services of service providers.
