What is the National Technical Regulation QCVN 2:2021/BKHCN on protective helmets for motorcycle and moped users in Vietnam?

On June 15, 2021, the Ministry of Science and Technology issued the National Technical Regulation QCVN 2:2021/BKHCN on protective helmets for motorcycle and moped users in Vietnam together with Circular 04/2021/TT-BKHCN

Accordingly, in Section 1, National Technical Regulation QCVN 2:2021/BKHCN, the scope of adjustment and subjects of application of the National Technical Regulation QCVN 2:2021/BKHCN on protective helmets for motorcycle and moped users in Vietnam are as follows:

Scope of regulation

This National Technical Regulation specifies the limits of technical regulations for protective helmets for users of:

- Motorcycles,

- Mopeds,

- Motored bicycles

- Electric motorcycles

- Electric bicycles and like

(Collectively referred to as protective helmets for motorcycle and moped users in Vietnam and hereinafter abbreviated as protective helmets and regulations governing protective helmet quality in production, import, circulation, and distribution.

This National Technical Regulation does not apply to specialized protective helmets, protective helmets used for motorsport or other special duty vehicles.

Subjects of application

This National Technical Regulation applies to organizations and individuals manufacturing, importing, circulating and distributing protective helmets and related agencies, organizations and individuals.

Protective helmets for motorcycle and moped users in Vietnam have the corresponding HS code is 6506.10.10.

What are the technical regulations and methods of testing protective helmets for motorcycle and moped users in Vietnam?

In Section 2, National Technical Regulation QCVN 2:2021/BKHCN, the technical regulations and methods of testing protective helmets for motorcycle and moped users in Vietnam are clearly stated as follows:

Types, textures, sizes, parameters and basic dimensions

- Type and structure of protective helmets must comply with Article 3 of TCVN 5756: 2017.

- The size, parameters and basic dimensions of the protective helmet must comply with Article 4 of TCVN 5756:2017.

- The size of the protective helmet (if any) from the point of connection with the protective helmet shell to the farthest point of the protective helmet (on the symmetrical plane of the protective helmet) should not be greater than:

+ 70 mm for removable blades;

+ 50 mm for solid protective helmets with protective helmets.

Technical regulations

- The protective helmet must be made from materials in accordance with the requirements in 5.1 of TCVN 5756: 2017.

- The basic technical criteria of the protective helmet and test methods must comply with the provisions of Table 1 of National Technical Regulation QCVN 2:2021/BKHCN

The outer surface of the protective helmet case and attached parts include metal rivets and nut bolts for joining protective helmet parts.

- The outer surface of the protective helmet cover and attached parts must be smooth, without cracks or sharp edges;

- The rivet head must not protrude 2 mm above the surface of the helmet shell (including the outer surface and the inner surface of the protective helmet shell), there must be no sharp, pointed edges. Rivets with sharp ends must not be used;

- Metal bolts, screws and nuts for coupling parts of protective helmets must have spherical canopy heads, nuts with sealed heads must be used, radial nuts must not be used. The entire end of the canopy of bolts and nuts should be smooth, without sharp, sharp edges.

+ Preparation of test samples must comply with 6.1 of TCVN 5756: 2017.

Labeling and displaying the certificate of conformity

- The protective helmet and its packaging must be labeled in accordance with the law on labels. Labels must be presented in a clear, legible way.

The label mounted on the protective helmet must be clear and not peel, torn or blurred during transportation and use. The required content of the label includes:

+ Name of goods: "protective helmets for motorcycle and moped users";

+ Name and address of the organization or individual responsible for the goods;

+ Origin of goods;

+ Protective helmet size: Head circumference;

+ Month and year of production;

+ Protective helmet style;

+ Quantitative: Exponential volume and mass tolerance;

+ User manual (specific instructions on how to use the protective helmet are written directly on the protective helmet or printed on waterproof material attached to the protective helmet or in the attached user manual);

+ Warning information (if any).

For imported protective helmets, if the label does not show or does not show enough mandatory contents in Vietnamese, there must be a sub-label showing the corresponding mandatory contents translated from the original label of the protective helmet into Vietnamese and supplemented with the missing mandatory contents according to the above regulations, the name and address of the establishment importing the protective helmet. The original label of the protective helmet must be preserved.

- The Certificate of conformity must be clearly shown, easily recognizable, printed directly on the protective helmet or printed on waterproof material attached to the protective helmet and must be clear, not peeled, torn or blurred during transportation and use.

The Certificate of conformity and related information must be shown as follows:

+ The shape and size of the Certificate of conformity according to Appendix I promulgated together with Circular 28/2012/TT-BKHCN stipulating the announcement of standard conformity, announcement of conformity with regulations and methods of assessing conformity with standards and technical regulations;

+ The Certificate of conformity must be accompanied by a minimum of information: abbreviated name (may include logo) of the certification body, number of the certificate.

What are the responsibilities for complying with standards for protective helmets for motorcycle and moped users in Vietnam?

In Section 4, National Technical Regulation QCVN 2:2021/BKHCN, the responsibilities of organizations and individuals are as follows:

- Enterprises manufacturing and importing protective helmets must announce applicable standards whose contents must not contravene this National Technical Regulation, and ensure the quality of protective helmets in accordance with the provisions of this National Technical Regulation and applicable announcement standards.

- Protective helmet manufacturers must announce conformity with regulations as prescribed in this National Technical Regulation.

- Protective helmet importers must carry out the certification of conformity and register for state inspection of quality for imported protective helmets as prescribed in Sections 3.2, 3.3 and 3.5 of this National Technical Regulation and shall keep records of protective helmet quality and certificate of conformity in accordance with the provisions of law, publicize the list of addresses selling protective helmets; provide copies (true copies of originals) of the Certificate of Conformity with protective helmets to addresses selling protective helmets.

- Organizations and individuals distributing protective helmets (enterprises, business households, households) must be responsible for selling protective helmets protective helmet meet technical regulations and management regulations in this National Technical Regulation; publicly announce the name and address of the protective helmet sale and keep at the place of sale a copy (copy of the original) of the Certificate of conformity for protective helmets provided by protective helmet manufacturers and importers.

- The organization assessing the conformity of protective helmet products shall be responsible as prescribed in Article 29 of the Government's Decree No. 107/2016/ND-CP dated July 01, 2016, on conditions for the provision of conformity assessment services.

Where imported protective helmets are the subject of an agreement on mutual recognition of conformity assessment results between a domestic certification body and a foreign certification body, the domestic certification body shall be responsible before law for the recognition of certification results by the foreign certification body as agreed.
