What are the general provisions for the production, preservation, use, and destruction of consumer fireworks and fireworks in Vietnam?
Pursuant to Circular 125/2021/TT-BCA promulgating the National Technical Regulation QCVN 04:2021/BCA as follows:
Specifically, Section 1.5 National Technical Regulation QCVN 04:2021/BCA promulgated together with Circular 125/2021/TT-BCA, the general provisions for the production, preservation, use, and destruction of consumer fireworks and fireworks in Vietnam are:
- Locations for construction of production establishments and storage warehouses in the production of consumer fireworks and fireworks must ensure a safe distance as prescribed in Appendix 7 of National Technical Regulation QCVN 01:2019/BCT.
- The investment, construction, repair and renovation of production establishments and storage warehouses for consumer fireworks and fireworks shall comply with the provisions of law on investment in construction works, environmental protection, safety and fire prevention and fighting.
- Consumer fireworks and fireworks are classified as dangerous according to the Government's Decree No. 42/2020/ND-CP dated April 08, 2020 stipulating the list of dangerous goods, transportation of dangerous goods by road motor vehicles and transportation of dangerous goods on inland waterways.
- Technical regulation on safety
+ Factories producing and storing consumer fireworks and fireworks must ensure safety techniques as prescribed in this National Technical Regulation;
+ Consumer fireworks and fireworks stored in the same 01 warehouse must be arranged separately according to the provisions of Clause 2.1.7.4 of this National Technical Regulation;
+ Do not allow fireworks in the area of influence of electrical energy sources, electrical induction and static electricity caused by sources of receiving and emitting electromagnetic waves, thunderstorms, high-voltage power lines or stray currents.
- When working with or in contact with consumer fireworks fireworks must fully comply with the following regulations:
+ Do not smoke, use fire sources, or heat sources less than 100 m from the location where consumer fireworks and fireworks are located;
+ Avoid impact on consumer fireworks and fireworks or do not allow consumer fireworks and fireworks in areas with temperatures higher than the manufacturer's regulations;
+ Do not poke, stab, push, throw, drag containers of fireworks products, exploding fireworks;
+ Do not carry instruments capable of emitting sparks, or electromagnetic wave transceivers, except for persons assigned or assigned to ignite;
+ Do not wear clogs, shoes, or sandals with soles closed with iron nails or iron fish when in contact with consumer fireworks and fireworks;
+ Do not use tools to close and open containers of consumer fireworks and fireworks made of materials capable of emitting sparks.
- Electrical equipment
+ Use explosion-proof electrical equipment, with an IP outer shell protection level of 54 or higher in factories and storage warehouses
In case electrical distribution and switchgear other than explosion room type must be placed in an explosion room box or installed in a separate booth;
+ Power supply cables to factories and storage warehouses must be cables buried underground or placed in protective steel pipes buried underground. The metal housing of electrical appliances must all be grounded and ensure that the resistance is not greater than 4 Ω;
+ Overload and short-circuit protection devices must be available and safety requirements against electrical leakage protection for electrical equipment systems in production establishments according to the provisions of National Standard TCVN 7447-4-41:2010;
+ Electrical safety measures must be fully implemented when repairing or replacing electrical equipment at production establishments and storage warehouses.
- Explosion prevention equipment must be inspected by competent agencies according to regulations and meet occupational safety and health requirements.
- Lightning protection
+ Install a straight lightning strike protection system, electromagnetic induction lightning protection, anti-intrusion of high voltage for factories, storage warehouses for consumer fireworks and fireworks according to the regulations in National Technical Regulation QCVN 01:2019/BCT;
+ The design, construction, acceptance and put into use, inspection, measurement and periodic repair of lightning protection systems comply with the provisions of National Standard TCVN 9385: 2012 (BS 6651: 1999).
- Fire prevention and fighting
+ Based on the provisions of the law on fire prevention and fighting to determine production establishments and storage warehouses before construction and put into operation, they must be approved for design, inspection and acceptance of fire prevention and fighting;
+ Ensure compliance with regulations on fire safety, fire fighting, rescue and rescue; fire fighting plans, rescue and rescue plans approved by competent authorities;
+ Arrange grassroots fire prevention and fighting forces, being trained in fire prevention, fighting, rescue and rescue by competent state agencies; organize firefighting, rescue and rescue readiness to meet on-site requirements;
+ Ensure the equipment and equipment for fire prevention and fighting forces at grassroots level as prescribed in Circular 150/2020/TT-BCA dated 31/12/2020 of the Minister of Public Security stipulating the equipment for fire prevention, fighting and rescue for civil defense forces, grassroots fire prevention and fighting forces, specialized fire prevention and fighting forces; TCVN 2622-1995; TCVN 4513-1988; TCVN 5738:2001; TCVN 7336:2003; TCVN 3890-2009; QCVN 06:2021/BXD and other relevant standards and regulations;
+ In case of a fire or explosion incident, it must comply with the motto 04 on-site: On-site command, on-site forces, on-site vehicles, on-site logistics and comply with the approved firefighting, rescue and rescue plan;
+ Purchase compulsory fire and explosion insurance in accordance with the provisions of law.
- Environmental protection
+ Ensure compliance with regulations on environmental impact assessment reports or environmental protection plans before building production facilities and storage warehouses as prescribed in Circular 27/2015/TT-BTNMT dated 29/5/2015 of the Minister of Natural Resources and Environment on strategic assessment, environmental impact assessment and environmental protection plans;
+ Wastes of production establishments are treated to meet standards according to regulations on environmental protection according to QCVN 40:2011/BTNMT on industrial wastewater;
+ Periodically check the concentration of hazardous substances of the environment around the production area as prescribed in Circular 24/2017/TT-BTNMT dated 01/9/2017 of the Minister of Natural Resources and Environment stipulating environmental technical monitoring.
- Safety procedures and rules
+ Production establishments and storage warehouses must formulate, promulgate, and post internal rules, regulations and procedures on ensuring security and order, safety, fire prevention, and fighting;
+ In the area of the consumer fireworks and fireworks production line, rules and working procedures must be posted;
+ In the storage warehouse, rules and procedures for arranging, preserving, exporting, and importing consumer fireworks and fireworks must be posted.
- Persons directly producing, preserving and using, when in contact with consumer fireworks and fireworks, must be provided with personal protective equipment suitable to their nature, degree of toxicity and danger.
What are the requirements for places for testing consumer fireworks and fireworks in Vietnam?
Pursuant to subsection 2.1.3 Section 2.1 National Technical Regulation QCVN 04:2021/BCA promulgated together with Circular 125/2021/TT-BCA, the requirements for places for testing consumer fireworks and fireworks in Vietnam are as follows:
- The testing place is a room with a ventilation system or a vacant lot with a hard earth, brick or concrete foundation.
- The testing place must ensure a safe distance to the works and objects to be protected as follows:
+ From 100 m or more for fireworks;
+ From 0.5 m or more for hand-held fireworks;
+ From 10 m or more for non-portable fireworks.
- Do not store consumer fireworks and fireworks overnight at the testing place.
What are the technical regulations on safety in the production of consumer fireworks and fireworks in Vietnam?
Pursuant to Section 2.1 Section 2 of the National Technical Regulation QCVN 04:2021/BCA promulgated together with Circular 125/2021/TT-BCA, the technical regulations on safety in the production of consumer fireworks and fireworks in Vietnam are as follows:
- The manufacturer must comply with the technical procedures approved by the competent authority;
- When drying or drying fuses, consumer fireworks and fireworks, they must be placed on racks and supervised; drying racks must be clean, without pieces of brick, gravel, stone, or metal; it is forbidden to dry directly on a brick, cement or iron pole base; when drying, the supply heat source must not exceed 60°C; fuses, consumer fireworks and fireworks must not come into direct contact with the heat supply;
- The fuse cutting tool must be sharp and made of stainless materials; when cutting the fuse, it must be precisely and decisively manipulated; the finished fuse must be placed in secure containers;
- Tools for introducing cannon powder into the molding mold or feed hopper of the machine or compressor must be made of materials that do not generate sparks during operation;
- After drying, consumer fireworks and fireworks must be cooled to a temperature not greater than 35°C before being put into storage and use.
