According to the provisions of the Inspection Law 2022 of Vietnam, who are inspectors? What are the titles of Inspector?
On 14/11/2022, the National Assembly promulgated the Law on Inspection 2022 regulating the organization and operation of inspection, replacing the current 2010 Inspection Law of Vietnam.
Pursuant to Clause 1, Article 38 of the Law on Inspection 2022 of Vietnam, the concept of inspector is defined as follows:
Inspectors, who are assigned to perform specialized inspection duties
1. Inspector means a person appointed to the rank of inspector to perform tasks and exercise powers in inspection activities in accordance with law.
At the same time, Clause 1, Article 39 of the Law on Inspection 2022 mentions:
Criteria for appointment to the rank of inspector
1. Being civil servants, officers of the People's Army, officers of the People's Police, persons doing basic work, unless otherwise provided for by the Government for inspectors of inspection agencies established under the provisions of law or treaties to which the Socialist Republic of Vietnam is a contracting party or as prescribed in Clause 3, Article 9 of this Act.
Accordingly, it can be understood that inspectors are civil servants, officers of the People's Army, officers of the People's Police, people doing basic work who are appointed to the rank of inspectors to perform their duties and powers in inspection activities.
Regarding inspection quotas, Clause 2, Article 38 of the Law on Inspection 2022 stipulates:

2. Inspectors include inspectors, principal inspectors and senior inspectors.
Thus, according to the provisions of the Inspection Law 2022, the rank of inspector includes:
- Ombudsman;
- Principal Ombudsman;
- Senior Ombudsman.

What are the criteria for appointing inspectors under the Inspection Law 2022 of Vietnam?
The criteria for appointing inspectors are specified in Article 39 of the Law on Inspection 2022 as follows:
Criteria for appointment to the rank of inspector
1. Being civil servants, officers of the People's Army, officers of the People's Police, persons doing basic work, unless otherwise provided for by the Government for inspectors of inspection agencies established under the provisions of law or treaties to which the Socialist Republic of Vietnam is a contracting party or as prescribed in Clause 3, Article 9 of this Act.
2. Loyalty to the Fatherland and the Constitution of the Socialist Republic of Vietnam; have good moral qualities; have a sense of responsibility, integrity, honesty, fairness, objectivity.
3. Having a university diploma or higher, having state management knowledge and understanding of law; for inspectors in specialized fields, they must also have professional knowledge of that specialty.
4. Having certificates of professional training of inspectors and other certificates in accordance with the law on cadres, civil servants and public employees.
5. Having at least 02 years of inspection work excluding probationary period or at least 05 years of work or more for cadres, civil servants, public employees, officers of the People's Army, officers of the People's Police, persons doing basic work at agencies, other organizations and units turn to inspection agencies.
Thus, civil servants, officers of the People's Army, officers of the People's Police, and persons doing basic work who want to be appointed to the rank of inspectors are required to meet the above criteria.
Are inspectors issued costumes, inspection cards in Vietnam?
Based on the contents of Article 43 of the Law on Inspection 2022 stipulates as follows:
Costumes, inspection cards
1. Inspectors shall be granted inspection costumes and cards according to the Government's regulations for use when performing inspection tasks.
2. Persons assigned to perform specialized inspection tasks shall be granted specialized inspection costumes and cards according to the regulations of ministers and heads of government-attached agencies for use when performing specialized inspection tasks.
According to the above regulations, inspectors are issued with costumes and inspection cards when performing inspection duties. Regulations on costumes and inspection cards of inspectors are specified in Circular 02/2015/TT-TTCP on the costumes of cadres, inspectors, civil servants and employees of state inspection agencies.
When will the Inspection Law 2022 apply in Vietnam?
The effective time of the Inspection Law 2022 is specified in Article 117 of the Law on Inspection 2022 as follows:
Enforceability
1. This Law takes effect from 01/07/2023.
2. The Inspection Law No. 56/2010/QH12 expires from the effective date of this Law.
Accordingly, from 01/07/2023, the provisions mentioned in the Inspection Law 2022 will be officially put into effect. From this date, the Inspection Law 2010 will no longer be in force.
For inspections with inspection decisions issued before the effective date of the Inspection Law 2022, they shall continue to comply with the provisions of the Inspection Law 2010.
