What are the criteria and entities to be considered for the Excellent Labor Collective title in Vietnam under Circular 01/2024/TT-BXD?

On May 6, 2024, the Vietnam Ministry of Construction issued Circular 01/2024/TT-BXD on elaboration of several articles of the Law on Emulation and Commendation in the construction industry.

Under Article 5 of Circular 01/2024/TT-BXD, the criteria and entities to be considered for the Excellent Labor Collective title of the Ministry of Construction are specified as follows:

Entities to be considered for the Excellent Labor Collective title:

According to Clause 1, Article 5 of Circular 01/2024/TT-BXD, entities to be considered for the Excellent Labor Collective title are specified as follows:

- Public administrative agencies and public service providers under and affiliated with the Ministry of Construction (including, divisions, departments, faculties, and equivalent or higher);

- State-owned enterprises managed by the Ministry of Construction (including production groups, teams, workshops; factories; divisions, departments, and equivalent or higher).

Criteria for consideration for awarding the Excellent Labor Collective title:

According to Clause 2, Article 5 of Circular 01/2024/TT-BXD, the criteria for consideration for awarding the Excellent Labor Collective title are specified as follows:

The Excellent Labor Collective title shall be annually awarded to a collective meeting the following criteria:

- Excellently complete assigned tasks;

- Actively participate in regular, practical and effective emulation movements;

- Have 100% of individuals in the collective completing the assigned tasks, of which at least 70% of individuals achieve the "Advanced Laborer" title;

- Have an individual who has received the "Grassroots-level Emulation Fighter" title;

- Have internal solidarity and be exemplified in observance of the CPV's guidelines, policies and laws of the State.

In particular, the criteria for excellent completion of tasks are specified as follows:

- Exceed targets and tasks assigned in programs and plans approved by competent authorities during the year;

- Fulfill obligations to the State and policies applicable to employees as prescribed.

According to Clause 1, Article 6 of Circular 01/2024/TT-BXD, entities to be considered for the Advanced Labor Collective title include:

- Public administrative agencies and public service providers under and affiliated with the Ministry of Construction (including, divisions, departments, faculties, and equivalent or higher);

- State-owned enterprises managed by the Ministry of Construction (including production groups, teams, workshops; factories; divisions, departments, and equivalent or higher).

According to Clause 2, Article 6 of Circular 01/2024/TT-BXD, the criteria for consideration for awarding the Advanced Labor Collective title are specified as follows:

The Advanced Labor Collective title shall be awarded annually to a collective meeting the following criteria:

- Successfully complete assigned tasks;

- Participate in regular, practical, and effective emulation movements;

- Have at least 70% of individuals in the collective who have achieved the title of "Advanced Laborer” title and no individuals who have been disciplined by warning or higher;

- Have internal solidarity and be exemplified in observance of the CPV's guidelines, policies and laws of the State.

In particular, the criteria for successful completion of assigned tasks are specified as follows:

- Complete targets and tasks assigned in programs and plans approved by competent authorities during the year;

- Fully implement policies and regimes applicable to employees as prescribed.

What are the responsibilities of agencies, organizations, and units in emulation and commendation work in Vietnam?

Under Article 13 of the Law on Emulation and Commendation 2022, the responsibilities of agencies, organizations, and units in emulation and commendation work in Vietnam are as follows:

- Heads of agencies, organizations, and units shall directly lead, direct, and take responsibility for the result of emulation and commendation work; detect individuals, collectives, and households with achievements to commend based on entitlements or as requested by superior agencies; expand the typical advanced model; assess achievements; take responsibility for issuing commendation decisions and presenting such decisions to superior agencies.

- Agencies, organizations, and units shall apply information technology and modernization of management to emulation and commendation work.

- The Vietnam Fatherland Front and its member organizations shall, within their scope of tasks and entitlements, implement regulations prescribed in Clause 1 and Clause 2 of Article 13 of the Law on Emulation and Commendation 2022 and shall:

+ Disseminate, mobilize, and encourage union members, members, and the People to comply with laws on emulation and commendation;

+ Organize or cooperate with agencies, organizations, and units in organizing emulation movements;

+ Supervise the implementation of policies and laws on emulation and commendation and social criticism regarding drafts of policies and laws on emulation and commendation.

- Press agencies shall implement regulations prescribed in Clause 1 and Clause 2 of Article 13 of the Law on Emulation and Commendation 2022 and regularly disseminate guidelines of the CPV, policies and laws of the State on emulation and commendation; actively participate in detecting individuals, collectives, and households with excellent achievements; disseminate and popularize goods examples, good people, and good deeds, contributing to the encouragement of emulation movements. The dissemination work must reflect the correct result of emulation movements and commendation and timely reflect and fight against violations of laws on emulation and commendation.

- Agencies, organizations, and units that provide advisory services and assistance regarding emulation and commendation work shall:

+ Provide advisory services and propose the implementation of emulation and commendation work;

+ Provide advisory services for the launch emulation movements; develop programs, plans, and contents of emulation;

+ Guide, urge, and inspect the implementation of emulation and commendation work; receive, consider, and appraise applications for emulation titles and commendation forms; present such applications to competent authorities for consideration of issuance of commendation decisions;

+ Provide advisory services regarding the preliminary and summary of emulation movements.

Circular 01/2024/TT-BXD will come into force from July 1, 2024 and replaces Circular 04/2020/TT-BXD.
