Is the National High School Exam 2023 considered a secret of the State's top secret?

Pursuant to Article 1 of Decision 809/QD-TTg in 2020, it is prescribed as follows:

Top Secret State Secrets include:
1. Plans, action programs, reports and documents attached to reports of the Ministry of Education and Training on the implementation of guidelines and policies of the Party and the State on the development of education and training directly in service of security and defense strategies have not been made public.
2. Official exams, preparatory exams, official exam answers, preparatory exam answers of high school graduation exams, national good student selection exams, international and regional Olympic team selection contests have not been made public.
3. Information on persons belonging to the People's Army, People's Police and Ciphers sent for training at home and abroad should be protected at the request of the party sending for training.

Accordingly, official exam questions, preparatory exam questions, official exam answers, and preparatory exam answers of high school graduation exams that have not been publicly disclosed are considered top secret of the State.

How will spreading false rumors about the national high school exam 2023 on Facebook be administratively sanctioned?

Pursuant to Article 101 of Decree 15/2020/ND-CP (amended by Clause 37 Article 1 of Decree 14/2022/ND-CP) stipulating penalties for exposing high school exam questions 2023 to Facebook as follows:

Violating regulations on responsibility for using social networking services; websites set up through social networks
1. A fine of VND 10,000,000 to VND 20,000,000 shall be imposed for taking advantage of social networks to perform one of the following acts:
a/ Providing and sharing false information, false information, misrepresentation, slander, insulting the reputation of agencies, organizations, honor and dignity of individuals;
b/ To provide and share information promoting customs, superstitions, superstitions, lewdness, depravity, incompatible with the fine customs and customs of the nation;
c/ To provide and share information meticulously describing the act of slashing, killing, accident, horror or horror;
d/ Providing and sharing fabricated information, causing confusion among the people, inciting violence, crimes, social evils, gambling or serving gambling;
dd) Providing and sharing works of journalism, literature, art or publications without the consent of intellectual property rights holders or without permission to circulate or decisions prohibiting circulation or confiscation;
e) Advertising, propagating and sharing information about prohibited goods and services;
g) Provide and share images of Vietnam's maps but do not show or improperly represent national sovereignty;
h/ Providing and sharing links to information on the network with prohibited contents.
2. A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for the act of disclosing information on the list of state secrets, personal life secrets and other secrets that have not reached the level of criminal liability.
3. Remedies:
Forcibly removing false or misleading information or information that violates the law due to the violation specified in Clauses 1 and 2 of this Article

Thus, the act of spreading false rumors about the high school exam 2023 on Facebook causing public confusion, affecting the security and safety of the exam may be administratively sanctioned up to 20 million VND.

At the same time, the remedy is to forcibly remove false or misleading information or information that violates the law due to committing violations.

Note, the above-mentioned fine only applies to individual violators. If the act of borrowing and using the above-mentioned citizen identity is carried out by the organization, the applicable fine will be 02 times the fine for the individual.

Can candidates who reveal the national high school exam 2023 in Vietnam while taking the test be allowed to take the exam again?

Pursuant to Clause 3, Article 54 of the Regulation promulgated together with Circular 15/2020/TT-BGDDT (amended by Clause 17 Article 1 of Circular 05/2021/TT-BGDDT) stipulates as follows:

Suspension:
a) For candidates who violate one of the following errors: Have been dealt with in the form of a one-time warning but continue to violate the exam regulations at the level of reprimand or warning; bringing unauthorized items as prescribed in Article 14 of this Regulation into the exam room/waiting room or when moving between the exam room and the waiting room; take the test outside the exam room or receive the solution from outside the exam room; write and draw on your test paper content that is not related to the test; acting aggressively, threatening those responsible for the exam or threatening other candidates; failure to follow the instructions of supervisors or lounge managers when traveling in the exam area and during lounge stays;
b) The cbct shall make minutes, collect exhibits (if any) and report to the head of the test score to decide on the form of suspension. If the Head of Test Scores does not agree, report to the Head of the Examination Committee for decision. Candidates who are suspended from the exam must submit their exam papers, exam papers and draft papers to the CBCT, must leave the exam room immediately after the decision is made and can only leave the exam area when the exam period expires;
c) Candidates who are suspended from the exam in any year will have the results of all exams/subjects in that year's exam canceled.

Accordingly, candidates who reveal the national high school exam 2023 while taking the test will be suspended from the exam.

At the same time, the examination officer shall make a record, collect exhibits (if any) and report to the Head of the Test Site to decide on the form of suspension.

Candidates who are suspended from the exam must submit their exam papers, exam papers, draft papers to the CBCT, must leave the exam room immediately after the decision is made and can only leave the exam area when the exam period expires.

Besides, candidates who are suspended from the exam every year will have their results canceled all exams/subjects in that year's exam.
