If a Vietnamese Communist Party member is a cadre under the management of the Central Committee, how is the verification, conclusion, and handling of the Party member's membership done?
Pursuant Section 8 of Guidelines 08-HD/BTCTW in 2017 stipulates:
“8- About the party membership
The verification, conclusion, and handling of party membership, recognition of party membership, restoration of party membership rights, deletion of party member's name, or resumption of party activities shall comply with Regulation No. 29-QD /TW dated July 25, 2016 of the Central Committee of Vietnam on the implementation of the Party Charter, Regulation No. 59-QD/TW dated December 22, 2016 of the Politburo on party organization in the Vietnam People's Army and decentralization of personnel management in the Army, specifically as follows:
- Party members who are officials under the management of the Central Committee, the Standing Committee of the Central Military Commission of Vietnam shall request the Central Organization Committee to consider and settle. If the opinion of the Standing Committee of the Central Military Commission is different from the conclusion of the Central Organization Committee, it shall be reported to the Secretariat for consideration and decision.
- Party members who are cadres under the management of the Central Military Commission shall be considered and decided by the Standing Committee of the Central Military Commission.
- Party members who are cadres under the management of the Party Committee of the Central Military Commission shall be considered and decided by the Standing Committee of the Party Committee under the Central Military Commission.
- Party members who do not fall into the above categories shall be considered and decided by the standing committee of the Party Committee of divisions, naval regions, coast guard regions and the equivalent."
Thus, based on Party members who are ministries under which agencies and organizations manage to determine the order of settlement according to the above guidelines.
Accordingly, if a Party member is a cadre under the management of the Central Committee, the Standing Committee of the Central Military Commission requests the Central Organization Committee to consider and settle the Party membership of the Party member.

Pursuant to subsection 5.1, Section 5 of Regulation 29-QD/TW in 2016 stipulates:
“5- About the party president of a party member
5.1- Competence to settle party membership issues (verification and conclusion on party membership, recognition of party membership, restoration of party membership rights, deletion of names or resumption of party activities of party members).
a) For Party members who are officials under the management of the Central Government, they shall authorize the Central Organization Committee to consider and handle them.
In case the opinion of the Party Committee directly under the Central Government is different from the conclusion of the Central Organization Committee, it shall be reported to the Secretariat for consideration and decision.
b) Party members who are officials of the provincial Party Committee and equivalent management level, the standing committee of the provincial Party Committee and equivalent shall consider and decide.
c) Party members who do not fall into the categories mentioned above shall be considered and decided by the standing committee of the district party committee and the equivalent."
Accordingly, based on the Party members who are officials under the management of any agency or organization to determine the competence to consider and handle the party membership of the Party members according to the above provisions.
Guide to solving problems about party membership of Vietnamese Communist Party members?
Pursuant to subsection 5.2, Section 5 of Regulation 29-QD/TW in 2016 stipulates:
“5- About the party president of a party member
…
5.2- Solve the problem of party membership of party members.
a) No reconsideration is required for party members whose party membership problems have been previously reviewed and concluded by the competent committee without discovering any new problems.
b) Only consider and restore party membership rights and calculate party age continuously for those who have been removed from the Party who have been examined, verified and concluded by competent authorities to be unjust and since being removed from The Party has so far not violated its membership.
c) Party members are admitted before the 3rd National Congress of the Party (September 5, 1960) and before April 30, 1975 (in localities from the south of Ben Hai River and back) that at the end of the year. If you are under 18 years old when you join the Party, your date of joining the Party will remain the same.

g) Party members who are suspected of not being admitted to the Party by the party organization must carefully consider and, after verifying, find that there are sufficient grounds to conclude that they have been admitted to the Party by the organization in accordance with the provisions of the Vietnamese Communist Party's Charter; or in accordance with the provisions of the points mentioned above and since then still participate in party activities and maintain the status of a party member, the Party Committee of Vietnam has the authority to recognize them as a party member. If there are enough grounds to conclude that such person is impersonating a party member, the competent party committee shall decide to remove his/her name from the list of party members.
h) Party members who do not participate in Party activities due to interruption of Party activities, after being examined, have sufficient grounds and clear evidence and announce the deletion of names from the list of party members; if the infringing content is not caused by themselves and is confirmed by the branch, grassroots party committee where they work or reside, they still perform their assigned tasks well, perform their civic duties well, preserve If they have moral qualities while not participating in party activities, they will be considered for resumption of party activities.”
Accordingly, the settlement of Vietnamese Communist party membership issues of party members in certain cases will be carried out in accordance with the above provisions.
