The Government Office has just issued Official Dispatch No. 8662/VPCP-KGVX dated November 3, 2023 on Lunar New Year Holiday and National Day Holiday Schedules in 2024.

Prime Minister Pham Minh Chinh agreed with the proposal of the Ministry of Labor - War Invalids and Social Affairs of Vietnam in the mentioned document for the schedules for the Lunar New Year Holiday (from February 8, 2024 to February 14, 2024) and the National Day Holiday (from August 31, 2024 to September 3, 2024)

Thus, the official Lunar New Year 2024 holiday schedule is as follows:

- 05 days off according to regulations, including 02 days before Tet and 03 days after Tet

- Officials and public employees will be off for the 2024 New Year holiday from Thursday, February 8, 2024, until the end of Wednesday, February 14, 2024 (i.e. December 29, 2024, lunar calendar) to the end of January 5, 2024 in lunar calendar).

->> Thus, during the Tet holiday, officials and public employees will have 07 days off, including 5 days as prescribed and 2 days off.

Specifically: From February 8, 2024 to February 14, 2024, and the National Day holiday from August 31, 2024 to September 3, 2024.

2024 National Day holiday schedule

Including 02 days off as prescribed, in which, the holiday on September 2 of the Solar calendar, and 01 days immediately after September 2. Officials and public employees are entitled to take days off from Saturday, August 31, 2024, through Tuesday, September 3, 2024.

->> Thus, with this option on the National Day holiday in 2024, officials and public employees are entitled to 04 days off.

The days off on the Lunar New Year 2024 will be equivalent to the Solar Days as follows:

Are employers in Vietnam required to give Tet bonuses in money to employees?

Bonus is understood as the amount of money that employees are rewarded based on annual production and business results and the employee's job completion level. The bonus mechanism for employees will vary, depending on the employer.

Under Article 104 of the Labor Code 2019 as follows:

Bonuses
1. A bonus means an amount of money, a piece of property or item that is provided by an employer for his/her employees on the basis of the business performance or the employees’ performance.
2. A bonus regulation shall be decided and publicly announced at the workplace by the employer after consultation with the representative organization of employees (if any).

According to the above regulations, employers are not required to give Tet bonuses to employees. Depending on the business situation of the enterprise along with the working productivity of the employee, the employer decides whether to give Tet bonuses or not.

At the same time, according to the above regulations, employers are not required to give Tet bonuses in money to employees. Instead, employers can give Tet bonuses to employees in other forms or with assets.

What is the salary paid to employees working during the Lunar New Year holiday 2024 in Vietnam?

Under Article 98 of the Labor Code 2019 on overtime pay and night work pay as follows:

Overtime pay, night work pay
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
4. The Government shall elaborate this Article.

Thus, according to the above regulations, employees working on the Lunar New Year holiday 2024 in Vietnam are entitled to the following salary:

- At least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

- An employee who works at night will be paid an additional amount of at least 30% of the normal salary. (300% (overtime pay on Tet holidays) + 30% (working at night) + 20% * the day work salary of public holiday (300%) = 390%)

Note: This salary does not include the daily salary during public holidays or paid leave for employees receiving daily salaries.
