Documents, order, procedures for transferring schools for students in 2022 in Vietnam?

Pursuant to Article 36 of Circular 28/2020/TT-BGDDT stipulating school transfer procedures for primary school students as follows:

"1. Transfer student records
The school has a transfer student who guides the completion and confirms the validity of the application. The school accepts transfer students to receive and manage records. The dossier includes:
a) Application for transfer of the student's parent or guardian (according to the form in Appendix I attached to this Circular).
b) School records.
c) Information on learning materials (at the school being studied), progress of program implementation (according to the form in Appendix III attached to this Circular), summary table of results of training and learning assessment of students as prescribed.
d) Individual education plan for students with disabilities (if any).
2. Order and procedures for transferring schools
a) The student's parent or guardian submits the transfer application to the school where the transfer is made by direct submission, mail or online submission on the Public Service Portal (if any).
b) Within 03 working days from the date of receipt of the application, the principal of the school where the application is transferred agrees on the admission of the student to the application, in case of disagreement, he must clearly state the reason for the application and return the application to the student's parent or guardian in the form in which the application was received.
c) Upon receiving consent from the place of transfer, the student's parent or guardian shall send an application for transfer to the school where the transfer is made. Within 03 working days from the date of receipt of the application, the principal of the school where the transfer is transferred is responsible for returning the dossier to the student as prescribed in Clause 1 of this Article.
d) Parents or guardians of students shall submit all dossiers specified in Clause 1 of this Article to the school where they are transferred.
dd) Within 03 working days from the date of receipt of a complete dossier,
the principal of the school where the transfer is transferred to organize exchanges, surveys, counseling and admissions for the placement of students in the class.
3. School transfer procedures for primary school-aged students returning home from abroad.
a) The student's parent or guardian submits an application (in the form in Appendix II attached to this Circular) to the school where the transfer is made by direct submission, by post or online on the Public Service Portal (if any).
b) Within 03 working days from the date of receipt of the application, the principal of the school where the application is transferred agrees on the admission of the student to the application, in case of disagreement, he must clearly state the reason for the application and return the application to the student's parent or guardian in the form in which the application was received.
c) In case of agreeing to receive a student, within 07 working days from the date of receipt of the application, the principal of the primary school shall conduct a survey of the student's qualifications, place it in an appropriate class, receive and manage student records as prescribed."

Pursuant to Article 5 of Decision 51/2002/QD-BGDDT stipulating the order and procedures for transferring schools for high school students as follows:

“Article 5.- School change dossiers and procedures
1. A school change dossier consists of:
a/ The application for school change, signed by the mother, father or guardian.
b/ The study result register (the original).
c/ The diploma of the lower education level (a notarized copy).
d/ A birth certificate copy.
e/ The certificate of admittance to the first grade of the general secondary education level, specifying the type of the admitting school (public or non-public).
f/ The paper of introduction regarding the school change, issued by the principal of the school where the pupil leaves.
g/ The paper of introduction regarding the school change, issued by the head of the district-level Education and Training Section (for junior secondary education level) or the director of the provincial-level Education and Training Service (for senior secondary education level) of the locality where the pupil leaves (for cases of school change from other provinces or cities).
h/ Valid papers for enjoying priority and incentive regimes in study, entrance examinations and graduation examinations (if any).
i/ The household registration book or the certificate of long-term temporary residence or decision on job transfer of the father, mother or guardian to the locality where they move to, for pupils move from other provinces or cities.
j/ The written certification of the administration of the locality where the pupil resides, for pupils meeting with extreme family difficulties.
2. School change procedures:
a/ For junior secondary pupils:
- Changing to schools in the same province or city: The principals of the schools in the destination places shall receive and consider the dossiers and make decisions according to the regulations of the directors of provincial-level Education and Training Services.
- Changing to schools in other provinces or cities: The district-level Education and Training Sections of the destination places shall receive the dossiers and introduce the pupils to schools according to their residence places, together with the examined dossiers.
b/ For senior secondary pupils:
- Changing to schools in the same province or city: The principals of the schools in the destination places shall receive and consider the dossiers and settle according to the regulations of the directors of provincial-level Education and Training Services.
- Changing to schools in other provinces or cities: The provincial-level Education and Training Services of the destination localities shall receive and examine the dossiers and introduce the pupils to schools.
3. The school change shall be effected at the end of the first semester of the school year or during the summer vocation before the start of the new school year. For exceptional cases, the school change time shall be considered and decided by the heads of district-level Education and Training Sections (for the junior secondary education level) or the directors of provincial-level Education and Training Services (for the senior secondary education level), of the destination localities.”
