What is the application form for renting state-owned social housing in Vietnam?

Pursuant to Circular 19/2016/TT-BXD guiding the implementation of a number of contents on housing development, housing management and use, housing transactions, housing ownership, state management of housing specified in the Law on Housing in Vietnam 2014 and Decree 99/2015/ND-CP guiding the Law on Housing in Vietnam issued by the Minister of Construction on June 30, 2016.

The application form for renting state-owned social housing is currently the form in Appendix No. 09 issued together with Circular 19/2016/TT-BXD.

Who can rent state-owned social housing in Vietnam?

Based on the provisions of Article 52 of Decree 99/2015/ND-CP, Point 3.10 Clause 3 Subsection II Section C Part II of the List issued together with Decision 705/QD-BXD in 2021, the tenants of state-owned social housing include:

Persons credited with the revolution in accordance with the law on preferential treatment of persons credited with the revolution

Low-income people, poor and near-poor households in urban areas

Employees are working at enterprises inside and outside the industrial park

4

Officers, non-commissioned professional officers, non-commissioned officers of technical expertise, professional military personnel, workers in agencies and units of the people's police and people's army

5

Cadres, civil servants and public employees in accordance with the law on cadres, civil servants and public employees

Subjects who have returned to civil service housing

Households and individuals subject to land confiscation and must clear and demolish houses in accordance with law but have not been compensated by the State with housing or residential land satisfy the following conditions:

- There is no housing owned by them, have not been bought, rented or rented to buy social housing, have not enjoyed housing support policies, land in any form at the place of living, in case there is already a house owned by them, the average area in the household is less than 10m2 floor/person;

- Must have permanent residence registration in the province or centrally-run city where social housing is located; in case there is no permanent residence registration, there must be a temporary residence registration for one year or more in this province or city,

- For the subjects (2), (3), (4), (5) mentioned above, they must not be subject to regular income tax payment in accordance with the law on personal income tax; in case they are poor or near-poor households, they must be poor or near-poor according to the Prime Minister's regulations.

What does the application for renting state-owned social housing in Vietnam include?

According to the provisions of Point 3.3, Clause 3, Subsection II, Section C, Part II of the List issued together with Decision 705/QD-BXD in 2021, the above-mentioned social housing tenant will make a dossier of registration for renting state-owned social housing including documents, The document is as follows:

- Application for renting state-owned social housing;

- Documents proving that they are subject to and qualified for housing, residence and income;

- Documents proving that they are subject to exemption or reduction of social housing rent (if any).

Accordingly, persons wishing to rent or rent and buy state-owned social housing shall submit 02 sets of dossiers at the unit assigned to manage housing operation or at the Department of Construction in Vietnam where the housing is located.

The time limit for processing dossiers is no more than 30 days from the date on which the housing operation management unit receives all valid documents, in case it must be reviewed and scored, the time limit for settlement is not more than 60 days.
