Regulations on transferring schools in middle and high schools in Vietnam?

Pursuant to Article 2 of Decision 51/2002/QD-BGDĐT (This "non-public" cluster has been replaced by Clause 2, Article 2 of Circular 50/2021/TT-BGDĐT to "Private"), providing for the transfer in middle and high schools:

"Article 2. School transfer.

1. Except for the provisions in Clauses 2 and 3 of this Article, students may be considered and handled for school transfer if they satisfy all the conditions on subjects and procedures specified in Articles 4 and 5 of this Regulation.

2. The transfer from an ordinary high school to a specialized high school (boarding high school for ethnic minorities, specialized schools, gifted schools) must comply with the specific regulations of that special school.

3. The transfer from a private high school to a public high school may only be considered and settled in the following two cases:

a) In case a student studying at a private high school has to move his/her place of residence with his/her parents or guardian to an area with extremely difficult socio-economic conditions where there is no secondary school; In a private high school, the Director of the Department of Education and Training of the destination shall consider and decide on a case-by-case basis for transfer to a public high school.

b) In case a student studying at a private high school of the type of school having entrance exams must change his/her place of residence with his/her parent or guardian, where there is no private high school. with equivalent quality, the Director of the Department of Education and Training of the destination shall consider and decide on a case-by-case basis for transfer to a public high school."

As such, the transfer of schools at junior high schools and high schools shall comply with the above regulations.

"Article 5. Dossiers and procedures for transferring schools.

1. A school transfer dossier includes:

a) A transfer application form signed by a parent or guardian.

b) Academic transcript (original).

dd) Certificate of enrollment in the first class of upper secondary school specifying the type of school to be recruited (public or non-public).

e) Letter of recommendation for transferring schools, issued by the principal of the school where you are going.

f) Letter of recommendation for school transfer issued by the Head of Education and Training Department (for the lower secondary level); The director of the Department of Education and Training (for upper secondary school level) of the place of departure (in case of applying for a transfer from another province or city).

2. Procedures for transferring schools:

a) For junior high school students:

Transferring schools within the same province or city: The principal of the destination school receives the application and considers it, and settles it according to the regulations of the Director of the Department of Education and Training.

Transferring schools from another province or city: The Department of Education and Training of the destination receives and introduces the school according to the place of residence, together with the checked documents.

b) For high school students:

Transfer schools in the same province or city. The principal of the school at the destination receives the application and considers it, and settles it according to the regulations of the Director of the Department of Education and Training.

Transferring schools from another province or city: The Department of Education and Training of the destination receives, checks the records and introduces the school.

3. The transfer is done at the end of the first semester of the school year or during the summer time before the start of the new school year. Exceptions in terms of time shall be considered and decided by the Head of the Education and Training Department (for the lower secondary level) and the Director of the Department of Education and Training (for the upper secondary level) of the destination. "
