Shall the certificate of teachers' professional titles in Circulars 01, 02, 03, 04 be officially annulled from May 30, 2023 in Vietnam?
The Vietnam Ministry of Education and Training has just issued Circular 08/2023/TT-BGDĐT (effective from May 30, 2023) amending and supplementing a number of articles of Circulars 01/2021/TT-BGDĐT, Circular 02/2021/TT-BGDĐT, Circular 03/2021/TT-BGDĐT, Circular 04/2021/TT-BGDĐT stipulating codes and professional title standards and appointment and salary classification of teachers working in public preschool education institutions and secondary schools.
Accordingly, only 1 general certificate is prescribed for teacher ranks. Each education level has only 1 retraining program according to professional title standards.
To be specific:
Point b, Clause 3, Article 3, Point b, Clause 3, Article 4 and Point b, Clause 3, Article 5 of Circular 01 are amended as follows:
b/ Have retraining certificates according to preschool teachers' professional title standards.
Point b, Clause 3, Article 3, Point b, Clause 3, Article 4 and Point b, Clause 3, Article 5 of Circular 02 are amended as follows:
b/ Have retraining certificates according to primary school teachers' professional title standards.
Point b, Clause 3, Article 3, Point b, Clause 3, Article 4 and Point b, Clause 3, Article 5 of Circular 03 are amended as follows:
b/ Have retraining certificates according to lower secondary school teachers' professional title standards.
Point b, Clause 3, Article 3, Point b, Clause 3, Article 4 and Point b, Clause 3, Article 5 of Circular 04 are amended as follows:
b/ Have retraining certificates according to upper secondary school teachers' professional title standards.
When taking examination or consideration for rank promotion, is it not required to hold certificates of teachers' professional titles in Vietnam?
According to Circular 08/2023/TT-BGDĐT, teachers who have obtained one of the rank-based certificates of the education level issued before June 30, 2023 are determined to meet the certification requirements. They are allowed to use them when taking examination or consideration for rank promotion and are not required to study the training program according to the professional title standards corresponding to each education level.
To be specific:
A teacher who has held one of the following retraining certificates issued before June 30, 2022 is determined to meet the retraining certificate requirement under the teachers’ professional title standards corresponding to each education level. He/she can use the certificate when taking examination or consideration for rank promotion a professional title, and is not required to study the training program according to the professional title standards corresponding to each education level specified in this Circular:
- Preschool teachers have obtained one of the retraining certificates according to the professional title standards of Class II, Class III and Class IV preschool teachers.
- Primary school teachers who have obtained one of the retraining certificates according to the professional title standards of Classs II, III and IV primary school teachers;
- Lower secondary school teachers who have obtained one of the retraining certificates according to the professional title standards of Classs I, II and III lower secondary school teachers;
- Upper secondary school teachers who have obtained one of the retraining certificates according to the professional title standards of Classs I, II and III upper secondary school teachers.
Is it not required to hold certificates of teachers' professional titles when appointing or transferring to professional titles in Vietnam?
According to Article 5 of Circular 08/2023/TT-BGDĐT, when appointing and transferring to corresponding teachers' professional titles as prescribed in Circulars 01-04 and when transferring professional titles, teachers are not required to have certificates. Newly recruited teachers must obtain certificates as prescribed during the probationary period.
To be specific:
Newly recruited teachers must obtain a retraining certificate according to professional title standards as prescribed during the probationary period. Newly recruited teachers who are exempted from the probationary regime must supplement their certificates within 01 (one) year from the date of recruitment.
As of the effective date of this Circular, in case there is less than 01 (one) year in the probationary period, the certificate must be supplemented within 01 (one) year from the effective date of this Circular.
In case the teacher has not been appointed to a professional title in accordance with the education level that he/she is teaching or changes the current job position because the current professional title is not suitable with the requirements of the new job position, the head of the public service provider shall request the competent authority to decide on the consideration of the transfer of professional titles according to the provisions of Article 30 Decree 115/2020/ND-CP and ensure the principle:
- Be appointed to the professional title rank corresponding to the current professional title rank when meeting the criteria of the appointed professional title rank and transfer the classification to the nearest equal or higher salary coefficient of the transferred rank according to the guidance in Circular 02/2007/TT-BNV and current provisions of law;
- When transferring professional titles, it is not allowed to combine the rank promotion to professional titles with salary upgrade;
- When transferring professional titles, the public employee is not required to hold a retraining certificate according to the professional title standards of the transferred job position;
- The period of holding the old professional title is determined to be equivalent to the period of holding the transferred professional title.
