What are the Vietnamese regulations on determining the value of records and documents?
Pursuant to Article 22 of the Regulation on the regime of case file management and archival work in the People's Court system promulgated together with Decision 193/QD-TANDTC in 2022 stipulating the determination of the value of documents and dossiers:
"Article 22. Determination of the value of records and documents
1. The determination of the value of dossiers and documents must ensure the following principles:
a) Ensure political, historical, comprehensive and integrated principles.
b) Follow the systematic method, analyze the function, information and history.
c) Must be based on basic standards such as: " Contents of documents;
- The position of the agency, organization or individual forming the document;
- The meaning of the event, the time and place where the document was formed;
- The integrity of the archive font;
- the form of the document;
- The physical condition of the document.
2. When determining the value of files and documents, it must be based on the Table of time limits for preserving records and documents of the People's Court system (issued together with Decision No. 312/2017/QD-TANDTC dated on December 30, 2017 of the Chief Justice of the Supreme People's Court) and legal provisions on archival work.
3. The value of dossiers and documents must be determined by the Valuation Council in accordance with the provisions of law and the provisions of this Regulation."

"Article 23. Document Valuation Council
1. The Document Valuation Council was established to advise the Chief Justice in determining the time limit for preservation of archival materials, selecting documents for submission to the Agency Archives, Historical Archives and archival records. invalid document type.
2. The Document Valuation Council is established under the decision of the Chief Justice, with the following composition:
a) For the Supreme People's Court:
- Deputy Chief Justice in charge of the Department of General Meeting
- Chairman of the East Council;

- Commissioner;

- Office leader - Member;
- Representative of the unit's leader with dossiers and documents - medical members;
- People who are knowledgeable about the field with documents to determine - Uyen;
- Archives specialist - Council secretary.
d) For district-level People's Courts:
- Deputy Chief Justice of the People's Court of the province - Chairman of the Council;
- Leaders of district-level People's Courts - lieutenants;
- Office leader - nurse practitioner;
- Representative of the department with records and documents - Member;
- Archivist - Secretary of the Council."
Thus, the Council for determining the value of documents in archival work in the People's Court system is regulated by the components specified above.
