How is the lump-sum social insurance payment procedure done in Vietnam?

Step 1: Prepare your application

The employee fully prepares 01 dossier of request for social insurance payment 1 time.

Step 2: Submit the application to the social insurance agency of the district/province of residence.

- Form of submission:

+ Via electronic transactions: Employees register to receive authentication codes and send electromagnetic documents to the Vietnam Social Insurance Portal or through I-VAN Organization (if registered to use I-VAN service); in case the paper dossier is not transferred to electronic format, the entire paper dossier shall be sent to the social insurance agency via the public postal service;

+ Through public postal services;

+ Directly at the social insurance agency.

The social insurance agency receives the dossier and settles it according to regulations.

Step 3: Get the resolution results.

Time limit for settlement: Up to 05 working days from the date the social insurance agency receives a complete dossier as prescribed.

Employees receive settlement results, including:

- Relevant documents: in the registered form (Directly at the social insurance agency or through the public postal service or through electronic transactions);

- Stipend:

+ Directly at the social insurance agency or through the public postal service or through a personal account;

What does the dossier of application for lump-sum social insurance payment include in Vietnam?

Pursuant to Article 109 of the Law on Social Insurance 2014, the dossier of enjoying social insurance once is as follows:

Dossier for the enjoyment of lump-sum social insurance allowance

- The social insurance book.

- The employee’s application for the enjoyment of lump-sum social insurance allowance.

- For persons who settle abroad, a copy of the competent agency’s written certification of renunciation of Vietnamese nationality, or a certified or notarized Vietnamese translation of one of the following papers:

+ Passport issued by a foreign country;

+ Visa issued by a competent foreign agency, certifying such country’s permission for entry for overseas residence;

+ Paper certifying such person is carrying out procedures for naturalization in a foreign country; paper certifying residence or permanent residence card or residence card of a term of 5 years or more, issued by a competent foreign agency.

- Extract of the medical record, in the case specified at Point c, Clause 1, Article 60, or Point c, Clause 1, Article 77, of this Law.

- For employees defined in Article 65, and Clause 5, Article 77, of this Law, a dossier for the enjoyment of lump-sum social insurance allowance must comply with Clauses 2 and 3 of this Article.

Instructions for writing a one-time social insurance application form:

- Write down the full name of the beneficiary;

- Write down the phone number. In case the employee does not have a phone, he/she can write down the phone number of the relative when he/she needs to contact with his/her full name and relationship with that person;

- Write down the full address of the place of residence of the person requesting settlement: Number of houses, alleys (niches, alleys), streets, nests (villages, hamlets), communes (wards, towns), districts (towns, cities), provinces and cities; in case the beneficiary authorizes another person to make an application and procedures, write the address of the authorized person;

- Where the authorized person is the applicant, it states: "I am .... authorized to make an application" otherwise it is left blank. For example: I am Nguyen Van A authorized to make an application"; and enclose a Power of Attorney.

- Tick the content of the request for resolution and specify the information.

- In case the application is submitted later than the time of receiving the pension or the certificate is lost pending the regime, an explanation shall be added during the time of late application for illegal exit or whether the Court declares it missing or serving a prison sentence (if any, specify the time of illegal exit, be declared missing or serve time imprisonment) or state the loss of a certificate pending the regime and a commitment to take responsibility for the content of the accountability.

- In case of other requests, clearly state the content of the request and the information related to the settlement request, for example: In case of inconsistency of information about the surname, middle name, first name, date, month and year of birth between the identity card /passport/citizen identity card and the beneficiary dossier, waiting for social insurance benefits, clearly state what information is inconsistent with a copy of the identity card/passport of the citizen's identity card.

- Address to receive pensions, social insurance benefits, new residences to move to: Specify the number of houses, alleys (niches, alleys), streets, nests (villages, hamlets, hamlets), communes (wards, towns), districts (towns, cities), provinces and cities. In case the payment point has been determined at the place of request for receipt, it shall be clearly stated.

- Check the corresponding boxes to choose the form of receiving pensions and benefits.
