Vietnam: Increase the monthly allowance for police officers eligible for the monthly allowance from May 21, 2022

My father is a soldier of the People's Public Security who participated in the resistance war against the US and has 16 years working in the People's Public Security before retiring. As I know, the Ministry of Public Security recently issued the circular to adjust the monthly allowance for people like my father. So, what is the monthly allowance adjusted and when will the new monthly allowance be applied? Thanks a lot!

What police officers are eligible for the monthly allowance in Vietnam?

Pursuant to Article 4 of Joint Circular 05/2010/TTLT-BCA-BLDTBXH-BTC and Clause 1, Article 3 of Joint Circular 05/2012/TTLT-BCA-BLDTBXH-BTC on the beneficiaries of the monthly allowance :

- Officers and soldiers of the People's Public Security who participated in the resistance war against the US; joined the People's Police from April 30, 1975 or earlier; have less than 20 years of service in the People's Public Security; had quit his job or was discharged from the army in the cases specified in Articles 2 and 1, Article 8 of Decision No. 53/2010/QD-TTg and:

+ Having from full 15 years to under 20 years working in the People's Police;

+ Having from full 15 years to less than 20 years working in the People's Police, having quit, discharged from the army, returned to the locality, then worked in communes, wards or townships with salary from the state budget and participated in compulsory social insurance but do not meet the conditions or continue to pay voluntary social insurance premiums to be eligible for the retirement regime as prescribed in Decree No. 152/2006/ND-CP dated December 22, 2006 of the Government guiding a number of articles of the Law on Social Insurance on compulsory social insurance.

- Officers, non-commissioned officers and soldiers of the People's Public Security who are one of cases specified at Point a, Clause 2, Article 1 of this Circular with working full 15 years and under 20 years are eligible for benefits under the guidance in Article 2 This Circular (including those who have been discharged from the army or quit their jobs after December 15, 1993, currently working in communes with compulsory social insurance, they are not eligible for social insurance benefits the prescribed retirement regime; when leaving work in the commune, they are eligible to add the working time in the Police with the time working in the commune, but are not eligible for the retirement regime that the time working in the Public Security is not eligible for a lump-sum social insurance allowance) are entitled to a monthly allowance based on the number of working years with benefits; The specific benefits are as follows:

+ From full 15 years to under 16 years, the allowance level is 925,000 VND/month.

+ From full 16 years to under 17 years, the allowance level is 971,250 VND/month.

+ From full 17 years to under 18 years, the allowance level is 1,017,500 VND/month.

+ From full 18 years to less than 19 years, the allowance level is 1,063,750 VND/month.

+ From full 19 years to less than 20 years, the allowance level is 1,110,000 VND/month.

What are the regulations on the time and the adjustment for increasing monthly allowance in Vietnam?

Pursuant to Article 2 of Circular 14/2022/TT-BCA on the time and the adjustment for increasing monthly allowance as follows:

From January 1, 2022, the monthly allowance of the subjects specified in Article 1 of this Circular shall be adjusted according to the following formula:

Monthly allowance from January 1, 2022 = December 2021 benefit rate x 1,074

Example 1: Comrade Nguyen Van A is eligible for monthly allowance as prescribed in Joint Circular No. 05/2010/TTLT-BCA-BLDTBXH-BTC. Comrade A has a working period for which he is entitled to the regime of 18 years and 6 months; In December 2021, Mr. A receives a subsidy of 2,145,998 VND.

From January 1, 2022, the monthly allowance of Mr. Nguyen Van A is: 2,145,998 VND x 1,074 = 2,304,802 VND.

Example 2: Pham Van B is eligible for monthly allowance as prescribed in Joint Circular No. 05/2012/TTLT-BCA-BLDTBXH-BTC. Comrade B has a working period for which he is entitled to the regime of 16 years and 10 months; In December 2021, Mr. B will receive a subsidy of 1,975,450 VND.

From January 1, 2022, the monthly allowance of Mr. Pham Van B is: 1,975,450 VND x 1,074 = 2,121,633 VND.

What are the regulations on the form for implementing monthly allowance in Vietnam?

Pursuant to Article 3 of Circular 14/2022/TT-BCA on the form for implementing monthly allowance as follows:

- Form No. 01/QD-X01: Decision on monthly allowance according to Decision 53/2010/QD-TTg dated August 20, 2010 of the Prime Minister;

- Form No. 02/GT-X01: Letter of introduction for payment of monthly allowance according to Decision 53/2010/QD-TTg dated August 20, 2010 of the Prime Minister;

- Form No. 03/QD-X01: Decision on monthly allowance according to Decision 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister;

- Form No. 04/GT-X01:Document of introduction for payment of monthly allowance according to Decision 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister;

Thus, the Ministry of Public Security has specified the adjustment of monthly allowances for police officers who are eligible for monthly allowances. Accordingly, the Department of Organization, the Ministry of Public Security, the Department of Labor, War Invalids and Social Affairs of the provinces and centrally-run cities, the heads of the units under the Ministry, the Directors of the Public Security of the provinces and cities under central direct management shall adjust the allowance level and pay monthly allowance to the subjects.

Circular 14/2022/TT-BCA takes effect from May 21, 2022.
