In what emergencies can the electricity supply be stopped, reducing the power supply to the buyer in Vietnam?

Pursuant to Article 6 of Circular 22/2020/TT-BCT which stipulates as follows:

Article 6. Emergency electricity supply disconnection and reduction
The electricity seller may disconnect or reduce electricity supply in response to emergency in the following cases:
1. There is an incident in the electricity grid supplying electricity to the buyer; an incident in the electricity system causing electricity failure beyond the electricity seller’s control.
2. There is a risk of serious breakdown and unsafety to people, equipment and the entire electricity system.
3. There is a lack of capacity in electrical system, leading to a threat to the electricity system security.
4. Force majeure event occurs.

Accordingly, the seller of electricity may stop and reduce the emergency power supply in 4 emergency cases as follows:

- There is a problem on the power grid supplying electricity to the buyer; a breakdown in the power system causes a power outage that the seller cannot control.

- There is a risk of causing serious problems and safety for people, equipment and electrical systems.

- The power system lacks capacity, leading to a threat to the security of the power system.

- There are force majeure events.

When the emergency power supply stops or reduces in Vietnam, must the seller immediately notify the supplier?

Pursuant to Clause 2, Article 27 of the 2004 Vietnam Law on Electricity stipulates:

Article 27.- Electricity supply cessation, reduction
1. In case of non-urgent cessation or reduction of electricity supply, except for cases prescribed in Clause 6, Article 23 of this Vietnam Law, the electricity sellers must notify the electricity buyers thereof at least five days before the time of electricity supply cessation or reduction by announcing such for three consecutive days on the mass media or in other forms of information.
2. In case of urgent cessation or reduction of the electricity supply due to incidents or force majeure events, which are beyond the electricity sellers' control and threaten to cause serious unsafely for human beings, equipment or due to electricity shortage which threatens the safety of the electric systems, the electricity-generating, -transmitting or -distributing units may cease or reduce the electricity supply to the electricity buyers for handling and must within 24 hours notify the electricity buyers of the causes and the estimated time for resumption of electricity supply.
3. In cases where electricity units cease or reduce the electricity supply in contravention of the regulations on electricity supply cessation or reduction, they shall be sanctioned according to Vietnam Law provisions on handling of administrative violations; if causing damage, they must pay compensations to the electricity buyers according to Vietnam Law provisions,
4. In cases where the electricity buyers fail to comply with the provisions at Points a and b of Clause 2, Article 46, Points b and c of Clause 2, Article 47 of this Vietnam Law, the electricity sellers may cease the electricity supply to the electricity buyers.

Accordingly, stopping or reducing the emergency power supply, the seller must notify within 24 hours to notify the buyer of the cause and expected time to supply electricity again.

What is the sequence of stopping and reducing the power supply in case of emergency in Vietnam?

Pursuant to Article 9 of Circular 22/2020/TT-BCT stipulating:

Article 9. Steps and procedures for emergency electricity supply disconnection and reduction
When one of the cases specified in Article 6 of this Circular occurs, the electricity seller shall have the right to disconnect or reduce the electricity supply for emergency purposes, and then carry out the following activities:
2. Notifying the electricity buyer in the form of notification agreed upon by both parties in the electricity purchase and sale contract, including the contents specified in Clause 1 of this Article, within 24 hours from the time of the emergency disconnection and reduction of electricity supply.

Accordingly, the sequence of stopping and reducing the power supply in case of emergency is carried out as follows:

Step 1: The seller of electricity has the right to stop or reduce the emergency power supply in a number of cases as prescribed in Article 6 of Circular 22/2020/TT-BCT.

Step 2: Determine the cause, scope of impact, expected time of power supply.

Step 3: Notify the electricity buyer in the form of a notice agreed upon by the two parties in the power purchase contract, including the contents stipulating the causes, scope of impact, expected time to supply electricity again within 24 hours from the time of stoppage, reduce the level of emergency power supply.

Step 4: The seller must record the full time, cause, sequence of operation to stop or reduce the power supply in the work log or operation log.

Step 5: Coordinate with relevant parties to urgently overcome the causes leading to the shutdown, reduce the emergency power supply to supply electricity again in the fastest time.

Note that: In case of stopping or reducing the power supply level due to the lack of capacity of the electricity system, leading to threats to the security of the electricity system, the seller must ensure the correct reduction and reduction of the amount of load capacity calculated and allocated according to regulations on the preparation and implementation of electricity supply plans when the national electricity system lacks power sources.

When a shutdown must be carried out, the emergency power supply is reduced.
