In 2024, what is the retirement age of female employees in Vietnam?
Retirement age is understood as the age at which employees participating in social insurance are eligible to receive pensions according to pension regulations.
Accordingly, in 2024, the retirement age of female employees in Vietnam is determined according to Clause 2, Article 169 of the 2019 Labor Code as follows:

2. Retirement ages of employees in normal working conditions shall be gradually increased to 62 for males by 2028 and 60 for females in 2035.
From 2021, the retirement ages of employees in normal working conditions shall be 60 yeas 03 months for males and 55 years 04 months for females, and shall increase by 03 months for males and 04 months for females after every year.
Thus, based on the above regulations, the retirement age of female employees in Vietnam in 2024 is 56 years and 04 months.

The above-mentioned retirement age of female employees applies to employees working in normal working conditions.
The retirement age of female employees who suffer from work capacity reduction; doing laborious, toxic or dangerous works; and working in highly disadvantaged areas may be younger by up to 05 years than the retirement age.
What is the roadmap of retirement ages by month and year of birth applicable to female employees in Vietnam?
Under normal working conditions, the roadmap of retirement ages by month and year of birth applicable to female employees in Vietnam shall comply with Appendix I issued with Decree 135/2020/ND-CP.

Notes:
The retirement date is the last day of the month in which one reaches the full retirement age as prescribed.
If an employee continues in employment after his full retirement age as prescribed, the retirement date is the date of termination of employment.
- The start date for retirement benefits is the first day of the month following the month of the retirement date.
- If the employee's dossier does not indicate his day and month of birth, but year of birth only, January 1 of his year of birth shall be used as the basis for determining of the retirement date and start date for retirement benefits.
In what cases can female employees in Vietnam early retire?
Under the provisions of Clause 3, Article 169 of the 2019 Labor Code and Article 5 of Decree 135/2020/ND-CP, unless otherwise prescribed by law, a female employee, in any of the following circumstances, may retire at the age earlier but not exceeding 5 years before the statutory retirement age, determined until the retirement date:
- She has at least 15 years’ doing laborious, toxic and dangerous occupations or highly laborious, toxic and dangerous occupations on the lists of the Minister of Labor, War Invalids and Social Affairs.
- She has at least 15 years’ working in highly disadvantaged areas, including the period he/she works in areas with the region-based allowance of at least 0.7 (allowance for those working in disadvantaged areas) before January 01, 2021 on the list of the Minister of Labor, War Invalids and Social Affairs.
- Her work capacity reduction is at least 61%.
- She has at least total 15 years’ doing the occupations specified in point a and working in the areas specified in point b.
Accordingly, the lowest retirement age of female employees in Vietnam is specifically determined according to Clause 2, Article 5 of Decree 135/2020/ND-CP:

Shall officials who are in the period for taking disciplinary measures and reach retirement age be eligible for retirement benefits in Vietnam?
Under the provisions of Article 38 of Decree 112/2020/ND-CP as follows:
Relevant provisions when considering discipline
1. Officials and public employees who commit violatión against the law are in the period of considering disciplinary action or are within the period for taking disciplinary measures or are under investigation, prosecution or trial, but reach retirement age, they are still eligible for retirement benefits.
2. In case the disciplinary council has made a written petition on disciplinary action but the disciplinary decision has not yet been issued, which discovers additional circumstances related to the disciplinary violation or discovers that the official or public employee being considered for disciplinary action has committed other violations of law, the disciplinary council shall consider to re-propose disciplinary measure.
3. The taking of disciplinary measures to civil servants holding judicial positions shall comply with the provisions of this Decree and specialized laws.
Thus, according to the provisions of Clause 1, Article 38 of Decree 112/2020/ND-CP above, officials who are in the period for taking disciplinary measures and reach retirement age will still be eligible for retirement benefits in Vietnam.
