In 2024, what are the cases of exemption of immigration-related fees and charges in Vietnam?

Under the provisions of Clause 1 Article 5 of Circular 25/2021/TT-BTC, the cases of exemption of immigration-related fees and charges in Vietnam are specified as follows:

(1) Cases where fees are exempted

- Guests (including spouse, children) of the Communist Party, the Government, the National Assembly or heads thereof invited personally.

- Officials and employees of diplomatic missions, foreign consular missions and representative missions of international organizations in Vietnam and their family members (spouse and children under 18 years of age), regardless of passport type, that are not Vietnamese nationals and not residing in Vietnam are not required to submit fees based on reciprocity.

- Cases of exemption as per international agreement to which Vietnam is a signatory or reciprocity basis.

- Cases of exemption as per international agreement to which Vietnam is a signatory or reciprocity basis.

- Foreigners enter Vietnam to provide assistance or provide humanitarian support for Vietnamese organizations and individuals.

- Cases, where visas and/or temporary residence are issued for foreigners in Vietnam violating the law and facing penalties without being financially capable and representative missions of home countries of the foreigners, refuse to incur the fees or representative missions of home countries of the foreigners are not available in Vietnam.

Fee collectors shall decide whether the violating foreigners are eligible for exemption or not in this case and be legally responsible.

(2) Exempt passport issuance fee for Overseas Vietnamese who are subject to deportation decisions issued by competent agencies in host countries without possessing passports; overseas Vietnamese who must repatriate under international agreements on receiving citizens without passports and cases for humanitarian purposes.

Where will citizens in Vietnam apply for domestic issuance of regular passports?

Under the provisions of Clauses 3, 4, 5, Article 15 of the Law on Exit and Entry of Vietnamese citizens 2019, the places of domestic issuance of regular passports are specified as follows:

- A person shall apply for issuance of passport for the first time at immigration authority of provincial police where he/she temporarily or permanently resides;

In case he/she has Citizen Identity Cards, he/she shall apply at immigration authority of provincial police wherever suitable.

- A person applying for passport issuance for the first time may choose to do so at immigration authority of Ministry of Public Security if:

+ He/she has letter of introduction or recommendation of hospitals regarding travelling abroad for medical diagnosis and/or treatment; or

+ His/her overseas relatives are identified to be in accidents, diseased or deceased according to a well-grounded basis; or

+ Supervisory authority of his/hers who is an employee, official, officer, non-commissioned officer, professional serviceman or cadre in armed forces or personnel of cipher organization issues documents requesting issuance; or

+ He/she applies due to other humanitarian or emergency reasons decided by heads of the immigration authority of the Ministry of Public Security.

- A person shall apply for issuance of passport for the second time at immigration authority of provincial police of choice or the immigration authority of the Ministry of Public Security.
