What are the main contents of a cadastral map in Vietnam?

Pursuant to the provisions of Article 8 of Circular 25/2014/TT-BTNMT, the main contents of a cadastral map in Vietnam include the following:

- Map frame;

- National coordinate and elevation control points of all levels, cadastral points, field photo control points, surveying control points with stable landmarks;

- Administrative boundary markers, and administrative boundary lines at all levels;

- Planning boundary markers; outlines the safety protection corridors for traffic, irrigation, dykes, electrical conduction systems and other public works with safety protection corridors;

- land parcel boundaries, land type, land parcel number, land parcel area;

- Housing and other construction works: only shown on the map are the main construction works suitable for the use purpose of the land parcel, excluding temporary construction works. Underground works, when required to be shown on cadastral maps, must be specifically stated in the technical design-project estimate;

- Objects occupying land that do not constitute land parcels such as roads, irrigation works, dykes, rivers, streams, canals, canals and other elements of land occupation along lines;

- Landmarks and structures with historical, cultural, social value and high orientation significance;

- Land shape or elevation note (when required, it must be specifically stated in the technical design - project estimate);

- Explanatory notes.

Where can citizens in Vietnam see cadastral maps?

Pursuant to Article 12 of Circular 34/2014/TT-BTNMT as follows:

Procedures for providing land data
1. The enquiry form may be submitted to the receiving authority:
a) in person;
b) by post or fax; or
c) by email or through the land website.
2. The receiving authority shall receive and process the enquiry form and notify the applicant of fulfillment of financial obligations (if any). If the enquiry form is rejected, the receiving authority shall provide the applicant with a written explanation.
3. After fulfilling financial obligations, the applicant shall be provided with land data by the receiving authority.
4. Time limit for providing land data:
a) Land data shall be provided within a day if the enquiry form is received before 3 p.m. or on the following day if the enquiry form is received after 3 p.m.;
b) If the request for providing land data is made in the form of collecting information, the time limit therefor shall be determined according to an agreement concluded by and between the receiving authority and the applicant.

Thus, based on the above regulations, organizations and individuals wishing to be provided cadastral map information can apply directly at the land data provider or submit an application form for providing cadastral map information by post or via an electronic information portal.

If an organization or individual requests to provide cadastral map information before 3:00 p.m., the competent authority must provide cadastral map information on the same day of receiving the application form.

In case an organization or individual requests to provide cadastral map information after 3:00 p.m., the competent authority must provide cadastral map information on the next working day.

What is the preparation of cadastral maps and land-itemizing books in Vietnam?

Pursuant to Clause 3, Clause 4, Clause 5, Article 20 of Circular 24/2014/TT-BTNMT, the preparation of cadastral maps and land-itemizing books in Vietnam is specified as follows:

- Cadastral maps and land-itemizing books shall be established and stored in the cadastral database to be used for land management at all levels; printed out on paper for use in areas where the cadastral database has not been completed or has had no conditions to develop the use of cadastral map, digital land-itemizing book.

- Measurement and readjustment of cadastral maps, land-itemizing book shall comply with the provisions of the cadastral map of the Ministry of Natural Resources and Environment.

- If cadastral maps have not been measured, other types of measurement documents shall be used to register the land in accordance with the following provisions:

+ Where there are cadastral maps, the change of the land parcel boundaries, land types must be inspected, measured, revised to make it suitable for current conditions of use and regulations on land type, land user in accordance with the regulations to use;

+ Where there is a map of detailed planning of urban construction, construction planning of the rural residential area, inspection, revision must be carried out to suit the current conditions of land use and edit the content under the provisions on cadastral maps to use;

+ Where there is no cadastral map or map of detailed construction planning, the cadastral measurements must be carried out for use under the provisions of the cadastral map of the Ministry of Natural Resources and Environment.
