What are the regulations on salary classification when transferring in the same type of civil servants and public employees in Vietnam?
Pursuant to the provisions of Subsection 2, Section II of Circular 02/2007/TT-BNV, the salary classification when transferring ranks in the same category of civil servants and public employees is guided as follows:

2. Salary classification when transferring in the same category of civil servants and public employees:
a. In case of being appointed to a new rank in the same class as the old one (the old and new ranks have the same salary hierarchy coefficient), the salary level and % of the excess seniority allowance (if any) are enjoyed in the old tier (including counting the time to consider the next salary upgrade or considering the excess seniority allowance if any in the old tier) to the new tier.
b. In case of being appointed to a new rank with a salary coefficient of the same level higher than the old one (for example, from the rank of A2.2 to the rank of A2.1), the salary classification shall be carried out when raising the rank of civil servants and officials guided in Clause 1, Section II of this Circular.
c. In case of being appointed to a new rank with a salary coefficient of the same rank lower than the old one (for example, from a rank under A2.1 to a rank of A2.2), it shall be done as instructed at Point a, Clause 2 of this and be entitled to an additional coefficient of difference reserved equal to the salary coefficient (including excess allowance, if any) is enjoying the old tier. This reserved difference coefficient shall be implemented as instructed at Point c, Clause 1, Section II of this Circular.
Thus, the salary classification when transferring in the same category of civil servants and public employees is carried out as follows:
- In case of being appointed to a new rank in the same quota group as the old one: Equal salary level and % of seniority allowance exceeding the bracket (if any) currently enjoyed in the old tier (including calculating the time to consider the next salary upgrade or considering the excess seniority allowance if any in the old tier) to the new tier;
- In case of being appointed to a new rank with a salary coefficient of the same level higher than the old one: Perform the same salary classification when raising the rank of an official;
- In case of being appointed to a new rank, the salary coefficient of the same rank is lower than the old one:
Do the same as the salary classification in case of being appointed to the new rank in the same quota group as the old one and enjoy an additional coefficient of reserved difference equal to the salary coefficient (including the excess deficit allowance, if any) currently enjoyed in the old tier.

The transfer of salary classification for officials belonging to the group of professional titles of port commissioners who are arranging salaries in the ranks of current officials to professional titles of specialized officials in the group of professional titles of port commissioners specified of Circular 40/2022/TT-BGTVT in Circular 40/2022/TT-BGTVT is specified in Clause 3 Article 12 as follows:

3. The transfer of salaries for officials belonging to the group of professional titles of port authorities who are arranging salaries in the ranks of civil servants and current employees to professional titles of specialized officials in the group of professional titles of port authorities specified in this Circular shall comply with the guidance in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated On May 25, 2007, the Minister of Interior instructed the salary classification when raising, transferring, and transferring civil servants and public employees, specifically as follows:
a) Salary classification of professional titles of port authorities of class I, code V.12.42.01 for officers currently ranked salary class A3, group 1 (A3.1).
b) Salary classification of professional titles of port authorities grade II, code V.12.42.02 for officers currently ranked salary class A2, group 1 (A2.1).
c) Salary classification of port authority class III, code V.12.42.03 for officers currently ranked salary class A1.
d) Salary classification of port authority class IV, code V.12.42.04 for officers currently ranked salary class A0.
Thus, other specialized officers when transferring to Port Authority officers are classified as follows:
- Salary classification of professional titles of port authorities class 1, code V.12.42.01 for officers currently ranked salary class A3, group 1 (A3.1).
- Salary classification of professional titles of port authorities class 2, code V.12.42.02 for officers currently ranked salary class A2, group 1 (A2.1).
- Salary classification of professional title Port Authority 3rd class, code V.12.42.03 for officers currently ranked salary class A1.
- Rank salary of professional title Port Authority 4, code V.12.42.04 for officers currently ranked salary class A0.
When will the new rules on the transfer of salaries of port authority officers apply in Vietnam?
Regarding effectiveness, Article 13 of Circular 40/2022/TT-BGTVT stipulates as follows:
Enforceability
1. This Circular will come into force from March 01, 2023.
2. Where legal documents referred to in this Circular are amended, supplemented or replaced, they shall comply with the provisions of such amended, supplemented or replaced documents.
Thus, according to the above regulations, the new regulations on salary transfer are applied from 01/03/2023.
Circular 40/2022/TT-BGTVT will come into force from March 01, 2023.
