How is the latest cold penalty lookup regulated in Vietnam?

Cold penalty lookup is done through the following 04 main methods:

Option 1: Look up the penalty on the Traffic Police Department website (http://www.csgt.vn/)

- Step 1: Access the website of the Traffic Police Department via the link: http://www.csgt.vn/

- Step 2: Find the section "Look up vehicles violating traffic through images" in the right corner of the main screen

- Step 3: In the section "Look up vehicles violating traffic through images", enter the following information:

+ Control plates (Traffic license plates);

+ Type of vehicle (Car, Motorcycle, Electric Bike)

+ Security code

- Step 4: Click the "Look up" button at the bottom of the lookup section. The system will redirect to the results page:

+ The results of traffic violations will be displayed on the screen;

+ If the system shows "No results found!" it means that the vehicle is not penalized.

Option 2: Look up cold penalties on the website of the Vietnam Register (www.vr.org.vn)

- Step 1: Access the website of the Vietnam Register via the link: www.vr.org.vn

- Step 2: On the homepage, scroll down to the "Look up data" section in the right corner and click Find "Motor vehicles for vehicle owners"

- Step 3: The system will automatically redirect to the lookup page.

+ The owner of the vehicle enters the following information:

++ Registration plate (Traffic license plate);

++ Number of current stamps and certificates

++ Authentication code

- Step 4: Click the "Look up" button at the bottom of the lookup section. The system will redirect to the results page:

+ The results of traffic violations will be displayed on the screen as a black box with violation handling information inside;

+ If no results are found, this means that the vehicle is not penalized.

Note: This cold penalty lookup only applies to cars.

Option 3: Look up cold penalties directly on the website of the Department of Transportation

Vehicle owners can look up cold penalties through the website of the provincial Department of Transport.

However, it should be noted that this cold penalty lookup only applies to websites that have the convenience of looking up cold penalties.

For example, in Ho Chi Minh City, vehicle owners can look it up via the link http://www.giaothong.hochiminhcity.gov.vn/tracuu/#home/VIPHAM (Applicable to cars).

- Post on mass media, social networks.

How is late payment of traffic violation fines in Vietnam?

Pursuant to the provisions of Clause 1, Article 78 of the Law on Handling of Administrative Violations 2012 (amended by Clause 39 Article 1 of the Law on Handling of Administrative Violations amended 2020) on the procedure for paying fines as follows:

Article 78. Procedures for paying fines
1. During the period of execution of the sanction decision specified in clause 2 of Article 68 or clause 2 of Article 79 of this Law, sanctioned individuals and organizations must pay fines at the State Treasury or into the State Treasury's account specified in each sanction decision, except if the fine has already been paid under the provisions of clause 2 of this Article. Upon expiry of the above period, they shall be forced to execute the sanction decision and, for each day exceeding the period, the violating individual or organization must pay an additional amount accounting for 0.05% of the total outstanding fine.

Thus, according to the above provisions, in case of late payment of traffic violation fines, violators will have to pay an additional 0.05% of the unpaid fine for each day of late payment of fines, except for some cases of exemption or reduction of fines as prescribed by law.

How long is the penalty processing period in 2023 in Vietnam?

According to the provisions of Article 19a of Circular 65/2020/TT-BCA (supplemented by Clause 2 Article 4 of Circular 15/2022/TT-BCA) stipulating the time limit for handling cold penalties as follows:

19a. The order of handling the results collected by means and professional technical equipment for violations but cannot stop vehicles to control and handle administrative violations
1. Within 10 working days from the date of detection of violations, the person competent to sanction the Police agency where the administrative violation is detected shall:
a) Determine information on means of transport, vehicle owners, organizations and individuals involved in administrative violations through vehicle registration agencies and the national database on population;
c) Send a notice (according to form No. 02/65/68) requesting vehicle owners, organizations and individuals involved in administrative violations to the headquarters of the Police agency where administrative violations are detected or to the headquarters of the commune-level Police, the district police of the place of residence or headquarters to settle the case of administrative violation if the travel is difficult and not have conditions to go directly to the headquarters of the Police agency where administrative violations are detected as prescribed in Clause 2, Article 15 of the Government's Decree No. 135/2021/ND-CP dated December 31, 2021 stipulating the list, management and use of professional technical devices and equipment and collection processes, use data obtained from technical devices and equipment provided by individuals and organizations to detect administrative violations (hereinafter abbreviated as Decree No. 135/2021/ND-CP).

Thus, the time limit for handling cold penalties is 10 days from the date of detection of violations. During this time, the person competent to sanction the police agency where the administrative violation is detected determines the information and carries out sanctions according to regulations.
