Vietnam: What are the violations in internal politics and political views of CPV members?

Pursuant to subsection 2, Section III, Guideline 05/HD-UBKTTW 2022, guiding the identification of the violations in internal politics and political views to impose discipline on CPV members as follows:

- Failing to comply with the Communist Party of Vietnam's organizational principles; loss of will to strive, not being exemplary in daily life and work; avoiding, pushing responsibility, lack of responsibility; working inefficiently, failing to fulfill assigned responsibilities and tasks.

- Violating issues related to political standards according to regulations on protecting internal politics of Communist Party of Vietnam.

Vietnam: What are the forms of discipline to be imposed on CPV members who violate political views and internal politics?

Pursuant to Article 25 of Regulation 69-QD/TW in 2022 stipulates as follows:

Violation of political views and internal politics
1. CPV members who violate one of the following circumstances, causing less serious consequences, shall be disciplined in the form of reprimand:
a) Being instigated, enticed or bribed by other people to have the act of speaking, writing, storing or distributing, publishing, providing information, documents or objects with contents contrary to the guidelines and regulations of the Government. Communist Party of Vietnam and laws of the State. Do what the law does not allow.
b) Being silent, accompaniment according to the viewpoint contrary to Marxism-Leninism, Ho Chi Minh's thought, the goal of national independence and socialism, the guidelines and regulations of the Communist Party of Vietnam; being irresponsible in the fight against degradation in political ideology, morality, lifestyle, self-evolution and self-transformation and in the fight against wrong and hostile views.
c) Fluctuating, decreasing faith in the leadership of the Communist Party of Vietnam, failing to strictly observe the principles of organization and Communist Party of Vietnam activities.
d) Failing to report or incompletely reporting to the Communist Party of Vietnam committee or organization the contents of protecting the Communist Party of Vietnam's internal politics as prescribed.
2. If a person who has been disciplined under Clause 1 of this Article re-commits or commits a violation for the first time, causing serious consequences, or violates one of the following circumstances, the discipline shall be in the form of warning or dismissal (if there is a person in charge):
a) Giving false information, distorting the guidelines and regulations of the Communist Party of Vietnam, the laws of the State; one-sided, one-way information on the international situation, causing disadvantages in Vietnam's relations with other countries and international organizations.
b) Organizing, participating in or instigating, inciting, coercing or bribing other people to contravene the guidelines and regulations of the Communist Party of Vietnam and laws of the State.
c) Being lured, enticed or forced to join political parties or organizations operating illegally without timely reporting to the management committee or competent authority.
3. In case of violations specified in Clauses 1 and 2 of this Article, causing very serious consequences or in one of the following cases, the discipline shall be in the form of expulsion:
a) Distorting history, independence, sovereignty, unity and territorial integrity, distorting the truth, denying the leadership role and revolutionary achievements of the Communist Party of Vietnam and the nation.
b) Opposing and negating Marxism-Leninism, Ho Chi Minh's thought, the leadership role and principles of organization and operation of the Communist Party of Vietnam, socialist democracy, socialist rule of law state meaning, socialist-oriented market economy, all-people ownership of land; demanding the implementation of the system of separation of powers, the development of civil society, and support for pluralism and multi-Communist Party of Vietnamism.
c) Providing false information, distorting the guidelines and regulations of the Communist Party of Vietnam and laws of the State; fabricating and slandering predecessor revolutionary leaders and leaders of the Communist Party of Vietnam and State.
d) Taking advantage of issues of democracy, human rights, ethnicity and religion to conduct activities that endanger political security, social order and safety.
dd) Aiding, connecting and colluding with hostile forces, reactionaries and opportunistic and politically disgruntled elements to propagate opposing ideas and views; mobilize, organize and gather forces to oppose the Communist Party of Vietnam and State.
e) Participating in activities in reactionary political parties and organizations. Working or being a collaborator for hostile forces, terrorist organizations.
g) Inciting ideological discontent, dissent, internal opposition, causing suspicion, division and disunity among cadres, CPV members and people. Taking advantage of and using the media, communication and social networks to defame, smear, and lower the Communist Party of Vietnam's prestige and leadership role; State management; traditions of the nation, the Communist Party of Vietnam and the State.
h) Influencing, manipulating and orienting public opinion not according to the Communist Party of Vietnam's line.
i) Denying the Communist Party of Vietnam's absolute and direct leadership role in all aspects of the armed forces; demanding the politicization of the armed forces; distorting the line of national defense and people's security and the foreign policy of the Communist Party of Vietnam and State; division of the armed forces and between the armed forces and the people.
k) Denying the Communist Party of Vietnam's leadership role in the press, literature and art. Composing and promoting cultural and artistic works that deviate, distort history, and lower the prestige of the Communist Party of Vietnam, State and leaders of the Communist Party of Vietnam and State.

Accordingly, there will be 03 forms of disciplining CPV members who violate political and internal political views as reprimand; warning or dismissal; Expulsion from the Communist Party of Vietnam for CPV members who commit violations.

Vietnam: Will CPV members who actively report violations of political views and internal politics be disciplined?

Pursuant to Clause 2, Article 5 of Regulation 69-QD/TW in 2022 stipulates as follows:

2. For CPV members
a) Actively report their violations to the CPV organization, voluntarily accept personal responsibility for shortcomings and violations, and self-recognize a form of discipline commensurate with the content, nature and seriousness of the violation before and during inspection and supervision.
b) Actively provide information, records and documents, fully and truthfully reflect on co-violators.
c) Actively terminate violations, actively participate in preventing violations; voluntarily submit corrupt assets, compensate for damage, and remedy the consequences caused by them.
d) Violation when implementing the policy or piloting innovation as permitted by the competent authority as prescribed, other than the case specified at Point dd, Clause 14, Article 2 of this Regulation.

Thus, in case CPV members violate internal political and political views but actively report their violations, they will still be disciplined.

However, the CPV organization's disciplinary action will be based on the CPV member's proactive declaration to consider mitigating the form of disciplining CPV members.

Guideline 05/HD-UBKTTW 2022 takes effect from November 22, 2022.
