Pursuant to Point b, Clause 1, Article 3 of Circular 08/2013/TT-BNV of Vietnam stipulating as follows:

1. Advance salary increase regime due to outstanding achievements in task performance:

b) Rate of salary increase ahead of time:
Percentage of cadres, civil servants, public employees and employees (except for the subjects specified in Clause 2 of this Article) whose salary level is raised ahead of time due to outstanding achievements in task performance within a year not exceeding 10% of the total number of cadres, civil servants, public employees and employees in the salary list of agencies and units. The salary list of the agency or unit is determined by the decision of the competent authority to assign payroll (for cadres and civil servants) or to approve the number of people working (for public employees and employees) up to December 31 of the year in which the salary level increase is considered ahead of schedule.
Thus, in a year, the number of civil servants, public employees and employees who have made excellent achievements in performing their duties and are promoted to salary level will not exceed 10% of the total number of cadres, civil servants, public employees and employees in the salary list of agencies and units.

Civil servants, public employees and employees in Vietnam are entitled to a raise in salary level ahead of time due to outstanding achievements in performing tasks:
Pursuant to Point a, Clause 1, Article 3 of Circular 08/2013/TT-BNV of Vietnam stipulating as follows:
The mode of raising salary level ahead of time in Vietnam
1. Advance salary increase regime due to outstanding achievements in task performance:
a) Eligible conditions and regimes:
The subjects specified in Clause 1, Article 1 of this Circular fully meet the 02 criteria specified in Clause 2, Article 2 of this Circular and have made excellent achievements in performing the tasks recognized in writing by the competent authorities. If the last salary level has not been ranked in the rank or title and by December 31 of the year in consideration for raising the salary grade, there is a gap of 12 months or less in order to receive a regular salary increase. The maximum salary level is 12 months ahead of the time specified at Point a, Clause 1, Article 2 of this Circular.
Thus, according to the provisions of Clause 1, Article 1 of Circular 08/2013/TT-BNV of Vietnam (some regulations are amended by Clause 1, Article 1 of Circular 03/2021/TT-BNV), civil servants and public employees , the following employees will be promoted ahead of time due to excellent performance in task performance:
- Cadres, civil servants and public employees arrange their salaries according to the salary table of senior experts, professional and professional salary tables, perform and serve working in state agencies from the central government to communes, wards and towns (communes, wards and townships collectively referred to as commune levels) and in public service providers, including:
+ Cadres in state agencies from the central government to districts, towns and provincial cities who are subject to salary classification according to the rank and grade of administrative civil servants specified at Point b, Clause 1, Article 3 of Decree 204/2004/ND-CP;
+ Civil servants and public employees in state agencies and public service providers shall arrange their salaries according to the high-level expert's salary table, professional, execution, and service payrolls (including professional titles of the Court and the Procuracy);
+ Commune-level cadres specified at Point b, Clause 1, Article 5 and commune-level cadres specified at Point a, Clause 2, Article 5 of Decree 92/2009/ND-CP of Vietnam.
- Those who arrange salaries according to the salary schedule of senior experts, professional, professional, and service salary tables prescribed by the State shall be decided by competent authorities to come and work at projects and international agencies, organizations located in Vietnam but still on the list of salaries paid by agencies and units.
- Those who work under the labor contract regime are paid according to the salary table prescribed by the State in state agencies, public service providers according to current regulations of law.
- Those who arrange salaries according to the salary table prescribed by the State and belong to the payroll quotas shall be funded by the state budget in associations with specific characteristics specified in Decree 45/2010/ND-CP.
Cadres, civil servants, public employees and employees who have announced their retirement:
Pursuant to Clause 2, Article 3 of Circular 08/2013/TT-BNV of Vietnam stipulating on the subjects who are entitled to raise the salary level ahead of time due to the notice of retirement as follows:
Cadres, civil servants, public employees and employees who have announced their retirement, if during the period of holding the rank, they fully meet the 02 criteria specified in Clause 2, Article 2 of Circular 08/2013/TT-BNV of Vietnam, and have not been ranked yet. the last salary in the category or in the title and from the date of retirement notice to before the date of retirement, there is a shortage of 12 months or less in order to receive a regular salary increase according to regulations, they will be entitled to a salary increase before the deadline 12 months compared to the time specified at Point a, Clause 1, Article 2 of Circular 08/2013/TT-BNV of Vietnam.
Thus, the above two groups of civil servants, public employees and employees will receive a salary increase when under the salary increase regime ahead of time without having to wait for the time to increase the statutory pay rate.
Who is not allowed to raise their salary level ahead of time?
Pursuant to Clause 2, Article 1 of Circular 08/2013/TT-BNV of Vietnam stipulating those who are not allowed to apply the regulations on raising salary grades before the due date are as follows:
- Cadres who are subject to salary classification according to the salary table of positions which have been paid according to the term of office.
- Commune-level cadres who are enjoying retirement benefits or benefits for loss of working capacity specified at Point c, Clause 1, Article 5 of Decree No. 92/2009/ND-CP of Vietnam and Clause 1, Article 1 of Decree No. 29/2013/ND-CP of Vietnam.
- Commune-level civil servants who have not graduated from the professional training specified at Point b, Clause 2, Article 5 of Decree No. 92/2009/ND-CP of Vietnam.
