What is the penalty for improper classification of garbage in Vietnam?
Pursuant to Clause 2, Article 25 of Decree No. 45/2022/ND-CP stipulating the act of collecting and disposing of waste in contravention of regulations on environmental protection, the fines shall be
- A fine ranging from VND 100,000 to VND 150,000 shall be imposed for discarding, disposing or discarding cigarette butts or heads at the wrong places in apartment, commercial, service or public places;
- A fine ranging from VND 150,000 to VND 250,000 shall be imposed for acts of personal hygiene (urinating, defecating) at the wrong place in apartment, commercial, service or public places;
- A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for dumping, disposing of, disposing of garbage or dumping wastewater at the wrong place in apartment, commercial, service or public places, except for violations of regulations. specified at Point d of this Clause;
- A fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed for dumping, disposing or disposing of garbage on sidewalks, roadways or into urban wastewater drainage systems or surface water drainage systems; dumping wastewater in contravention of regulations on sidewalks and street beds; Dispose of plastic waste generated from daily life into ponds, lakes, canals, rivers, streams and sea.
Thus, acts of not classifying domestic solid waste according to regulations, not using packaging containing domestic waste can be fined from 500,000 VND to 1 million VND.
Note: The fine level for administrative violations specified in Chapter II of this Decree is the fine level applicable to administrative violations committed by individuals. For organizations with the same violations, the fine level is 2 times higher than the fine level for individuals (according to Clause 2, Article 6 of Decree 45/2022/ND-CP).

Pursuant to Article 75 of the Law on Environmental Protection 2020 of Vietnam stipulates the classification, storage and transfer of daily-life solid waste:
- Domestic waste generated by households and individuals is classified as:
+ Reusable and recyclable solid waste;
+ Food waste;
+ Other domestic solid waste.
- Provincial People’s Committees shall to classify domestic solid waste specified in Point c Clause 1 of this Article within their provinces under the guidance of the Ministry of Natural Resources and Environment; introduce policies to encourage the classification of hazardous waste present in domestic solid waste generated by households and individuals.
- Households and individuals in urban areas must contain the domestic solid waste already classified as prescribed in Clause 1 of this Article in packages for transfer as follows:
+ Reusable and recyclable solid waste shall be transferred to entities for reuse and recycling or facilities licensed for collection and transport of domestic solid waste;
+ Food waste and other domestic solid waste must be contained in packages as prescribed and transferred to facilities licensed for collection and transport of domestic solid waste; food waste may be used as organic fertilizers and animal feeds.
- Households and individuals in rural areas that generate domestic solid waste and classify them as prescribed in Clause 1 of this Article shall manage them as follows:
+ Households and individuals are encouraged to make the most of waste food to be used as organic fertilizers and animal feeds;
+ Reusable and recyclable solid waste shall be transferred to entities for reuse and recycling or facilities licensed for collection and transport of domestic solid waste;
+ If not used as prescribed in Point a of this Clause, food waste shall be transferred to or facilities licensed for collection and transport of domestic solid waste;
+ Other domestic solid waste must be contained in packages as prescribed and transferred to facilities licensed for collection and transport of domestic solid waste.
- Households and individuals in rural areas that produce domestic solid waste shall classify, contain and transfer domestic solid waste as prescribed in Clause 3 of this Article.
- The classification, collection, transport and treatment of bulky waste shall comply with regulations imposed by provincial People’s Committees.
- The Vietnamese Fatherland Front Committee and socio-political organizations at all levels shall encourage residential communities, households and individuals to classify domestic solid waste at source. Internal residential communities and socio-political organizations shall supervise the classification of domestic solid waste by households and individuals.
In addition, the guidance on waste classification can be found in Clause 2, Article 1 of Decision 09/2021/QD-UBND amending and supplementing Article 5 of Decision 12/2019/QD-UBND:
- Individuals, households and source owners of domestic solid waste (abbreviated as MSW) shall classify MSW at source suitable for management and treatment purposes, into two groups as follows:
+ The group of wastes can be reused and recycled.
+ The remaining group of wastes (excluding hazardous waste generated from households and waste source owners).
- Depending on the socio-economic conditions and the municipal solid waste treatment technology, the City People's Committee will specify the quantity and composition of waste groups that can be reused and recycled according to the roadmap. for the People's Committees of districts and Thu Duc city (hereinafter referred to as the People's Committee of the district) to implement.
- Waste at source after sorting must be stored in separate packages (bags) or storage devices (bins), with signs identifying the type of waste or according to current regulations of law.
- Packaging (bags), storage devices (bins) of solid waste after sorting must meet the following requirements:
+ Ensuring safe storage of waste, waterproofing, no leakage of leachate and suitable size for the amount of waste and storage time.
+ The packaging (bag) must be tightly sealed, the storage device (the box) must have a tight lid to ensure that no odor is emitted, and there must be a warning sign on the body of the box.
- The organization and implementation of MSW classification must comply with detailed instructions of state management agencies.
- Limit the use of non-biodegradable plastic bags to store MSW after sorting, encourage the use of biodegradable plastic bags and environmentally friendly packaging to replace difficult-to-decompose plastic bags.
Why do you have to sort garbage at home?

Decree 45/2022/ND-CP comes into force from August 25, 2022.
