Celebrations such as fireworks displays, art programs, and festivals are usually bustling in many major cities.

How will employees in Vietnam be paid if they work on New Year’s Day 2025?

According to Article 98 of the Labor Code 2019 which regulates overtime and nighttime work wages in Vietnam:

Overtime and nighttime work wages

1. Workers who work overtime shall be paid wages calculated based on the wage unit price or the actual wage paid for the job they are doing as follows:

a) On normal days, at least 150%;

b) On weekly days off, at least 200%;

c) On public holidays, New Year's holidays, paid days off, at least 300% excluding the wage for public holidays, New Year's holidays, paid days off for workers receiving daily wages.

2. Workers who work at night shall be paid an additional wage of at least 30% calculated based on the wage unit price or the actual wage for a normal working day.

3. Workers who work overtime at night, apart from the wage stipulated in clauses 1 and 2 of this Article, shall be paid an additional 20% wage calculated based on the wage unit price or the daytime work wage of a normal working day, weekly day off, or public holiday, New Year's holiday.

4. The Government of Vietnam shall detail this Article.

Thus, if workers work on New Year’s Day 2025, apart from the holiday wages, they will also receive additional overtime wages.

Workers who work on New Year’s Day 2025 will be paid as follows:

- If the worker works during the day, they will receive at least 400% of their wage.- If the worker works at night, they will receive at least 490% of their wage.

Will fireworks displays be organized for New Year’s Day 2025 in Vietnam?

According to Article 11 of Decree 137/2020/ND-CP (amended by clause 2, Article 3 of Decree 56/2023/ND-CP) regarding permitted fireworks events:

(1) Lunar New Year

- Centrally-run cities and Thua Thien Hue Province may set off high-altitude and low-altitude fireworks for no more than 15 minutes; other provinces may set off low-altitude fireworks for no more than 15 minutes;

- The time is at the Lunar New Year’s Eve.

(2) Hung Kings’ Commemoration Day

- Phu Tho Province may set off low-altitude fireworks for no more than 15 minutes at the Hung Kings' Temple area;

- The time is 9:00 PM on March 9 of the lunar calendar.

(3) National Day

- Centrally-run cities and Thua Thien Hue Province may set off high-altitude and low-altitude fireworks for no more than 15 minutes; other provinces may set off low-altitude fireworks for no more than 15 minutes;

- The time is 9:00 PM on September 2.

(4) Dien Bien Phu Victory Day

- Dien Bien Province may set off low-altitude fireworks for no more than 15 minutes at Dien Bien Phu City;- The time is 9:00 PM on May 7.

(5) Victory Day (April 30 lunar calendar)

- Hanoi and Ho Chi Minh City may set off high-altitude and low-altitude fireworks for no more than 15 minutes;

- The time is 9:00 PM on April 30.

(6) Anniversary of liberation, establishment day of centrally-run cities and provinces

- Centrally-run cities and Thua Thien Hue Province may set off high-altitude and low-altitude fireworks for no more than 15 minutes; other provinces may set off low-altitude fireworks for no more than 15 minutes;

- The time is 9:00 PM on the anniversary of the liberation or establishment day of centrally-run cities and provinces.

Thus, New Year’s Day 2025 is not among the holidays for which the State organizes fireworks displays.

However, localities may seek permission to set off fireworks for New Year's Day from the Ministry of Culture, Sports, and Tourism.
