How is the principle of granting personal protection to workers regulated in Vietnam?

Pursuant to Article 5 of Circular 25/2022/TT-BLDTBXH, the provision of personal protective equipment at work is carried out according to the following principles:

- The employer must organize the assessment and control of dangerous and harmful factors at the workplace in accordance with the provisions of law; take measures on occupational safety and hygiene technologies, equipment and techniques to eliminate or minimize the harmful effects of dangerous and harmful factors and improve working conditions before taking measures to provide personal protective equipment.

- The employer shall make a list and page of personal protective equipment for employees according to the list of personal protective equipment issued to employees doing occupations and jobs with dangerous elements and harmful factors specified in Appendix I promulgated together with Circular 25/2022/TT-BLDTBXH.

- In addition to making the list specified in Clause 2, Article 5 of Circular 25/2022/TT-BLDTBXH, employers actively develop lists and pages to provide personal protective equipment for employees to ensure safety and health for employees in the following cases:

+ Occupations and jobs not specified in Appendix I promulgated together with Circular 25/2022/TT-BLDTBXH that the employer deems to have dangerous and harmful factors that do not ensure health safety for employees.

+ Occupations and jobs are specified in Appendix I promulgated together with Circular 25/2022/TT-BLDTBXH but it is necessary to supplement the list of personal protective equipment to ensure effective prevention of harmful effects of dangerous and harmful factors in the working environment.

- The employer shall, based on the level of requirements of each profession or specific job at its establishment, the manufacturer's recommendations for each type of personal protective equipment, decide the shelf life and quantity of personal protective equipment to suit the nature of the work and the quality of personal protective equipment.

- Depending on specific requirements, the employer shall provide necessary personal protection facilities for persons who come to inspect, inspect, visit and study for use during the inspection, inspection, visit and study period.

- The employee does not have to pay for the use of personal protective equipment and has the right to request the employer to add new or change the type of personal protective equipment to suit actual conditions.

Before implementing measures to provide personal protective equipment to employees, what should employers do in Vietnam?

Pursuant to Article 5 of Circular 25/2022/TT-BLDTBXH stipulates as follows:

1. The employer must organize the assessment and control of dangerous and harmful factors at the workplace in accordance with law; take measures on occupational safety and hygiene technologies, equipment and techniques to eliminate or minimize the harmful effects of dangerous and harmful factors and improve working conditions before taking measures to provide personal protective equipment.

Accordingly, before taking measures to provide personal protective equipment, employers must:

- Organize the assessment and control of dangerous and harmful factors at the workplace in accordance with the provisions of law;

- Take measures on occupational safety and hygiene technologies, equipment and techniques to eliminate or minimize the harmful effects of dangerous and harmful factors and improve working conditions.

Circular 25/2022/TT-BLDTBXH will come into force from April 01, 2023.
