The minimum salary used to calculate the payment of social insurance, health insurance, unemployment insurance, occupational accident and occupational disease insurance from July 1, 2022 in Ho Chi Minh City, Vietnam?

According to Official Dispatch 3288/BHXH/QLT in 2022 of Vietnam on the regional minimum wage applied in these area:

Region I increased by 260,000 VND, from 4,420,000 VND/month to 4,680,000 VND/month.

Region II increased by 240,000 VND, from 3,920,000 VND/month to 4,160,000 VND/month.

Region III increased by 210,000 VND from 3,430,000 VND/month to 3,640,000 VND/month.

Region IV increased by 180,000 VND from 3,070,000 VND/month to 3,250,000 VND/month.

About the minimum hourly wage according to 4 regions: Region I is 22,500 VND/hour, Region II is 20,000 VND/hour, Region III is 17,500 VND/hour, Region IV is 15,600 VND/hour.

- Minimum wage is the lowest salary paid to employees who do the simplest jobs in normal working conditions in order to ensure a minimum standard of living for employees and their families, in accordance with social- economic development.

- The employer operating in an area in any region shall apply the minimum wage rate prescribed for that area; If the unit or branch operates in different areas with different minimum wages, in which area the unit or branch operates, the minimum wage rate prescribed for that area shall apply; Units operating in industrial parks or export processing zones located in different areas with different minimum wages shall apply according to the areas with the highest minimum wages.

- For employees who are receiving salary according to other forms of salary payment (weekly, daily, product-based, package salary), the salary being paid according to these salary payment methods shall not be converted lower than the monthly minimum wage or the hourly minimum wage prescribed by the Government.

- Review the agreements in the labor contract, the collective labor agreement and the employer's regulations and regulations to adjust and supplement accordingly; must not remove or reduce salary regimes when employees work overtime, work at night, compensation in kind and other regimes as prescribed by labor law.

- For the contents agreed, committed in the contract, labor agreement or other lawful agreements that are more favorable to the employee than the provisions of Decree 38/2022/ND-CP of Vietnam, continue continue to be implemented, including the salary regime paid to employees who perform jobs or titles through vocational training or vocational training that is at least 7% higher than the minimum wage, the implementation will continue, except otherwise agreed by the two parties in accordance with the provisions of law.

What is the guideline on the payment of social insurance premiums of health insurance, unemployment insurance and occupational accident and occupational disease insurance for employees according to the new minimum wage in Vietnam?

According to Official Dispatch 3288/BHXH/QLT in 2022 of Vietnam, the insurance premium rates are guided:

- After the employers review and adjust the minimum wage in the salary scale, the salary table that the unit has sent to the state management agency in charge of labor according to the principle that it must not be lower than the minimum wage specified in Decree No. 38/2022/ND-CP of Vietnam.

- On that basis, adjust the salary and remuneration rates stated in the labor contract as the basis for payment of social insurance, health insurance, unemployment insurance and occupational accident and occupational disease insurance for each employee according to the established salary scale and salary table.

- No later than July 25, 2022, the employer must submit an application for adjustment of the salary paid for social insurance, health insurance, unemployment insurance and occupational accident and occupational disease insurance for employees according to the new minimum salary (if any). Past the above time limit, if the unit has not adjusted, the social insurance agency will temporarily adjust the salary paid for social insurance, health insurance, unemployment insurance and occupational accident and occupational disease insurance by the new minimum wage for employees doing the simplest jobs until when the unit prepares an adjustment dossier according to regulations.

- The social insurance agency only confirms the process of social insurance and unemployment insurance and settles benefits when the unit prepares a dossier for adjusting the minimum wage in accordance with the above regulations.

What is the guideline to adjust the insurance premium to the occupational accident and disease fund in Vietnam?

According to Official Dispatch 3288/BHXH/QLT in 2022 of Vietnam, the instructions are:

The policy of reducing the contribution rate to the occupational accident and occupational disease fund by 0% of the salary fund as the basis for paying social insurance premiums according to the Vietnamese Prime Minister's Decision No. 23/2021/QD-TTg has been implemented for 12 months, from July 1, 2021 to the end of June 30, 2022. Therefore, from July 1, 2022, the employer shall pay the occupational accident and disease insurance fund at the rate of 0.5% of the salary fund as the basis for paying social insurance contributions according to Decree No. 58/2020/ND-CP of Vietnam dated May 25, 2020 stipulating the rate of payment of compulsory social insurance to the Fund of Occupational Accidents and Diseases.
