Is it compulsory for guest reception to be performed by the Prime Minister of Vietnam?

Pursuant to Article 37 of the Regulation promulgated together with Decree 39/2022/ND-CP stipulates as follows:

“Article 37. Regulations on guest receptions
1. The Prime Minister may receive in person or assign a Deputy Prime Minister or a Government member to receive on his/her behalf guests of the Government or Prime Minister.
2. The Government Office is tasked:
a) To receive written proposals for guest receptions by the Prime Minister or a Deputy Prime Minister from related ministries, agencies, organizations and individuals; to advise and propose the Prime Minister or Deputy Prime Minister to consider and decide on the agenda, form and participants in the receptions; timely notify the opinions of the Prime Minister or Deputy Prime Minister to related ministries, agencies, organizations and individuals;
b) To coordinate with related ministries and agencies in preparing the agendas and documents for guest receptions, time, venues, participants and interpreters (if necessary);
c) To organize service and ensure reception protocols, logistics, security and safety for guest receptions; invite news and press agencies to report on guest receptions according to regulations.”

Accordingly, the Prime Minister of Vietnam may receive in person or assign a Deputy Prime Minister or a Government member to receive on his/her behalf guests of the Government or Prime Minister.

Thus, it’s not compulsory for guest reception to be performed by the Prime Minister of Vietnam

Pursuant to Article 38 of the Regulation promulgated together with Decree 39/2022/ND-CP stipulates as follows:

“Article 38. Working visits to localities and establishments
1. Under the direction of the Prime Minister or Deputy Prime Ministers and at the proposal of localities, the Government Office shall prepare programs for the Prime Minister’s or Deputy Prime Ministers’ working visits to localities. The preparation must comply with Clauses 2, 3 and 4, Article 29 of this Regulation.
2. For an unexpected working visit by the Prime Minister or a Deputy Prime Minister without advance notice to a locality or an establishment, the Government Office shall prepare the program for the working visit under the direction of the Prime Minister or Deputy Prime Minister..
3. The Prime Minister’s working teams to visit and work in localities shall be organized in conformity with regulations of the Party Central Committee and Political Bureau. Government members are responsible for fully participating in working trips of the Government and Prime Minister upon request. In case of absence or absence for a period of time, a report must be made and approved by the Prime Minister, the deputy may be assigned to attend instead.
4. Government members shall spare time for paying inspection visits to localities.. Depending on its program, each working visit may be organized in an appropriate form to ensure practicality and thrift..
5. Ministers, heads of ministerial-level agencies and heads of government-attached agencies who are invited to participate in conferences and delegations other than the Government of important nature must clearly report on the purpose, content and time. Time to participate with the Prime Minister, Deputy Prime Minister in charge to consider, decide and after the meeting, business trip, must have a quick report on the results to the Deputy Prime Minister in charge and Prime Minister."

Thus, working visits to localities and establishments of the Prime Minister and Deputy Prime Minister shall comply with the above provisions.

In case the Prime Minister goes for an unscheduled inspection without notifying localities and establishments in advance, the Government Office shall prepare a business trip program under the direction of the Prime Minister.

What are the responsibilities of the Ministry of Foreign Affairs in the overseas working visits of Government members and heads of government agencies in Vietnam?

Pursuant to Article 39 of the Regulation promulgated together with Decree 39/2022/ND-CP stipulates as follows:

“Article 39. Overseas working visits
1. The organization of overseas working visits of Government members and heads of Government agencies shall strictly comply with the regulations of the Party and the Government.
2. The Ministry of Foreign Affairs shall assume the prime responsibility for, and coordinate with the Government Office and relevant ministries and agencies in, formulating a scheme on the policy of the working visits, formulating the program, composition of the delegation, preparation of working contents, the contents of reception, propaganda and communication security; take full responsibility for the implementation of the contents, work programs and reception works of the working visits, reports to the Deputy Prime Minister in charge before reporting to the Prime Minister for consideration and decision.
3. At the request of the Ministry of Foreign Affairs, the Government Office shall submit to the Prime Minister and Deputy Prime Minister for consideration and decision the programs, working contents and composition of the working visits.
4. The Ministry of Foreign Affairs shall assume the prime responsibility for, and closely coordinate with the Government Office, relevant ministries and agencies in, formulating press releases on the results of the working visits and sending them to press agencies. The Ministry of Foreign Affairs shall promptly and fully report on the results of official activities of the working visits as prescribed.
5. Government members, heads of government-attached agencies, presidents of the People's Councils, and presidents of provincial-level People's Committees, before going on a oversea working visits or joining delegations on oversea working visits, must apply for an application, which shall be permitted and approved by the Prime Minister, including working visits carried out in accordance with the annual plan of foreign activities approved by the Prime Minister. After returning from a oversea working visit, within 07 days, report to the Prime Minister the results of the trip."

Accordingly, the Ministry of Foreign Affairs will have responsibilities such as presiding over and coordinating with the Government Office and relevant ministries and agencies in formulating a scheme on the policy of the business trip, taking full responsibility for the implementation of the contents, working program and reception work of the working visits, etc. according to the above regulations.
