From May 18, 2024, what are the rank codes for civil judgment enforcement officials in Vietnam under Circular 02/2024/TT-BTP?

On April 3, 2024, the Minister of Justice issued Circular 02/2024/TT-BTP stipulating codes, professional standards, and salary classification for civil judgment enforcement officials.

Article 3 of Circular 02/2024/TT-BTP stipulates the rank codes for civil judgment enforcement officials in Vietnam as follows:

1. Senior Enforcer

2. Intermediate Enforcer

Code: 03.300

3. Primary Enforcer

Code: 03.301

4. Senior Examiner in judgment enforcement

Code: 03.230

5. Principal Examiner in judgment enforcement

Code: 03.231

6. Examiner in judgment enforcement

Code: 03.232

7. Clerk in judgment enforcement

Code: 03.302

8. Intermediate Clerk in judgment enforcement

Code: 03.303

In addition, under the provisions of Article 4 of Circular 02/2024/TT-BTP, the general standards for civil judgment enforcement officials in Vietnam are specified as follows:

- Have strong political bravery, consistency with Marxism-Leninism, Ho Chi Minh's thought, master the Party's guidelines and lines; loyalty to the Fatherland and the Constitution of the Socialist Republic of Vietnam; and protect the interests of the Fatherland and the People.

- Fulfill the obligations of officials as prescribed by law; strictly obey the assignment of tasks of superiors; obey the law, maintain discipline, discipline, and administrative order; exemplify the implementation of internal rules and regulations of the agency;

- Be dedicated, responsible, integrity, honest, objective, impartial, and exemplary in the performance of public tasks; politeness, culture, and norms in communicating and serving the people;

- Lead a healthy, humble, and united lifestyle and living; get need, thrift, integrity, righteousness, impartiality; fail to take advantage of public affairs to pursue personal interests; no bureaucracy, corruption, waste, negativity;

- Regularly have a sense of learning and training to improve quality, qualifications, and capacity.

- Be healthy enough to complete the assigned tasks.

- Officials applying for the exam for rank promotion must meet the standards and conditions prescribed by the Government of Vietnam.

From May 18, 2024, what are the regulations on the salary classification for civil judgment enforcement officials in Vietnam under the newest Circular?

Under Article 13 of Circular 02/2024/TT-BTP, the salary classification for civil judgment enforcement officials in Vietnam is specified as follows:

- Civil judgment enforcement officials are entitled to apply professional payroll applicable to officials in State agencies (Payroll 2) issued together with Decree 204/2004/ND-CP (amended and supplemented by Decree 17/2013/ND-CP) as follows:

- The salary coefficient of officials of class A3, group A3.1 shall be applied to Senior Enforcer and Senior Examiner in judgment enforcement;

- The salary coefficient of officials of class A2 and group A2.1 shall be applied to Intermediate Enforcer and Principal Examiner in judgment enforcement;

- The salary coefficient of class A1 officials shall be applied to Primary Enforcer, Examiner in judgment enforcement, and Clerk in judgment enforcement;

- The salary coefficient of class B officials shall be applied to Intermediate Clerk in judgment enforcement.

What are the training and retraining qualifications of civil judgment enforcers in Vietnam from May 18, 2024?

According to the provisions of Circular 02/2024/TT-BTP, training and retraining qualifications of civil judgment enforcers in Vietnam are specified as follows:

[1] Senior Enforcer (Clause 4 Article 5 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

- Have a certificate of retraining the state management knowledge and skills for the senior official rank and equivalent or advanced degrees in political and administrative theory;

- Possess an advanced diploma in political theory or an advanced diploma in political-administrative theory or a diploma or certificate certifying the political theory level equivalent to the advanced level of the political theory of the competent authority;

- Have certificates of retraining knowledge and skills as required for job positions for senior enforcers according to the program contents of the Ministry of Justice.

[2] Intermediate Enforcer (Clause 4 Article 6 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

-Have a certificate of retraining the state management knowledge and skills for the principal official rank and equivalent or advanced degrees in political and administrative theory;

- Have certificates of retraining knowledge and skills as required for job positions for intermediate enforcers according to the program contents of the Ministry of Justice.

[3] Primary Enforcer (Clause 4 Article 7 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

- Have certificates of retraining state management knowledge and skills for official rank and equivalent;

- Have a certificate of professional training in civil judgment enforcement.

Circular 02/2024/TT-BT will come into force from May 18, 2024.
