From July 1, 2024, will only eID accounts be allowed to be used for carrying out administrative procedures online?

On May 20, 2024, the Prime Minister of Vietnam issued Directive 16/CT-TTg 2024 to continue promoting the reduction and simplification of administrative procedures at ministries, central authorities, and local authorities for serving people and enterprises.

In particular, with the content of reform of carrying out administrative procedures, the Prime Minister of Vietnam requests Ministers of ministries, heads of ministerial-level agencies, Government-attached agencies, Presidents of People's Committees of provinces and municipalities to perform several tasks as follows:

- Continue to effectively implement the renewal of the single-window system and interlinked single-window system in handling administrative procedures, focusing resources on accelerating the digitization of records and results of handling administrative procedures, linking digitization with the performance of duties of officials and public employees in the process of receiving and settling administrative procedures; promote the reuse of digitized data among ministries, central authorities, and local authorities through data connection and sharing; upgrade the synchronous information technology infrastructure system from central to local level under national digital transformation requirements, ensure information security and safety, promote connectivity, integration and data sharing in service of directing, administering and handling administrative procedures, providing public services.

- Focus on implementing interlinked online public service groups to prioritize reviewing and restructuring the integration process, provided on the National Public Service Portal in 2024 according to Decision 206/QD-TTg in 2024 of the Prime Minister. At the same time, review, evaluate, and restructure the process for online public services being integrated, provided on the National Public Service Portal, ensuring the principle of user-centricity.

- Focus on successfully implementing the Scheme on the development of data application on population, electronic identification and authentication for national digital transformation in the period of 2022 - 2025 with a vision to 2030 (Scheme 06), especially the tasks and solutions in Directive 04/CT-TTg in 2024 of the Prime Minister to definitively handle institutional bottlenecks, information technology infrastructure, data, human resources, funding.

- Ensure essential conditions to convert to using only eID accounts for carrying out administrative procedures and providing public services in the electronic environment from July 1, 2024 according to Decree 59/2022/ND-CP.

- Strictly implement the receipt and timely settlement of complaints and petitions of people and enterprises; strengthen dialogue and definitively resolve problems and difficulties in mechanisms, policies, and administrative procedures; improve the quality of human resources to handle administrative procedures.

- Continue to conduct the inspection and audit of administrative procedure reform to improve official duty ethics, strengthen administrative discipline, and promptly handle cases of avoidance, extruding, fear of mistakes, and fear of responsibility; monthly publicize the results of the assessment of the quality of service to the people and enterprises according to Decision 766/QD-TTg in 2022 of the Prime Minister on the National Public Service Portal, the Public Service Portal at ministerial and provincial levels, the Portal of ministries, central and local authorities.

What is an eID account in Vietnam used for?

Under the provisions of Article 13 of Decree 59/2022/ND-CP on access to eID accounts:

- EID holders shall be entitled to log in eID accounts to access features and services of the VNelD application or electronic identification webpages.

- Access to eID accounts created by the electronic identification and authentication system can be granted to carry out administrative procedures or public administration services in cyberspace and other activities to meet the demands of eID holders.

- Agencies, entities and persons shall be entitled to create accounts for use in their activities; must ensure authenticity and accuracy of the accounts that they create on their own; can decide the level and value of each of these accounts. Information required for creation of accounts are provided by account holders; or used by agencies, entities or persons for its original purposes with authorization from account holders.

- Level-1 eID accounts created by the electronic identification and authentication system, once access to them being granted to eID holders who are Vietnamese citizens, shall have the value of providing proof of their information specified in clause 1 of Article 7 of Decree 59/2022/ND-CP; once access to them being granted to eID holders who are foreigners, shall have the value of providing proof of their information specified in clause 1 of Article 8 of Decree 59/2022/ND-CP when these eID holders carry out activities or transactions requiring their personal information to be provided.

- Level-2 eID accounts created by the electronic identification and authentication system, once access to them being granted to eID holders who are Vietnamese citizens, shall have the same value as ID cards when they perform transactions requiring ID cards to be presented; shall have the value of providing information available on documents of citizens that are already synced to eID accounts to enable agencies and organizations having relevant competence to check when they perform transactions requiring these documents to be presented.

- Level-2 eID accounts created by the electronic identification and authentication system, once access to them being granted to eID holders who are foreigners, shall have the same value as passports or international travel documents with respect to transactions requiring passports or international travel documents to be presented; shall have the value of providing information available in documents of foreigners synced to eID accounts to enable agencies and organizations having relevant competence to check when they perform transactions requiring these documents to be presented.

- As a holder of the eID account created by the electronic identification and authentication system, any eID holder that is a non-person entity can grant access to this account to its legal representative or authorized trustee. eID accounts, once access to them being granted to non-person entities, shall have the value of providing proof of their eIDs when they perform any transaction requiring proof of information about them to be provided; shall have the value of providing information available in documents of these non-person entities synced to their eID accounts in order to enable agencies or organizations having relevant competence to check when they perform transactions requiring these documents to be presented.

The value of access to level-2 eID accounts granted to any eID holder for use in their electronic activities or transactions shall be the same as the value of the act of presenting papers or documents to provide proof of information integrated into eID accounts.

What are the prohibited acts in using eID accounts in Vietnam?

Under the provisions of Article 6 of Decree 59/2022/ND-CP, an eID holder must not commit the following acts:

- Use of the eID account for performing illegal acts and transactions; infringing upon national security, defense, national interest, public interest, legitimate rights and interests of natural and legal persons;

- Unauthorized interference with the electronic identification and authentication system.
