Vietnam: From April 15, 2022, what are the regulations on the standards for official residences for central and local agencies, the Ministry of National Defense and the Ministry of Public Security?

I heard that from April 15, 2022, the standards for official residences for central and local agencies, the Ministry of National Defense and the Ministry of Public Security have been re-regulated. I wonder what those regulations are. I would like to learn about this, thanks!

The standards for official residences are specified in Articles 4, 5 and 6 of Decision 03/2022/QD-TTg of Vietnam (effective from April 15, 2022) as follows:

Standard of official residences for central agencies

(1) Politburo member, Secretary of the Party Central Committee may arrange to rent official villas, meeting the requirements as prescribed at Point a, Clause 1, Article 3 of this Decision:

a) The area of the campus is from 450 m2 to 500 m2;

b) Removable furniture includes:

- Living room: 01 set of tables and chairs and 01 TV shelf;

- Kitchen: 01 dining table and chairs, 01 refrigerator;

- Bedroom: 01 wardrobe, 01 bed, 01 mattress;

- 01 set of desks and chairs; 01 washing machine.

c) The maximum cost norm for furnishing this official villa is 350 million VND.

(2) The President of the Central Committee of the Vietnam Fatherland Front, the Vice President of the State, the Vice President of the National Assembly, the Deputy Prime Minister and the equivalent level or higher may arrange to rent official villas to meet the requirements as prescribed at Point a, Clause 1, Article 3 of this Decision:

a) The area of the campus is from 350 m2 to 400 m2;

b) Furnishing furniture as specified at Point b, Clause 1 of this Article;

c) The maximum cost norm for furnishing and moving furniture for this official villa is VND 300 million.

(3) Members of the Party Central Committee, Heads of Party Committees at the central level, Chairmen of Committees of the National Assembly, Ministers, Heads of Central mass organizations, Heads of Government-affiliated agencies and equivalent levels or higher may arrange for rent one of the following two types of official residences:

a) Adjacent houses must satisfy the requirements specified at Point b, Clause 1, Article 3 of this Decision:

- Land area from 200 m2 to 250 m2;

- Furnishing furniture as specified at Point b, Clause 1 of this Article.

b) Apartment:

- Usable area from 145 m2 to 160 m2;

- Furnishing furniture as specified at Point b, Clause 1 of this Article.

c) The maximum cost norm for furnishing moveable furniture for adjacent houses or official apartments specified in this Clause is VND 250 million.

(4) Deputy Head of the Central Party Committee, Vice Chairman of the Central Committee of the Vietnam Fatherland Front, Vice Chairmen of Committees of the National Assembly, Deputy Ministers and scientists assigned to preside over scientific and public tasks. Especially important national technology according to the provisions of the Law on Science and Technology and equivalent level or higher may arrange apartments for rent:

a) Usable area from 100 m2 to 145 m2;

b) Furnishing furniture as specified at Point b, Clause 1 of this Article;

c) The maximum cost norm for furnishing and moving the serviced building apartment specified in this Clause is VND 200 million.

(5) Official residences standards for the Ministry of National Defense and the Ministry of Public Security are specified in Article 6 of this Decision.

Standards of official residences for the locality

(1) The secretary of the provincial Party Committee and the equivalent level may lease one of the following two types of official residences:

a) Adjacent houses must satisfy the requirements specified at Point b, Clause 1, Article 3 of this Decision:

- Land area from 200 m2 to 250 m2;

- Furnishing furniture as specified at Point b, Clause 1, Article 4 of this Decision.

b) Apartment:

- Usable area from 145 m2 to 160 m2;

- Furnishing furniture as specified at Point b, Clause 1, Article 4 of this Decision.

c) The maximum cost norm for furnishing moveable furniture for adjacent houses and official-duty apartment buildings specified in this Clause is VND 250 million.

(2) Deputy Secretary of the Provincial Party Committee, President of the province, city directly under the Central Government and equivalent level or higher may lease one of the following two types of official residences:

a) Adjacent houses must satisfy the requirements specified at Point b, Clause 1, Article 3 of this Decision:

- Land area from 120 m2 to 150 m2;

- Furnishing furniture as specified at Point b, Clause 1, Article 4 of this Decision.

b) Apartment:

- Usable area from 100 m2 to 145 m2;

- Furnishing furniture as specified at Point b, Clause 1, Article 4 of this Decision.

c) The maximum cost norm for furnishing moveable furniture for adjacent houses and official-duty apartment buildings specified in this Clause is VND 200 million.

(3) Chairpersons of district-level People's Committees, Directors of Departments and equivalent levels or higher, senior experts, scientists assigned to preside over particularly important national-level science and technology tasks according to regulations. as defined by the Law on Science and Technology or public employees (teachers, doctors and medical staff) of non-business units with leadership and management positions equivalent to Department Directors or higher are assigned to apartment rental:

a) Usable area from 80 m2 to 100 m2;

b) Furnishing furniture specified at Point b, Clause 1, Article 4 of this Decision;

c) The maximum cost norm for furnishing and moving the serviced building apartment specified in this Clause is VND 150 million.

(4) Cadres, civil servants and public employees (teachers, doctors and medical staff) who have leadership and management positions may be transferred or rotated to work in remote and remote communes, Areas with extremely difficult socio-economic conditions, border areas and islands may rent out houses:

a) Usable area is from 36 m2/room to 48 m2/house (excluding the area of auxiliary works);

b) Furnishings include: 01 table and chair, 01 refrigerator, 01 wardrobe, 01 washing machine, 01 fan, 01 bed, 01 mattress;

c) The maximum cost norm for furnishing the house specified in this Clause is VND 80 million.

(5) Cadres, civil servants and public employees (teachers, doctors and health workers) who have professional positions suitable to work in remote communes, areas with economic conditions - In extremely difficult society, in border areas and islands, it is possible to rent out dormitories:

a) Usable area is from 24 m2/room to 36 m2/room (excluding the area of auxiliary works); average area at least 12 m2/person;

b) Furnishings include: 01 set of tables and chairs, 01 refrigerator, 01 shared washing machine; each person is equipped with 01 wardrobe, 01 fan, 01 bed, 01 mattress;

c) The maximum cost norm for furnishing the dormitory room specified in this Clause is VND 60 million.

Standards of official residences of Ministry of National Defense, Ministry of Public Security

(1) The Ministry of National Defense of Vietnam, based on this Decision, develops standards of official-duty housing for active-duty soldiers, defense workers and public employees, and coordinates with the Ministry of Construction to agree on subjects, conditions and standards and norms of official residences before submitting them to competent authorities for consideration and decision.

(2) The Ministry of Public Security of Vietnam shall base itself on this Decision to develop official-duty housing standards for officers, non-commissioned officers and soldiers currently serving in the people's police force, and coordinate with the Ministry of Construction to unify on subjects, conditions and standards and norms of official residences before submitting them to competent authorities for consideration and decision.

This Decision takes effect from April 15, 2022 and replaces the Prime Minister's Decision 27/2015/QD-TTg dated July 10, 2015 on standards of official residences.
